When exactly should I file for EDD pregnancy disability leave at 36 weeks? Confused about payment timeline
I'm 34 weeks pregnant and getting nervous about timing my leave application. My doctor mentioned she'll clear me for pregnancy disability leave at 36 weeks, but I'm totally confused about WHEN I should actually file with EDD? Like, do I wait until exactly 36 weeks to submit the claim, or should I do it earlier? Also stressing about whether this part of my leave will be paid or unpaid - my HR person wasn't clear and just said

You should file your claim with EDD as soon as your doctor completes the medical certification (DE2501) form. Don't wait until you're exactly 36 weeks - you can actually submit it up to 9 days before your first day of disability. EDD recommends filing promptly to avoid payment delays.\n\nAs for payment, pregnancy disability is considered State Disability Insurance (SDI), not PFL. It's paid at approximately 60-70% of your wages (depending on your income) for up to 4 weeks before your due date and 6-8 weeks after birth (longer if C-section). There's a 7-day waiting period before benefits start, so plan for that first week to be unpaid.

Thank you! So even though my doctor is clearing me at 36 weeks, I should submit the claim NOW? Or wait until she actually gives me the form? Sorry for being dense, I'm just so worried about messing this up and not having income!

i did mine last year and u can actually start the claim online before u even get the doctors note! just create the account and start the process and theres a part where it tells u that u need to get the doc to fill out their section but at least ull have ur part done

This is BAD advice!!! You absolutely SHOULD NOT file until you have the doctor's certification in hand. If you file early without medical documentation, EDD will send you confusing requests for additional info and potentially delay your claim!!! Happened to my sister and she didn't get paid for MONTHS because of this exact mistake!

Hi there! The process isn't as complicated as it might seem. Here's what you need to know:\n\n1. Your doctor needs to complete the DE2501 form (medical certification) stating when your disability begins (36 weeks in your case)\n\n2. You can file your claim AFTER the doctor completes this form but BEFORE your actual disability start date - EDD allows filing up to 9 days before your first day of disability\n\n3. There's a 7-day unpaid waiting period that begins on your disability start date\n\n4. After that waiting period, payments should begin if your claim is approved\n\n5. Pregnancy disability is paid at approximately 60-70% of your wages up to the maximum benefit amount\n\nOnce your pregnancy disability ends (usually 6-8 weeks after birth), you'll need to apply separately for Paid Family Leave for baby bonding. That's a completely different claim with no waiting period.

This is so helpful, thank you! So if I understand correctly: I wait until my doctor gives me the completed form at my 36 week appointment, then immediately file with EDD, then my benefits would start after the 7-day waiting period? And I'd need to separately apply for the baby bonding PFL after delivery?

Yes, exactly! You've got it right. Here's your timeline:\n\n1. Doctor completes form at 36 week appointment\n2. You immediately file with EDD (online is fastest)\n3. Your disability officially starts at 36 weeks \n4. First week is unpaid (waiting period)\n5. Benefits begin after waiting period if approved\n6. After birth + recovery period, file separate PFL claim for baby bonding\n\nOne tip: Ask your doctor's office if they can complete the form a few days before your 36 week mark. That way you can submit immediately when you hit 36 weeks without delay. Some doctors are happy to do this!

When I did this in 2023, the online system was HORRIBLE!!! I tried filing 5 times and kept getting errors. Finally got through to an EDD rep who fixed everything after I spent 3 hours on hold. If the website gives you problems, try Claimyr (claimyr.com) - they got me connected to an actual EDD rep in 20 minutes instead of hours on hold. They have a video showing how it works here: https://youtu.be/DOLxZQb92wM?si=6N1iCQ3a8Cdb2Ay5 - totally worth it when you're pregnant and stressed!

my cousin just went thru this! she said make sure ur doctor uses the RIGHT DATE on the form bc her doc put the wrong date and it messed up her whole claim and she had to file an appeal which took forever omg the stress nearly put her into early labor lollll

THIS!! Review EVERYTHING on the form before you leave the doctor's office! My OB's office staff entered the wrong date (they put my due date instead of my disability start date), and it created a NIGHTMARE with EDD. I literally had to get my doctor on the phone with EDD to straighten it out. Check every single date, especially the \

Another important note: make sure you understand the difference between Pregnancy Disability Leave (PDL) and Paid Family Leave (PFL) for baby bonding. They're two separate benefits, with separate applications:\n\n1. Pregnancy Disability (SDI) - What you're applying for at 36 weeks. Can start up to 4 weeks before due date with doctor certification. Continues for 6-8 weeks after birth (8 if C-section).\n\n2. Baby Bonding (PFL) - Starts after your recovery period. Currently offers 8 weeks of partial wage replacement. You'll file this claim AFTER your pregnancy disability ends.\n\nDon't try to apply for both at the same time - it doesn't work that way and will just create confusion.

That makes sense! I've been confusing the two. So pregnancy disability is what I'm about to apply for (at 36 weeks), and then after delivery I'll need to file for baby bonding PFL as a separate claim. I'm writing this all down now so I don't mess up the sequence!

You're absolutely right about keeping copies! My claim was delayed because they said they never received my doctor's certification, even though I had uploaded it online. Fortunately I had saved the confirmation screen. Still took 3 weeks to resolve though.

Thanks everyone for all the helpful advice! I'm going to:\n\n1. Wait for my doctor to complete the DE2501 at my 36 week appointment\n2. Double-check all dates on the form before leaving the office\n3. File my claim immediately after getting the form\n4. Keep copies of EVERYTHING\n5. Understand that the first week will be unpaid\n6. Remember that I'll need to file a separate PFL claim after delivery for baby bonding\n\nStill nervous but feeling much more prepared now! I'll update once I go through the process in case it helps someone else.

That's a perfect plan! One last tip: when you do eventually transition from pregnancy disability to PFL baby bonding, there might be a short gap in payments while the new claim processes. Try to have a small financial buffer for that transition period if possible. Good luck with everything!

Just wanted to add something that really helped me when I went through this process - create your EDD online account BEFORE you need to file! You can set up your account at any time, and it'll save you stress later when you're trying to submit your actual claim. The account setup can take a day or two to fully activate, so doing it early means one less thing to worry about when you're at 36 weeks and ready to file. Also, once your account is set up, you can explore the interface and get familiar with where everything is located. Made the whole process much smoother for me!

•This is such great advice! I hadn't even thought about setting up the account early. I've been so focused on getting the doctor's form that I forgot there's probably a whole registration process too. I'm definitely going to do this today - thanks for thinking of that detail! Did you run into any issues during the account setup, or was it pretty straightforward?

•@Edison Estevez This is brilliant advice! I wish I had known this earlier. I m'actually going to set up my account this week while I m'still at 34 weeks. Did you have any trouble with the identity verification part? I ve'heard some people say EDD s'ID verification can be finicky, so I want to make sure I have all my documents ready. Also, once you have the account set up, can you save your application as a draft or do you have to complete it all at once when you re'ready to submit?

•@Edison Estevez YES! Setting up the EDD account early is such a lifesaver. I made the mistake of trying to do everything at once when I was already stressed at 36 weeks and it was a nightmare. The identity verification took about 24 hours for me, and you ll'need your Social Security card, driver s'license, and recent pay stubs handy. Once your account is active, you can actually start filling out parts of the application and save it as a draft - you just can t'submit until you have the completed medical form from your doctor. This way you can take your time with all the employment history questions and wage information when you re'not rushing!

•@Edison Estevez This is amazing advice! I m'actually going to do this right now while I have some free time. Quick question - when you set up your account early, did you need to provide any pregnancy-specific information during the initial setup, or is it just the standard account creation? I want to make sure I m'not accidentally triggering any claim processes before I m'ready. Also, did you find the online tutorials or help section useful for understanding the different forms and requirements? I m'trying to educate myself as much as possible before my 36-week appointment!

•@Edison Estevez This is such helpful advice! I m'32 weeks and was planning to wait until closer to 36 weeks to deal with any of this, but you re'absolutely right about getting the account set up early. I just checked the EDD website and it looks like the basic account setup is just standard info - no pregnancy details needed until you actually file a claim. I m'going to create my account this weekend so I have plenty of time for any verification delays. Did you find that having the account ready made the actual claim submission much faster when the time came?

•@Edison Estevez This is fantastic advice that I wish someone had shared with me earlier! I m'currently 33 weeks and was planning to handle everything at the last minute, but you ve'convinced me to get organized now. Quick question - when you set up your EDD account early, were you able to explore the claim forms and see what information you d'need without actually starting a claim? I m'hoping to gather all my employment documents and wage information ahead of time so I m'not scrambling later. Also, did the account setup require any specific documentation beyond the usual ID verification stuff?

•@Edison Estevez Thank you so much for this tip! I m'31 weeks and hadn t'even considered setting up the account early. This makes total sense - why add more stress when I m'already going to be anxious about filing at 36 weeks? I m'going to create my account this week. Did you find that the EDD website works better at certain times of day? I ve'heard some people say mornings are less glitchy than afternoons when more people are online. Also, once you have the account set up, can you access any helpful resources or FAQs that might not be available to non-account holders?

I have a tendency to procrastinate on paperwork, so doing this early will definitely reduce my stress later. Quick question - when you set up your account, did you need to have any specific employer information ready, or is it pretty basic personal info at first? I want to make sure I have everything I need before I start the process. Also, did you notice if there are any video tutorials or step-by-step guides within the account portal that help explain the pregnancy disability process? I learn better with visual aids!

•@Edison Estevez This is incredibly helpful advice! I m'35 weeks now and was literally planning to wait until my doctor s'appointment next week to think about any of this. You ve'saved me so much potential stress! I m'going to set up my EDD account tonight. One thing I m'wondering - when you eventually filed your actual claim, did having the account already established mean you got faster processing times? I ve'heard some horror stories about claims taking weeks to process, and I m'hoping early preparation might help avoid some of those delays. Also, did you find it helpful to screenshot or print out the account setup confirmation for your records?

Also, when you were exploring the interface early, were you able to get a sense of how long the actual application takes to complete once you have all your documents ready? I m'trying to plan out my timing for when I hit 36 weeks!

I just went to the EDD website to check it out and wow, there are SO many different sections and forms - I can already tell it would be overwhelming to navigate for the first time when I m'stressed at 36 weeks. Quick question - when you set up your account early, did you get any email confirmations or notifications that you needed to respond to right away? I want to make sure I don t'miss anything important during the setup process. Also, once you had your account ready, did you feel more confident about the whole disability claim process, or were there still surprises when you actually filed?
