EDD Overpayment Nightmare: PFL and Disability Overlap Causing Benefit Chaos - Help!
Hey everyone, I'm in a bit of a pickle with EDD and could use some advice. I've got this weird situation where there was an overlap between my disability leave and paid family leave (PFL). Now it's causing all sorts of problems with my benefits. EDD paid me PFL during my initial disability period, which messed up my disability benefits for that time. I think I'm eligible for disability backpay, but now there's an overpayment issue too. Has anyone dealt with something like this before? How did you sort it out with EDD?

Ugh, EDD and their overlapping benefits mess. Classic. 🙄 I've been there, done that, got the t-shirt. Here's what you need to do: 1. Contact EDD ASAP. Like, yesterday. 2. Request a detailed breakdown of the overpayment. Get dates, amounts, everything. 3. Ask about the process for requesting disability backpay. 4. Document EVERYTHING. Every call, email, letter. Trust me, you'll need it. 5. Be prepared for a long, frustrating process. EDD moves slower than a snail on vacation. 6. If they're not helpful (shocker), consider reaching out to your local assemblyperson or state senator. They can sometimes light a fire under EDD's butt. Good luck, OP. You're gonna need it. 💪

This is solid advice right here. I'd add one more thing: check if you qualify for a waiver of the overpayment. Sometimes EDD will waive it if it wasn't your fault and repaying would cause financial hardship.

Thanks for the detailed advice! I'll definitely start documenting everything from now on. Any tips on how to phrase things when I talk to EDD? I always get nervous and forget what to say.

Pro tip: Write down your main points before you call. Keep it simple and stick to the facts. Ask them to explain anything you don't understand. And always, ALWAYS get the name of who you're talking to. It'll save your butt later if there's any confusion.

Hey now, let's not blame the workers. The system is broken, but most EDD employees are just trying their best with the resources they have.

I had a similar issue last year. It took FOREVER to resolve, but I finally got it sorted. Here's what worked for me: 1. I wrote a detailed letter explaining the situation and sent it certified mail. 2. I called every week for updates (be polite but persistent!). 3. I filed an appeal when they initially denied my request for backpay. 4. Eventually, I got a hearing and was able to present my case. It took about 4 months, but I eventually got my backpay and the overpayment was adjusted. Hang in there!

4 months?! 😱 Ugh, I was hoping for a quicker resolution. But I guess that's just how it goes with EDD. Thanks for sharing your experience!

Yeah, unfortunately EDD time moves differently than regular time. It's like dog years, but worse. 😅 Just keep at it and don't let them wear you down!

Has anyone tried using one of those paid services that call EDD for you? I've seen ads but idk if they're legit or worth the money.

I actually used one called Claimyr (claimyr.com) and it worked pretty well. It costs $20, but they dial the phone menu, stay on hold, and then connect you when a live agent picks up. Saved me hours of hold time. Here's a video about how it works: https://youtu.be/DOLxZQb92wM

Sounds too good to be true. Are you sure it's not a scam?

Nah, it's legit. I was skeptical at first too, but it really did work. They don't ask for any personal info beyond your phone number to call you back. Definitely beats listening to that hold music for hours!

Thanks for the info! Might give it a try if I keep striking out with the regular phone line.

unpopular opinion: maybe if people didn't try to game the system by double dipping on benefits, EDD wouldn't be so strict and slow 🤷♂️

Wow, way to blame the victims. Most people are just trying to get the benefits they're entitled to. It's not our fault the system is confusing af.

I'm just saying, there's always two sides to every story. 🤐

I promise I wasn't trying to game anything! The overlap happened because of how they processed my claim, not because I was trying to double dip. I'm just trying to get it corrected.

Pro tip: If you're having trouble reaching EDD by phone, try calling right when they open or about an hour before they close. The hold times are usually shorter then.

OP, have you considered reaching out to a workers' rights organization or a lawyer who specializes in employment law? They might be able to give you more specific advice or even advocate on your behalf.

I hadn't thought of that! Do you know if they usually charge for consultations? I'm already stressed about money with this whole situation.

Many offer free initial consultations. Try contacting your local legal aid society or look for pro bono clinics in your area. They often have experience dealing with EDD issues.
