Why would I be eligible for unemployment benefits in Washington state?
I'm trying to figure out if I qualify for unemployment benefits through Washington ESD. I left my job at a retail store last month because my hours got cut from 40 to 15 per week and I couldn't afford to live on that. My manager said it was temporary but it's been going on for 3 months. I've been working there for 2 years full-time before this happened. Does anyone know if this situation would make me eligible for Washington unemployment benefits? I'm confused about all the requirements and don't want to waste time applying if I don't qualify.

You might qualify under constructive discharge rules. When your hours get cut that drastically, Washington ESD sometimes considers it equivalent to being laid off. You'll need to show that the hour reduction made your job unsuitable.

•That's exactly what happened! Is there a specific percentage of hour reduction that qualifies?

•Generally if your hours drop by more than 50% consistently, it can be considered good cause for leaving. You'll need to document the hour changes.

I had a similar situation and it was such a pain trying to get through to Washington ESD to explain my case. Took me weeks of calling before I could talk to someone who understood constructive discharge.

•Oh no, how long did it take to get approved? I'm already stressed about money.

•About 6 weeks total but most of that was just waiting to speak to someone. Once I explained the situation properly they approved it.

I used this service called Claimyr recently when I couldn't get through to Washington ESD about my claim. You can check it out at claimyr.com - they have this video demo at https://youtu.be/7DieNd3C7zQ that shows how it works. Basically they help you get connected to an actual ESD agent instead of being stuck in phone queue hell.

•Is that legit? I've never heard of using a service to help with unemployment calls.

•Yeah it's real. I was skeptical too but it actually worked. Much better than spending hours on hold every day.

•Wait, do you have to pay for that? I don't have money to spend on getting through to ESD.

•The service has a cost but for me it was worth it to actually talk to someone instead of wasting weeks. Check their website for details.

Basic eligibility for Washington unemployment: you need to have worked and earned enough wages in your base period, be unemployed through no fault of your own, be able and available for work, and actively seek work. Your situation with the hour cuts could qualify as involuntary unemployment.

•What's the base period? I've been working steadily for 2 years.

•Base period is usually the first 4 of the last 5 completed calendar quarters before you file. With 2 years of work history you should easily meet the wage requirements.

ugh the whole system is so confusing! I tried to apply last year and gave up because I couldn't figure out if I qualified. ended up just finding another job instead

•That's what I'm worried about! Did you ever find out if you actually qualified?

•never found out lol. probably should have stuck with it but the website was so overwhelming

For your specific case, you'll want to emphasize that you had good cause for leaving due to substantial change in work conditions. Keep records of your pay stubs showing the hour reduction and any communications with your employer about it.

•I have all my pay stubs! Should I include them when I apply online?

•Yes, upload them as supporting documentation. Also write a detailed explanation in your application about why you left.

RETAIL WORKERS GET SCREWED OVER ALL THE TIME! Same thing happened to me and Washington ESD acted like I quit for no reason. Had to appeal and everything. These companies know exactly what they're doing when they cut hours.

•Did you end up winning your appeal? I'm really worried about that whole process.

•Yeah but it took MONTHS. Document everything and don't let them intimidate you. You have rights as a worker.

Just make sure you apply as soon as possible. There's a waiting period and benefits are calculated from when you first become eligible, not when you finally get approved.

•Good point, I'll start the application tonight. Better to apply and find out than wait and lose time.

wait so if your hours get cut you can get unemployment? i thought you had to be completely fired

Malik Thomas
•Nope, major hour reductions can qualify as constructive discharge. It's like being forced to quit due to changed working conditions.

•damn wish i knew that when target cut my hours last year

Since you mentioned having trouble with calling Washington ESD - seriously consider that Claimyr service I mentioned earlier. When I was dealing with my own eligibility questions, I wasted so much time trying to get through on the phone. Would have saved me weeks of stress.

•I might try that if I run into problems. Thanks for the suggestion!

Make sure you're ready to do the job search requirements too. You have to apply for jobs and keep a log of where you applied.

Oliver Weber
•How many jobs do you have to apply for each week?
0 coins
Freya Larsen
•I think it's 3 per week but check the Washington ESD website to be sure. Requirements might have changed.

One more thing - when you file, be very clear that you left due to substantial reduction in hours making the job unsuitable. Don't just say you quit. The language you use matters for how they process your claim.

•That's really helpful advice. I'll make sure to word it carefully in my application.

You should also know that there might be a waiting week where you don't get paid even if approved. Plan your finances accordingly.

•Ugh, more waiting. But I guess that's better than nothing. Thanks for the heads up.

Your wage base and work history sound solid for eligibility. The main hurdle will be proving you had good cause for leaving. With your documentation of the hour cuts, you should have a strong case.

•That makes me feel more confident about applying. I was worried I'd automatically get denied for quitting.

Been following this thread - really informative! I'm in a similar boat with my restaurant job cutting shifts. Sounds like we both might have cases for constructive discharge.

Oliver Weber
•We should both apply! At least we know what to expect now from everyone's advice here.

•Definitely going to try. This thread convinced me it's worth the effort.

For anyone still struggling to reach Washington ESD by phone after applying, I can't recommend Claimyr enough. Saved me so much frustration when I needed to check on my claim status. The video demo really shows you exactly how it works.

REMEMBER - Washington ESD is required to help you even if your case is complicated. Don't let them brush you off. You paid into the system through your taxes and you deserve fair treatment.

•You're right. I need to remember that this is something I've earned, not a handout.

Final advice - start your application tonight and be thorough with your explanations. Better to provide too much information than too little. Good luck!
