Washington ESD - are you eligible for unemployment if fired from your job?
I got terminated from my retail job last week for being late too many times (honestly it was only like 6 times in 3 months but whatever). My manager said it was 'job abandonment' but I was never a no-show, just running 10-15 minutes behind because of bus issues. Can I still file for unemployment benefits with Washington ESD or does getting fired automatically disqualify you? I've been working for 2 years straight before this happened and really need the income while I look for something new.

Getting fired doesn't automatically disqualify you from unemployment benefits in Washington. The key question is whether you were terminated for 'misconduct.' Being late occasionally might not rise to the level of misconduct that would disqualify you, especially if it was due to transportation issues beyond your control.

•That's somewhat reassuring. Should I mention the bus situation when I file my claim?

•Absolutely. Document everything - bus schedules, any communication with your employer about the transportation issues, and whether you tried to resolve the problem.

I was in a similar situation last year - got fired for attendance issues but still qualified for UI benefits. Washington ESD will investigate and make a determination based on whether your actions constituted willful misconduct.

•How long did the investigation take? I'm worried about the adjudication process taking forever.

•Mine took about 3 weeks. They contacted my former employer and me separately to get both sides of the story.

File your claim immediately regardless. Don't let your employer's characterization stop you. 'Job abandonment' for tardiness is pretty weak - especially if you were showing up to work, just late due to public transportation.

•I'll start the application process today. Do I need to mention I was fired or can I just say I'm no longer employed?

•You have to be honest about being terminated. Lying on your unemployment application is fraud. But being fired for tardiness isn't the same as being fired for theft or violence.

Been trying to get through to Washington ESD for weeks about my own claim issues. The phone system is absolutely horrible - keeps hanging up after hours on hold. If you need to talk to someone about your eligibility, I recently found this service called Claimyr (claimyr.com) that actually got me through to an agent. They have a video demo at https://youtu.be/7DieNd3C7zQ showing how it works.

•How much does something like that cost? I'm already tight on money after losing my job.

•It's worth checking out their site for details. For me, getting through to resolve my claim was more important than continuing to waste time on hold.

•Never heard of this service before. Seems weird that you'd need to pay someone to call a government agency for you.

The unemployment system is SO messed up. They make it impossible to reach anyone and then act like we're criminals for needing help. I got denied initially for a similar situation but won on appeal.

•How did the appeal process work? Was it complicated?

•Not too bad actually. You just have to write a letter explaining your side and they'll schedule a hearing. The hearing officer was actually pretty fair.

For misconduct disqualification, Washington ESD looks at whether your actions were: 1) Connected to work, 2) Willful or wanton, 3) In disregard of employer's interests. Chronic tardiness could potentially meet these criteria, but transportation issues are often considered beyond your control.

•This is really helpful. I definitely wasn't trying to hurt my employer - I genuinely had bus issues and tried to make up the time.

•Did you ever talk to your boss about changing your schedule or finding solutions? That could help show you weren't being willfully negligent.

Whatever you do, don't wait to file. Even if Washington ESD initially denies you, you can appeal and still potentially get benefits backdated to when you first filed. The worst thing is not applying at all.

•Good point. I was hesitating because I thought getting fired meant automatic disqualification.

•Lots of people get unemployment after being fired. The bar for misconduct is actually pretty high - it's not just poor performance.

I hate to be that person but 6 times late in 3 months is actually pretty bad. Most employers have policies about attendance and they have to protect their business too.

•I get that, but it wasn't like I was skipping work. The bus route to my job had major delays during construction season.

•There's a difference between holding employees accountable and creating impossible situations. If public transit is unreliable, that's not really the employee's fault.

•Fair enough. I guess it depends on whether the employer was aware of the transportation issues and worked with you on solutions.

The key thing Washington ESD will examine is whether you had a good faith reason for the behavior that led to termination. Transportation issues, especially with public transit, often qualify as circumstances beyond your reasonable control.

•Should I gather documentation about the bus delays and construction in my area?

Isaac Wright
•Absolutely! Transit agency notices, construction schedules, anything that shows the delays were legitimate and not your fault.

Same thing happened to my brother - fired for tardiness but got unemployment because he could prove the bus route was unreliable. Washington ESD actually sided with him.

Evelyn Martinez
•That gives me hope. Did he have to go through an appeal or was he approved initially?

Vanessa Chang
•Initially denied, approved on appeal. The hearing officer said transportation issues weren't willful misconduct in his case.

Just wanted to follow up - that Claimyr service I mentioned earlier really helped me get through the Washington ESD phone maze. If you end up needing to speak with someone about your eligibility determination, it might be worth looking into.

•I'm curious about this too. The regular phone number for Washington ESD is basically unusable.

•Yeah, I spent literally weeks trying to get through the normal way. This actually worked and saved me so much frustration.

File your claim online at esd.wa.gov and be completely honest about everything. The adjudication process will sort out whether you qualify, but you can't qualify if you don't apply.

•Starting the application right after I post this. Thanks everyone for the encouragement and advice.

•Good luck! Remember you have appeal rights if the initial decision doesn't go your way.

Transportation issues are actually pretty common reasons for tardiness that don't necessarily constitute misconduct. I've seen plenty of cases where people got benefits after being fired for attendance when it was due to circumstances beyond their control.

•This whole thread has been really helpful. I was convinced I wouldn't qualify but now I feel like I have a real chance.

•The worst they can do is say no, and then you can appeal. Don't give up before you even try.

One more thing - when you file, make sure to mention any efforts you made to solve the transportation problem. Like if you tried different bus routes, left earlier, talked to your supervisor about schedule adjustments, etc.

Evelyn Martinez
•I did try leaving earlier but the construction delays were so unpredictable. Some days I'd be 20 minutes early, other days still late despite leaving at the same time.

•That actually helps your case - shows you were making good faith efforts to be on time.

Don't let your former employer intimidate you out of filing. Companies sometimes exaggerate misconduct to try to avoid their unemployment insurance costs going up. File your claim and let Washington ESD make the determination.

•I never thought about employers having financial incentives to contest claims. That makes sense though.

Daniel Price
•Exactly. Their UI rates can increase based on claims, so some employers will contest even legitimate claims.

Been following this thread and wanted to add - I used that Claimyr service someone mentioned earlier when I had issues with my claim adjudication. Really helped me get answers quickly instead of waiting weeks for a callback that never came.

•The Washington ESD phone system is legitimately broken. Any service that can actually get you through to a human is probably worth it.

Final advice: File immediately, be completely honest, document everything about your transportation situation, and don't get discouraged if you're initially denied. The appeal process exists for exactly these kinds of situations where the circumstances are complex.

Just to close this out - getting fired for tardiness due to public transportation issues is definitely not an automatic disqualification. You have a legitimate shot at benefits, especially if you can document the transportation problems were beyond your control.
