Can you sign up for Washington ESD unemployment if you get fired from your job?

I got terminated from my retail job yesterday for attendance issues (called in sick 3 times in 2 months). My manager said it was job abandonment but I have doctor notes for 2 of those days. Can I still file for unemployment benefits with Washington ESD or does getting fired automatically disqualify you? I'm really stressed about paying rent next month and don't know what my options are.

You can definitely file for unemployment even if you were fired. Washington ESD will investigate whether the termination was for 'misconduct' or not. Attendance issues might not always be considered misconduct, especially if you have medical documentation.

That's a relief to hear. Should I mention the doctor notes when I file my initial claim?

0 coins

Absolutely mention them. Keep copies of everything - the termination letter, doctor notes, any communication with your employer about the absences.

0 coins

File your claim ASAP even if you're not sure about eligibility. Washington ESD will make the determination during adjudication. The worst they can do is deny it, but you might be surprised - I've seen people get approved when they thought they wouldn't.

0 coins

How long does the adjudication process usually take? I'm in a similar situation and getting nervous about the wait.

0 coins

Can take anywhere from 2-6 weeks depending on complexity. They'll contact both you and your former employer to get the full story.

I went through this exact same thing last year. Got fired for tardiness but it wasn't willful misconduct - I was having car trouble. Washington ESD approved my claim after about 3 weeks of adjudication. The key is being honest about everything and providing documentation.

0 coins

Did you have to appeal the decision or did they approve it on the first review?

0 coins

They approved it initially. I think having documentation really helped my case - repair receipts, work schedule showing I tried to make up time, etc.

honestly the hardest part about filing after getting fired is actually reaching someone at Washington ESD to ask questions. I spent weeks trying to call them about my claim status and could never get through. Super frustrating when you're already stressed about money.

I had the same problem until I found this service called Claimyr. They actually got me connected to a Washington ESD agent within like 20 minutes. There's a demo video at https://youtu.be/7DieNd3C7zQ that shows how it works. Saved me hours of calling.

Wow really? I'll have to check that out. The regular phone system is basically impossible.

Make sure you understand the difference between being fired FOR CAUSE vs just being let go. If they fired you for stealing or violence, that's definitely misconduct. But attendance issues, especially with medical reasons, usually aren't considered willful misconduct.

0 coins

They said it was job abandonment but I never quit or said I was quitting. Is that different from misconduct?

0 coins

Job abandonment claims are tricky. If you were still showing up (even late) and didn't formally quit, that's usually not abandonment. Document everything about your termination meeting.

0 coins

The system is so confusing. I got fired 6 months ago and my claim got denied initially but then approved on appeal. Don't give up if you get a denial letter - about 40% of appeals get overturned according to Washington ESD statistics.

0 coins

How long did the appeal process take? I might need to go that route too.

0 coins

About 8 weeks total from filing the appeal to getting the hearing decision. Worth it though - I got backpay for all the weeks I would have been eligible.

0 coins

YES you can file! I got fired from my warehouse job for 'performance issues' and was approved. Washington ESD looks at whether you were trying to do your job properly. Sounds like you were calling in sick legitimately, not just skipping work.

0 coins

Thanks for the encouragement! I was definitely trying to follow proper procedures for calling in sick.

0 coins

That's exactly the kind of thing that helps your case. Shows you weren't just being irresponsible.

0 coins

Just wanted to say I used Claimyr too after seeing it mentioned here. Got through to Washington ESD in about 15 minutes to check on my adjudication status. The site is claimyr.com if anyone needs it. Way better than the regular phone system.

Mei Liu

Did it cost a lot? I'm already tight on money.

0 coins

It was worth it for me. Much better than wasting entire days trying to call and never getting through.

0 coins

File your weekly claims even during adjudication! This is super important. If you're eventually approved, you'll get backpay for those weeks, but only if you filed the claims.

0 coins

Good to know! I wasn't sure if I should file claims while waiting for the decision.

0 coins

Definitely file them. Even if the payment shows $0, you're establishing your claim for those weeks.

0 coins

The attendance thing is tricky but medical absences are usually protected. Did you follow your company's policy for calling in? If you did everything right and have documentation, you should be fine.

0 coins

I called the manager directly each time, which was the policy. And I brought in doctor notes when I came back.

0 coins

That sounds like you followed proper procedure. Keep records of when you called and who you spoke to.

0 coins

Washington ESD will send a questionnaire to both you and your employer asking about the termination. Be completely honest but also emphasize that you were following company policy and had legitimate medical reasons.

0 coins

How detailed should those questionnaire responses be? I don't want to write too much or too little.

0 coins

Be thorough but stick to facts. Include dates, times, who you spoke with, and attach any supporting documents.

0 coins

I'm dealing with something similar right now. Got fired for missing work but it was because of my kid being sick. Still waiting on my adjudication decision after 4 weeks. This whole process is nerve-wracking.

0 coins

4 weeks is a long time! Have you been able to talk to anyone about the status?

0 coins

I finally got through using that Claimyr service someone mentioned. Agent said it's still under review but should have an answer soon.

0 coins

File immediately and don't assume you'll be denied. The worst case is they say no and you appeal. Best case is they approve it right away. Either way, you need to get the process started.

0 coins

You're right, I need to stop overthinking it and just file. Thanks for the push!

0 coins

Exactly! Nothing to lose by filing and everything to gain if you're approved.

0 coins

Make sure you're also looking for new work and keeping a job search log. Washington ESD requires 3 job contacts per week, and you need to be actively seeking work to maintain eligibility.

0 coins

When do I need to start the job search requirements? Right away or after I'm approved?

0 coins

You should start immediately. Even during adjudication, you need to be available and actively seeking work.

0 coins

Don't let your employer intimidate you into not filing. Some employers will try to discourage former employees from applying for unemployment. You have every right to file a claim.

0 coins

This is so true. My former boss tried to tell me I couldn't get unemployment because I was fired. Total lie.

0 coins

Employers sometimes say that to reduce their unemployment tax burden. Washington ESD makes the final decision, not your former employer.

0 coins

Just to add another success story - I was fired for 'poor performance' but got approved because I was trying my best and following all policies. Washington ESD really does look at the whole situation, not just the fact that you were fired.

0 coins

That gives me hope. I really was trying to do everything right at my job.

0 coins

That's what matters. As long as you weren't intentionally doing anything wrong, you have a good shot at approval.
