Do you get unemployment when fired - Washington ESD eligibility question

Got terminated from my warehouse job last Friday for attendance issues (called out sick 4 times in 6 weeks). My supervisor said it was job abandonment but I was actually sick those days. Can I still file for unemployment benefits with Washington ESD or am I automatically disqualified because I was fired? Really stressed about paying rent next month and don't know if it's even worth applying.

You can definitely still file! Being fired doesn't automatically disqualify you from unemployment benefits in Washington. The key is whether you were fired for misconduct or not. Attendance issues can be tricky - if you had legitimate reasons for the absences (like being sick), that might not count as misconduct.

Thanks! I do have a doctor's note for two of those sick days. Should I include that when I file my claim?

0 coins

Absolutely include any documentation you have. Doctor's notes, medical records, anything that shows your absences were legitimate.

Washington ESD will investigate your separation through what's called adjudication. They'll contact both you and your employer to get both sides of the story. Even if your employer says it was misconduct, you can present your evidence about why the termination wasn't your fault.

0 coins

How long does this adjudication process usually take? I need to know if I should start looking for other income sources.

0 coins

Can take anywhere from 2-6 weeks depending on how complex your case is. You should definitely file your claim right away though, even while it's being investigated.

I was in a similar situation last year. Got fired for what my boss called 'poor performance' but I had never received any written warnings. Washington ESD approved my claim after the investigation. The key is being honest about what happened and providing any documentation that supports your side.

0 coins

That gives me hope! Did they contact your former employer during the investigation?

0 coins

Yes, they did. My employer tried to fight it but since they couldn't prove misconduct, I got approved. Took about 3 weeks total.

0 coins

File your claim ASAP regardless. Even if there's a chance you might not qualify, it's better to have the process started. You won't get benefits for the weeks you don't file, so don't wait. I learned this the hard way when I hesitated for two weeks after getting laid off.

0 coins

Good point, I'll file tomorrow morning. Is the online application pretty straightforward?

0 coins

Yeah, it's not too bad. Just have your employment history ready and be prepared to explain the circumstances of your termination honestly.

Had trouble reaching Washington ESD when my claim went into adjudication for a firing situation. Kept getting busy signals for weeks. Finally found this service called Claimyr that helped me get through to an actual agent. They have a website at claimyr.com and there's a demo video at https://youtu.be/7DieNd3C7zQ showing how it works. Really saved me a lot of stress trying to get answers about my claim status.

0 coins

Interesting, never heard of that. Is it expensive to use?

0 coins

They don't publish pricing but it was worth it to actually talk to someone instead of calling 50+ times a day. The peace of mind was huge when my claim was under review.

0 coins

I used them too when I couldn't get through about my adjudication delay. Really does work - got connected to an agent within a few hours instead of weeks of calling myself.

0 coins

Just remember that even if you get approved, there might be a waiting week before benefits start. And you'll need to file weekly claims and do job searches. Don't slack on the job search requirements - they're pretty serious about that now.

0 coins

What exactly are the job search requirements? I haven't looked for work in 3 years since I had this job.

0 coins

You need to make at least 3 job search contacts per week and keep a log. Can be applications, networking, interviews, etc. WorkSourceWA has good resources for this.

0 coins

don't listen to these people saying you'll definitely get approved... if you got fired for attendance thats usually misconduct. my friend got denied for the same thing

0 coins

Not necessarily true. If the absences were for legitimate reasons like illness, that's different than just skipping work. Each case is individual.

0 coins

maybe but employers usually fight these claims hard. just saying don't get your hopes up too much

0 coins

The timing of when you file matters too. Your benefit year starts the week you file, not when you were terminated. So if you wait a month to file, you lose those weeks of potential benefits even if approved.

0 coins

Oh wow, I didn't know that. So I should file this week even though I just got fired Friday?

0 coins

Yes, absolutely. You can't backdate benefits to before you filed your initial claim.

0 coins

I got fired from a restaurant job for 'insubordination' which was really just me questioning unsafe working conditions. Still got approved for unemployment after explaining my side during the phone interview. Don't assume the worst!

0 coins

Did they schedule a phone interview with you automatically or did you have to request it?

0 coins

They scheduled it automatically as part of the adjudication process. Got a letter in the mail about a week after filing.

0 coins

Make sure when you file online that you're completely honest about the reason for separation. If Washington ESD finds out later that you lied or omitted important details, that can disqualify you even if you would have been approved with the truth.

0 coins

Yeah I'm planning to be totally upfront about the attendance issues but also explain about being legitimately sick.

0 coins

That's the right approach. They want the full story, not just what makes you look good.

0 coins

The unemployment system is so broken anyway. Takes forever to get answers and half the time you can't even get through on the phone. At least if you get denied you can appeal, but that takes even longer.

0 coins

That's why services like Claimyr are helpful. Takes the frustration out of trying to reach them when you need answers.

0 coins

True, though it's annoying you have to pay extra just to contact a government agency that's supposed to serve you.

0 coins

Been through this twice - once approved, once denied. The difference was documentation. First time I had nothing to back up my story, second time I kept records of everything. Save any texts, emails, write down conversations with supervisors.

0 coins

I have the text messages where I told my supervisor I was sick those days. Think that would help?

0 coins

Definitely! That shows you were communicating about legitimate absences, not just no-showing.

0 coins

Also remember that even if you don't qualify for regular unemployment, there might be other programs available depending on your situation. Sometimes people get denied UI but qualify for other assistance.

0 coins

Like what kind of other programs?

0 coins

Could be SNAP, housing assistance, utility help, depends on your income and family situation. Worth looking into if unemployment doesn't work out.

0 coins

Quick question - was this your first attendance issue or had you been written up before? That makes a big difference in whether it counts as misconduct.

0 coins

No written warnings, just verbal mentions that I needed to improve attendance. But like I said, I was actually sick those times.

0 coins

That's actually good for your case. Shows they didn't follow progressive discipline and you weren't just being irresponsible.

0 coins

Whatever you do, don't wait around hoping your employer might rehire you or anything like that. File for unemployment immediately and start looking for new work. Even if you think there's a chance of getting your job back.

0 coins

Yeah, that bridge is definitely burned. They made it pretty clear I wasn't welcome back.

0 coins

Then you've got nothing to lose by filing. Worst case scenario they deny you and you're in the same position you're in now.

0 coins

I used Claimyr when I couldn't get through to Washington ESD about my adjudication taking forever. Worked great - finally got to talk to someone who could explain what was happening with my case. Much better than calling dozens of times every day.

0 coins

How quickly did they get you connected to someone?

0 coins

Same day I signed up. Was such a relief after weeks of busy signals and dropped calls trying to do it myself.

0 coins

One last thing - keep filing your weekly claims even while your initial claim is under adjudication. If you don't file those weekly, you won't get paid for those weeks even if eventually approved.

0 coins

Good to know! I'll make sure to do that once I get the initial claim filed.

0 coins

Exactly. It's annoying to file claims when you don't know if you'll get approved, but you have to do it to preserve those weeks.

0 coins

Bottom line - you won't know until you try. File the claim, be honest about what happened, provide your documentation, and let Washington ESD make the decision. Don't disqualify yourself before they even get a chance to review your case.

0 coins

Thanks everyone for all the advice! Going to file first thing tomorrow morning and see what happens.

0 coins

Good luck! Hope it works out for you.
