If you are fired from a job can you collect unemployment in Washington?
Got terminated from my retail job last week for attendance issues (was late a few times due to childcare problems). My manager said I was fired for cause. Does this mean I can't file for Washington ESD unemployment benefits? I've been working there for 2 years and really need the income while I look for something new. Has anyone been in this situation before?

You can still apply! Being fired doesn't automatically disqualify you from UI benefits in Washington. It depends on whether Washington ESD determines it was misconduct or not. Attendance issues might not count as willful misconduct if you had valid reasons.

•That's encouraging! Should I mention the childcare situation when I file my claim?

•Absolutely mention it. Document everything - any communications with your employer about the attendance issues and your attempts to resolve childcare problems.

I got fired for similar reasons last year and still got approved for benefits. Washington ESD looks at whether you willfully violated company policy or if there were circumstances beyond your control.

•How long did it take for them to make a decision on your claim?

•About 3 weeks. They had to do an adjudication to review the circumstances of my termination.

The key thing is Washington ESD will contact both you and your former employer to get both sides of the story. If you can show the attendance problems were due to circumstances beyond your control (like childcare issues), you have a good chance of being approved.

•Will my old employer try to fight my claim? They seemed pretty upset when they fired me.

•They might respond to Washington ESD's inquiry, but many employers don't actively fight claims unless it was serious misconduct like theft or violence.

I had trouble getting through to Washington ESD when I needed to check on my adjudication status after being fired. Ended up using this service called Claimyr (claimyr.com) that helped me get connected to an actual agent. There's a video demo at https://youtu.be/7DieNd3C7zQ that shows how it works.

•Is that legit? I've never heard of services that help you call government agencies.

•Yeah it's real - they basically handle the waiting on hold part and connect you when an agent picks up. Saved me from spending hours trying to get through.

•I used Claimyr too when I had questions about my disqualification. Much easier than the normal calling process.

File your claim ASAP! Even if there's going to be an adjudication, you want to get the process started. The sooner you file, the sooner you might start receiving benefits if approved.

•Good point. I'll file tonight. Do I need any special documents?

•Just your social security number, employer information, and dates of employment. You can file online through the Washington ESD website.

ugh the whole system is so confusing. I got fired from my restaurant job for dropping too many plates and they made it sound like I'd never get benefits. But then I got approved anyway after they reviewed everything.

•That gives me hope! Were you worried during the adjudication process?

Aisha Patel
•Super worried! But it worked out. Just be honest about everything when they ask questions.

One thing to remember - even if you're initially denied, you can appeal the decision. The appeal process gives you another chance to present your case, especially if you have documentation about the childcare issues.

•How long do you have to file an appeal if denied?

Liam Murphy
•You have 30 days from the date of the determination letter to file an appeal with Washington ESD.

My sister got fired for attendance and got benefits. Key is showing it wasn't willful misconduct - sounds like your childcare situation would qualify as a valid reason for the attendance problems.

•Did she have to provide any proof of the childcare issues?

•She had some texts with her babysitter about cancellations and stuff like that. Any documentation helps.

Also remember that if you do get approved, you'll need to do your weekly claims and job search requirements. Don't forget about those once you start receiving benefits.

Sasha Ivanov
•What are the job search requirements exactly?

Amara Okafor
•You need to make at least 3 job search contacts per week and keep a log. Washington ESD has the details on their website.

The worst they can do is say no, right? Might as well apply and see what happens. Being fired doesn't automatically mean you can't get unemployment - I've seen plenty of people get approved.

•True! I'm definitely going to file tonight. Thanks everyone for the encouragement.

Just to clarify the process - Washington ESD will review your separation reason during adjudication. They'll look at whether your actions were willful misconduct connected with work. Chronic tardiness can sometimes qualify as misconduct, but if you can show it was due to circumstances beyond your control (like childcare), that changes things.

•That makes sense. I did try to work with my manager on the schedule but they weren't very flexible.

•Document those conversations if you can remember them. Showing you tried to resolve the issue can help your case.

FIRED FOR CAUSE IS BS HALF THE TIME!!! Employers just say that to try to avoid paying higher unemployment taxes. Don't let them scare you into not applying.

•You're probably right. My manager did seem like they were trying to make it sound worse than it was.

•@11 While employers do sometimes exaggerate, Washington ESD does thorough investigations during adjudication to get the real story.

I was in almost the exact same situation - single mom, childcare issues, fired for attendance. Got approved after about a month of adjudication. The caseworker was actually pretty understanding.

•That's so reassuring to hear! Did you have to do a phone interview?
0 coins
Tyrone Johnson
•Yes, they called me and my former employer separately. Just be honest and explain the childcare situation clearly.

If you have trouble reaching Washington ESD during your adjudication, I second the Claimyr recommendation from earlier. Sometimes you really need to talk to someone to clarify things, and their normal phone lines are impossible.

•Good to know there are options if I can't get through. The phone system does seem pretty overwhelming.

Quick question - did you get any written warnings about the attendance before they fired you? That might affect how Washington ESD views the situation.
0 coins
Sasha Ivanov
•I got one verbal warning a few weeks ago, but nothing in writing. Is that bad?

Ingrid Larsson
•Actually might help you - shows they didn't follow proper progressive discipline. Mention that in your adjudication interview.

Don't overthink it too much. File your claim, be honest during the adjudication process, and see what happens. Worst case you get denied and can appeal or look for other assistance programs.

•You're right. I'm probably worrying too much about something that might work out fine.

my cousin got fired for attendance issues last year and she got benefits no problem. washington is pretty fair about these things as long as you weren't doing anything really bad

•That's encouraging! I definitely wasn't doing anything malicious, just struggling with the schedule.

One last tip - when you file your claim, be very detailed about the circumstances that led to your attendance issues. The more context you provide upfront, the better Washington ESD can understand your situation during adjudication.

Sasha Ivanov
•Will do! I'll mention the childcare problems and that I tried to work with my employer on solutions.

Good luck! The adjudication process can be stressful but try not to worry too much. Sounds like you have a reasonable case based on what you've described.
