Washington ESD unemployment if you get fired from a job - can you collect benefits?

Got terminated from my warehouse job last week for attendance issues (had some car trouble and was late a few times). My supervisor said I was fired for cause. Does this mean I can't get unemployment benefits through Washington ESD? I've been working for 2 years straight before this happened and really need the income while I look for something new. Has anyone been in a similar situation?

You can still potentially qualify for unemployment even if you were fired, but it depends on the specific circumstances. Washington ESD will look at whether you were terminated for 'misconduct' or just poor performance. Attendance issues might not always count as misconduct if there were legitimate reasons.

That's helpful to know! The car trouble was real - I had to get it towed twice that month. Should I mention that when I file my claim?

0 coins

Definitely mention any legitimate reasons for the attendance issues. Document everything you can - repair receipts, towing records, etc. Washington ESD will investigate both sides of the story.

i got fired from my last job too and still got unemployment. took like 6 weeks though because they had to do an investigation thing

0 coins

6 weeks? That's a long time to wait. Did you have to do anything special during the investigation?

0 coins

just had to wait for them to contact my old employer and stuff. got a letter asking for my side of the story

File your claim right away regardless. Even if you're not sure about eligibility, it's better to have the claim in the system. The worst that happens is they deny it and you can appeal. The key thing is Washington ESD will determine if your termination was for misconduct or not.

0 coins

Good point about filing right away. I was worried about wasting their time if I wasn't eligible.

0 coins

Never worry about 'wasting their time' - that's literally what they're there for. The sooner you file, the sooner your claim can be processed.

I had such a hard time getting through to Washington ESD when I had questions about my termination claim. Spent hours on hold multiple times. Finally found this service called Claimyr that helped me get connected to an actual agent without the endless wait times. Check out claimyr.com - they have a demo video at https://youtu.be/7DieNd3C7zQ that shows how it works.

0 coins

Interesting, I've never heard of that. Does it actually work for getting through to Washington ESD?

0 coins

Yeah it worked for me. Saved me from sitting on hold for 2+ hours. The agent was able to explain exactly what documentation I needed for my termination case.

0 coins

How much does something like that cost? Seems like it might be expensive.

0 coins

It's worth it when you consider the time saved and getting actual answers. Much better than the automated system runaround.

0 coins

The whole system is rigged against workers anyway. They'll find any excuse to deny your claim even when you've been paying into unemployment insurance for years. Don't get your hopes up too much.

0 coins

That's not really accurate. Washington ESD has clear guidelines about what constitutes misconduct. Many people who are fired do receive benefits.

0 coins

Maybe in theory, but in practice they side with employers most of the time. I've seen it happen to too many people.

0 coins

Here's what you need to know about misconduct in Washington state: It has to be willful or wanton disregard of employer interests, or deliberate violations of reasonable workplace rules. Simple attendance issues due to transportation problems often don't meet that threshold.

0 coins

This is really helpful. I was never written up for anything else and my work performance was good. It was just the car situation that month.

0 coins

Yeah that doesn't sound like misconduct to me. I think you have a good chance of getting approved.

0 coins

make sure you file your weekly claims even while theyre investigating. i almost missed doing that and it wouldve messed up my whole claim

0 coins

Wait, I have to file weekly claims even before they approve my initial claim?

0 coins

Yes, you need to file weekly claims starting from your first week of unemployment. If you're eventually approved, those weeks will be processed for payment.

0 coins

Been there, done that. Got fired from a retail job for missing too many shifts (had COVID and they didn't believe me even with a doctor's note). Still got unemployment after they investigated. The key is being honest about everything.

0 coins

Did you have to provide a lot of documentation for your case?

0 coins

Yeah, had to send in the doctor's note, work schedule, and a written statement explaining my side. Took about 5 weeks total.

0 coins

Question - if you get fired can you start looking for work right away or do you have to wait for the unemployment decision first?

0 coins

You should start looking for work immediately regardless of your unemployment status. In fact, you're required to be actively seeking work to receive benefits once approved.

0 coins

Good to know! I wasn't sure about the timeline for that.

0 coins

Another thing - when you do get connected to Washington ESD (whether through regular channels or something like Claimyr), ask specifically about the adjudication process timeline. They can give you a better estimate of how long your case might take.

0 coins

That's a great tip. I'll definitely ask about timing when I call.

0 coins

Just want to add that if you do get denied initially, don't give up. The appeals process exists for a reason and many people win on appeal even after an initial denial.

0 coins

How long do you have to file an appeal if you get denied?

0 coins

You have 30 days from the date of the determination letter to file an appeal. Don't wait - file it as soon as possible.

0 coins

my brother got fired for attendance and got unemployment no problem. think it depends on your work history and if youve had issues before

0 coins

This was my first job where I had attendance issues, so hopefully that helps my case.

0 coins

One more important point - make sure you have your employer's correct information when you file. Washington ESD will need to contact them as part of the investigation, so accurate contact details are crucial.

0 coins

Should I contact my old HR department to get the right contact info, or just use what I have?

0 coins

Use what you have from your employment records. Washington ESD has ways to verify and find the right contacts if needed.

0 coins

The waiting is the worst part honestly. I was so stressed about money while waiting for my termination claim to be decided. Try to have some backup plans in place.

0 coins

Yeah, I'm already looking into food banks and other assistance programs just in case. The uncertainty is really stressful.

0 coins

Remember that Washington ESD looks at the 'last act' that led to your termination. If it was attendance due to car trouble rather than willful misconduct, you have a strong case. Document everything and be thorough in your application.

0 coins

Thanks for all the advice everyone. I'm going to file my claim today and gather all my documentation about the car problems.

0 coins

Good luck with your claim! Sounds like you have a decent chance based on what you've described. Keep us updated on how it goes.

0 coins

Will do! This thread has been super helpful. I feel a lot more confident about the process now.

0 coins

Does anyone know if you can work part-time while your termination claim is being investigated? I might be able to pick up some gig work.

0 coins

Yes, you can work part-time, but you need to report all earnings on your weekly claims. It might affect your benefit amount but won't disqualify you entirely.

0 coins

Thanks! That's good to know for planning purposes.

0 coins

The car trouble excuse might not hold up if it happened multiple times. Employers expect you to have reliable transportation. Just being realistic here.

0 coins

I understand that perspective, but it was genuinely car trouble, not just excuses. I have the repair receipts to prove it.

0 coins

Having documentation makes a big difference. Legitimate car trouble with proof is very different from just claiming car trouble.

0 coins

I used that Claimyr service someone mentioned earlier when I had questions about my termination benefits. Really did help me get through to an agent quickly instead of spending my whole day on hold.

0 coins

That seems to be a popular recommendation. I might give it a try if I have trouble getting through to Washington ESD.

0 coins

One thing to keep in mind - even if you get approved, there might be a waiting period before benefits start. Plan accordingly for your first few weeks.

0 coins

How long is the typical waiting period for termination cases?

0 coins

It varies, but usually 3-6 weeks for the investigation plus any standard waiting week. Could be longer if they need more information.
