Can I get Washington ESD unemployment benefits when fired from my job?
I got terminated from my warehouse job last Friday after working there for 2 years. My supervisor said it was for attendance issues but I feel like they were targeting me unfairly. I've never been on unemployment before and I'm not sure if I can even qualify since I was fired instead of laid off. Does anyone know if Washington ESD will approve benefits when you're fired? I really need the income while I look for another job.

It depends on WHY you were fired. If it was for misconduct (like stealing or fighting) then no benefits. But if it was for things like poor performance or attendance issues that weren't intentional, you might still qualify. Washington ESD will investigate and decide.

•They said it was attendance but I had legitimate reasons for some of my absences. How do I prove that to Washington ESD?

•Keep all your documentation - doctor notes, family emergency proof, anything that shows your absences were justified. You'll need it if they deny your claim initially.

I was fired for performance issues last year and still got approved for UI benefits. The key is that it has to be 'misconduct' for them to deny you, not just being bad at your job. File your claim anyway and let Washington ESD decide. The worst they can do is say no.

•That's encouraging to hear! How long did the process take for you?

•About 3 weeks from filing to getting my first payment, but that was before all the recent delays people talk about.

You should definitely file your claim as soon as possible. Even if you were fired, Washington ESD will review the circumstances. They'll contact your employer and you to get both sides of the story. If you were fired for reasons beyond your control or for simple mistakes (not willful misconduct), you can still qualify for benefits.

•Should I wait to file until I have all my documentation together or file now?

Jason Brewer
•File now! Don't wait. Your benefit week starts the week you file, not when you gather paperwork. You can submit additional documentation later if needed.

•This is exactly right - I waited 2 weeks to file thinking I needed everything perfect and lost those benefit weeks permanently.

I had such a hard time getting through to Washington ESD when I was going through something similar. Spent weeks calling and either getting busy signals or getting disconnected. Finally found this service called Claimyr that actually got me connected to a real person at Washington ESD who could explain my situation. Check out claimyr.com - they have a video demo at https://youtu.be/7DieNd3C7zQ that shows exactly how it works.

•How much does that cost? I'm already tight on money after losing my job.

•It's worth checking out their site for details. For me it was worth it just to get answers instead of calling for hours with no luck.

•I've heard mixed things about services like that. Did they actually help or just get you through faster?

•They got me connected to someone who could actually look at my claim and explain what was happening. Way better than the automated system.

The Washington ESD system is SO confusing when you're fired vs laid off. I thought for sure I wouldn't qualify when I got terminated but turns out there's a whole process they go through. They'll send questionnaires to both you and your employer asking for details about what happened.

Paige Cantoni
•What kind of questions do they ask in those questionnaires?
0 coins
Mason Stone
•They ask about the specific incidents that led to termination, whether you were warned, if you had training, stuff like that. Be honest but don't hurt your case by oversharing.

honestly the whole system is messed up... I know people who got fired for actual misconduct and still got benefits while others who did nothing wrong got denied. It's like they flip a coin sometimes

•That's not really accurate. Washington ESD follows specific guidelines for misconduct determinations. There are appeal processes if you disagree with their decision.

Savannah Vin
•maybe but it sure feels random when you're going through it

•The appeal process actually works though. I appealed my initial denial and won after presenting my evidence.

Just remember that even if you get approved, you still have to meet all the other requirements - looking for work, registering with WorkSource, filing weekly claims. Being fired doesn't change those obligations.

Paige Cantoni
•Do I need to register with WorkSource before I file my claim or can I do it after?
0 coins
Kylo Ren
•You can register after filing your initial claim, but don't wait too long. You'll need to show job search activities on your weekly claims.

The attendance thing might actually work in your favor if you can show it wasn't willful. I had a similar situation where I was fired for being late too much due to childcare issues. Washington ESD approved my claim because they determined it wasn't misconduct.

•That gives me hope! Some of my absences were for car trouble and one was when my kid was sick.

Kiara Fisherman
•Exactly! Those are legitimate reasons. Make sure you document everything when you file your claim.

•Just be careful not to make it sound like ongoing issues that would prevent you from working new jobs.

One thing to watch out for - if your employer contests your claim (which they probably will), it might go to adjudication. That's when Washington ESD does a full investigation and it can take several weeks to get a decision.

Paige Cantoni
•Will I get benefits while they're investigating or do I have to wait?
0 coins
Nina Fitzgerald
•You have to wait unfortunately. No payments during adjudication. But if you win, you get back paid for those weeks.

•That's why it's so important to have other income sources lined up if possible.

If you do end up in adjudication and need to speak with someone at Washington ESD, definitely consider using Claimyr again. I used them twice during my claim process and it saved me so much frustration trying to get through on my own.

•How quickly were you able to get through with their service?

•Usually within a few hours versus the days or weeks I was spending trying to call myself.

Here's what will likely happen: 1) You file your claim online, 2) Washington ESD sends questionnaires to you and your employer, 3) They review the responses and make a determination, 4) If approved, you start getting benefits, 5) If denied, you can appeal within 30 days.

•How long does step 3 usually take?

•It varies a lot right now. Could be anywhere from 2-8 weeks depending on their workload and how complex your case is.

don't let your employer intimidate you into not filing... they might try to tell you that you won't qualify but that's not their decision to make
0 coins
Paige Cantoni
•They didn't say anything about that but good to know they can't stop me from filing.

Emma Olsen
•nope, filing is your right. worst case they contest it and you still get a fair hearing

I got fired for attendance too but it was because I kept having panic attacks and couldn't make it to work. Ended up getting approved because it was related to a medical condition. If any of your absences were health-related, mention that.
0 coins
Paige Cantoni
•One absence was when I had food poisoning. Should I mention that specifically?
0 coins
Lucas Lindsey
•Yes! Any legitimate medical reason helps show it wasn't willful misconduct.

•Just make sure you have some kind of documentation if possible - even just texts to your supervisor about being sick.

The whole process is stressful but don't give up. Even if you get denied initially, the appeal process gives you another chance to present your side. I know several people who won on appeal after losing the first round.

Paige Cantoni
•Do I need a lawyer for the appeal process?
0 coins
Mason Stone
•Not necessarily. You can represent yourself, but some people do get legal help for more complex cases.

File ASAP and be completely honest in your application. Don't try to hide the fact that you were fired - they'll find out anyway when they contact your employer. Being upfront shows good faith.

Paige Cantoni
•Should I mention that I think the firing was unfair or just stick to the facts?
0 coins
Sophie Duck
•Stick to facts but you can explain your perspective on what happened. Just don't sound bitter or blame everyone else.

Make sure you understand the difference between 'misconduct' and 'gross misconduct' too. Regular misconduct might still qualify you for benefits after a waiting period, but gross misconduct disqualifies you completely.
0 coins
Paige Cantoni
•What's the difference between those two?
0 coins
Makayla Shoemaker
•Gross misconduct is serious stuff like theft, violence, or intentionally damaging company property. Regular misconduct is more like poor performance or minor policy violations.

The waiting game is the worst part honestly. Even when everything goes smoothly it feels like forever before you see any money.

•Yeah I'm worried about how I'm going to pay rent next month.

•Look into local assistance programs too while you wait. Food banks, utility assistance, stuff like that can help bridge the gap.

I used to work in HR and I can tell you that most employers will contest unemployment claims regardless of the circumstances. It's usually just automatic. Don't take it personally if they fight it.
0 coins
Paige Cantoni
•Why do they contest it automatically?
0 coins
Anita George
•It affects their unemployment insurance rates. The more claims they have to pay into, the higher their rates go.

•that's so messed up... they fire you then try to prevent you from getting help

Whatever you do, don't wait to file thinking you need to find another job first. You can look for work AND collect benefits at the same time - that's literally the point of the system.

Paige Cantoni
•Good point. I was thinking maybe I should just focus on job hunting but you're right.

•Exactly. The benefits are there to help you while you search. Use every resource available to you.

One last thing about Claimyr - I found them super helpful when I needed to get clarity on my specific situation. Sometimes you just need to talk to a real person who can look at your account and explain what's actually happening instead of guessing based on generic information online.
