Can I apply for Washington ESD unemployment if I was terminated from my job?
I got fired from my warehouse job last Friday after working there for almost two years. My supervisor said it was due to performance issues but I honestly think they were just looking for reasons to let me go since they've been cutting staff. I'm not sure if I can even apply for unemployment benefits through Washington ESD since I was terminated instead of laid off. Has anyone been approved for UI after being fired? I really need the income while I look for another job but don't want to waste time applying if terminated employees can't get benefits.

Yes, you can absolutely apply for unemployment even if you were terminated! The key is whether you were fired for misconduct or not. Performance issues usually don't count as misconduct under Washington ESD rules. You should definitely file your claim as soon as possible.

•Really? I thought being fired automatically disqualified you. How do they determine what counts as misconduct?

•Misconduct has to be willful or deliberate violations of company policy. Poor performance, inability to do the job, or personality conflicts usually don't qualify as misconduct.

I was terminated last year for attendance issues and still got approved for benefits. Washington ESD looks at the specific circumstances. File your claim online and let them make the determination.

•How long did it take for them to decide on your claim? I'm worried about the adjudication process taking forever.

•Mine took about 3 weeks because they had to contact my former employer. Be patient but persistent if you don't hear anything.

If you're having trouble getting through to Washington ESD to check on your claim status, I found this service called Claimyr that helped me connect with an actual agent. They have a website at claimyr.com and there's a demo video at https://youtu.be/7DieNd3C7zQ that shows how it works. Really saved me hours of calling.

•Is that service legit? I'm always skeptical of third-party services for government stuff.

•Yeah it's legitimate, they just help you get through the phone system. You still talk directly to Washington ESD agents, they just bypass the busy signals.

been there done that, got fired for being late too many times but still got my benefits. washington esd doesnt care as much about why you got fired as people think

•That's encouraging to hear. Did your employer try to fight your claim?

•nah they didnt bother. most employers dont contest unless its something really bad

You need to be very careful about how you describe the termination on your application. Don't volunteer information that might hurt your case, but don't lie either. Stick to the facts and let Washington ESD make their determination based on the employer's response.

•What if my employer lies about what happened? I'm worried they'll make it sound worse than it was.

•That's why it's important to keep documentation if you have any. Washington ESD will investigate both sides of the story if there are discrepancies.

•Exactly right. Keep any performance reviews, emails, or written warnings you might have received. They can help support your case.

THE SYSTEM IS RIGGED AGAINST WORKERS!!! They'll find any excuse to deny your claim and then you have to wait months for an appeal. I got denied twice before finally getting approved.

Levi Parker
•What happened with your appeals? How long did the whole process take?

Brandon Parker
•TOOK ALMOST 6 MONTHS TOTAL! Had to go through two levels of appeals before they finally admitted I was right. Keep fighting if they deny you!

I'm in a similar situation - got let go for 'not being a good fit' which I think is just code for they didn't like me. Planning to file my claim tomorrow. This thread is really helpful.

•Good luck with your claim! 'Not being a good fit' usually isn't considered misconduct, so you should be fine.

•Thanks! I was really stressed about it but feeling more confident now.

One thing to remember is that even if you get approved, you still have to do the job search requirements. Don't forget about that part or they'll cut off your benefits.

•How many job contacts do you have to make each week in Washington?
0 coins
Hunter Hampton
•It's usually 3 job search activities per week, but it can vary based on your situation. They'll tell you the requirements when your claim is approved.

If you need to talk to someone at Washington ESD about your specific situation, that Claimyr service I mentioned earlier really does work. I was skeptical at first too but it's just a way to skip the busy phone lines. Saved me from calling 50+ times a day.

•It's worth checking out their site to see what they offer. The main thing is it actually works when you need to reach an agent.

Performance issues are definitely not the same as misconduct. I work in HR and we've had employees get approved for unemployment even after being terminated for poor performance. The bar for misconduct is pretty high.

Levi Parker
•That's really reassuring coming from someone in HR. What would qualify as misconduct then?

•Things like theft, violence, deliberate insubordination, or repeatedly violating clear company policies after warnings. Just not being good at your job doesn't count.

My brother got fired for arguing with his manager and still got unemployment. Don't stress too much about it, just file your claim and see what happens.

File ASAP because there's usually a waiting week before benefits start, and you want to get in the system as soon as possible. Every day you wait is money lost.

•Good point. I'll file my claim tonight. Is there anything I should gather beforehand?

•Have your Social Security number, employment history for the last 18 months, and your most recent employer's information ready. That's about it.

Remember that Washington ESD has to prove misconduct, not the other way around. The burden of proof is on them and your employer to show you did something that would disqualify you from benefits.
0 coins
Levi Parker
•That actually makes me feel a lot better. I was thinking I had to prove I deserved benefits.
0 coins
Chloe Zhang
•Nope, it's the opposite. They assume you're eligible unless there's evidence of disqualifying misconduct.

honestly washington esd approves most claims unless its really obvious misconduct. i've seen people get benefits after being fired for all kinds of stuff

•yeah youll probably be fine. the worst they can do is say no and then you can appeal

Whatever you do, don't let them intimidate you into not applying. I almost didn't file because my boss made it sound like I'd never qualify. Turns out she was wrong and I got benefits for the full 26 weeks.

Levi Parker
•Were there any complications during those 26 weeks or did it go smoothly once approved?
0 coins
Kristian Bishop
•Pretty smooth once I got into the routine of filing my weekly claims and doing the job search stuff. Just stay on top of the requirements.

One more thing - if Washington ESD does decide to investigate your termination, they'll send you a fact-finding questionnaire. Answer it honestly and completely. This is your chance to tell your side of the story.
0 coins
Levi Parker
•How detailed should I be in that questionnaire if I get one?

Libby Hassan
•Be thorough but stick to relevant facts. Explain the circumstances but don't get emotional or blame anyone. Just state what happened objectively.

Got terminated 3 months ago for performance and my claim went through no problem. Currently getting my weekly benefits and looking for work. You should be fine if it's just performance issues.

•It's tough but I'm getting interviews. The unemployment benefits help take some pressure off so I can be selective about where I apply.

For anyone still struggling to get through to Washington ESD about their claims, I can't recommend Claimyr enough. It's at claimyr.com and they have that demo video I mentioned before. Really takes the frustration out of trying to reach someone when you have questions.
