If you get fired can you collect unemployment - Washington ESD rules?
Got terminated from my warehouse job last Friday and honestly not sure what happens next. Manager said it was for 'performance issues' but I think they just wanted to get rid of me since I'd been there 3 years and was making more than the new hires. Can I still file for unemployment benefits through Washington ESD if I got fired? I've heard mixed things from coworkers about whether you can collect UI benefits after being terminated. Really need to know because I've got rent due in two weeks and this couldn't have happened at a worse time.

Yes, you can potentially collect unemployment benefits even if you were fired, but it depends on the reason for termination. Washington ESD looks at whether you were terminated for 'misconduct' or not. Performance issues usually don't count as misconduct unless they were willful or involved policy violations.

•What exactly counts as misconduct though? They said I wasn't meeting productivity standards but I was never written up or given any formal warnings.

•Misconduct has to be deliberate or connected to willful disregard of company policies. Poor performance alone usually isn't misconduct unless you were actively refusing to do your job or ignoring direct instructions.

File your claim ASAP! Don't wait around wondering if you qualify. Let Washington ESD make that determination. I got fired from my last job and still got benefits - took about 3 weeks to get approved though.

•Did your employer try to fight it? I'm worried they'll contest my claim and say I was fired for cause.

•They did contest it initially but I provided documentation showing I was never disciplined and the adjudicator sided with me. Make sure you keep any emails or paperwork from your termination.

Had a similar situation last year when I couldn't get through to Washington ESD about my claim status. Spent weeks calling the main number and either got busy signals or got hung up on after waiting for hours. Finally found claimyr.com which actually gets you connected to a real agent. They have a video demo at https://youtu.be/7DieNd3C7zQ that shows exactly how it works. Saved me so much frustration.

•Never heard of that service - does it actually work? I've been trying to reach Washington ESD for two weeks about my adjudication.

•Yeah it definitely works. They handle all the calling and waiting for you, then connect you directly to an Washington ESD agent. Way better than spending your whole day redialing.

PERFORMANCE ISSUES ARE NOT MISCONDUCT! I can't believe how many people don't know this. You have to do something really bad to be disqualified - like stealing, fighting, or repeatedly no-showing without calling. Being slow or making mistakes isn't grounds for denial.

•What if they said you weren't following safety protocols? Would that count as misconduct?

Hugo Kass
•Depends if it was willful. If you genuinely didn't know the protocol or made an honest mistake, probably not misconduct. If you knew the rules and deliberately ignored them, then yes.

•This is correct. Washington ESD looks at whether the behavior was deliberate and whether you had knowledge of the policy you allegedly violated.

File online at esd.wa.gov right away. You'll need your Social Security number, employer information, and dates of employment. The sooner you file, the sooner your claim can be processed. Even if your employer contests it, you might still qualify.

•How long does the whole process usually take? I really need to know when I might see some money coming in.

•If there's no dispute, you could see payments within 2-3 weeks. If your employer contests and it goes to adjudication, could be 4-6 weeks or longer.

•This is exactly why I used claimyr when I had adjudication issues. They got me through to an agent same day and I was able to get my claim moving again.

•might have to try that... getting desperate here

What about if you got fired during your probation period? I was let go after 2 months and they said it was 'not a good fit.' Would that affect my UI eligibility?

Hazel Garcia
•Probation period doesn't matter for unemployment purposes. What matters is whether you have enough work history to qualify for benefits and whether the termination was for misconduct.

•Good to know. I worked for 8 months at my previous job before this one so I should have enough work history.

Make sure you're honest on your application about why you were terminated. Don't try to hide it or make it sound like you quit. Washington ESD will verify with your employer anyway.

•Should I mention that I think they were looking for a reason to fire me? Or just stick to what they officially said?

Laila Fury
•Just state the official reason they gave you. You can provide additional context if Washington ESD asks during the investigation, but keep your initial application factual.

Been through this exact situation. Got fired for 'poor performance' but it was really because I complained about unsafe working conditions. Filed anyway and got approved after they investigated.

Salim Nasir
•How did you prove that the real reason was retaliation? Did you have documentation?

•I had emails where I reported the safety issues and then suddenly started getting negative reviews. The timing was pretty obvious.

Don't let your employer intimidate you into not filing! They might tell you that you won't qualify but that's not their decision to make. Washington ESD makes the final determination.

•Exactly! My manager tried to tell me I couldn't get benefits but I filed anyway and got approved.

Remember you'll need to do your weekly claim certifications even while your initial claim is being processed. Set up your online account and don't miss any weeks or you could lose benefits.

Salim Nasir
•When do I start doing the weekly claims? Right after I file or after I get approved?
0 coins
Khalil Urso
•You start filing weekly claims the week after you become unemployed, even if your claim is still being processed. Don't wait for approval.

If you do run into issues reaching Washington ESD during your claim process, definitely check out that claimyr service I mentioned earlier. It's been a lifesaver for getting through to agents when I had questions about my claim status.

•How much does that service cost? Seems like something that would be expensive.

•It's worth it when you consider how much time you save not having to call repeatedly. Much better than losing whole days trying to get through on your own.

Got fired from three different jobs over the past few years and collected unemployment each time. As long as you weren't stealing or fighting or something obviously bad, you'll probably be fine.

•Three times?? What kind of jobs were you working?

•Retail mostly. High turnover industry. Sometimes they just decide they don't like you and find a reason to get rid of you.

Key point: even if your employer contests your claim, you should continue filing your weekly claims while the appeal is being processed. If you're eventually approved, you'll get paid for those weeks retroactively.

•That's good to know. I was worried I'd be wasting my time if they were going to deny me anyway.

whatever you do dont give up if they deny you initially. i got denied first time but won my appeal. the phone hearing took like 20 minutes and the judge ruled in my favor

•Good point about appeals. A lot of people don't realize they can fight the initial decision if they disagree with it.

Update: finally got through to Washington ESD using that claimyr thing someone mentioned. Agent said my claim should be approved within the week. Wish I'd known about that service weeks ago!

•Glad it worked for you! Saves so much hassle compared to the regular phone system.

•That's encouraging. I might need to use that service too if I run into problems with my claim.

Bottom line for OP: file your claim today, be honest about the termination reason, keep doing your weekly claims, and don't let your employer scare you out of applying. Most terminations for performance don't disqualify you from benefits.

•Thanks everyone for all the advice. Going to file my claim this afternoon. Feeling much more confident about it now.
