Got fired from my job - can I still collect Washington ESD unemployment benefits?
I was terminated from my warehouse job last Friday after working there for almost 2 years. My supervisor said it was due to attendance issues, but I feel like the reasons weren't entirely fair. I've never filed for unemployment before and I'm not sure if being fired disqualifies me from getting benefits. Can anyone tell me if I can still apply for Washington ESD unemployment after being terminated? What should I expect during the application process?

You can definitely apply for unemployment even if you were fired. Washington ESD will review your case to determine if the termination was for 'misconduct' or not. Simple attendance issues often don't qualify as misconduct unless they were willful or a pattern you were repeatedly warned about. The key is being honest on your application about why you were terminated.

•That's good to know. I did get a couple verbal warnings but nothing written. Should I mention that in my application?

•Yes, be completely honest about everything. Washington ESD will contact your employer anyway, so it's better they hear your side first.

I got fired last year and still got approved for benefits. Just apply online at esd.wa.gov and answer all the questions truthfully. The worst they can do is say no, but you won't know unless you try.

•How long did it take for them to make a decision on your claim?

•about 3 weeks but mine went to adjudication because my employer contested it initially

The tricky part is going to be reaching someone at Washington ESD if your claim gets held up. I spent weeks trying to call them with no luck. Finally found this service called Claimyr (claimyr.com) that helped me get through to an actual agent. They have a video demo at https://youtu.be/7DieNd3C7zQ showing how it works. Saved me so much frustration trying to call on my own.

•Never heard of that before. Does it actually work or is it just another scam?

•It's legit. I was skeptical too but it really did help me get connected when I couldn't reach anyone through the normal phone lines.

•Interesting, might have to try that if my claim runs into issues. The phone system is absolutely terrible.

APPLY IMMEDIATELY! Don't wait around wondering if you qualify. The sooner you file, the sooner your waiting week starts. Even if you get denied initially, you can appeal the decision. I made the mistake of waiting too long thinking I wouldn't qualify and lost out on benefits I could have received.

•Good point about the waiting week. I'll file today then. Better safe than sorry.

•What's a waiting week? Is that something new?

•The waiting week is the first week of your claim where you don't get paid even if you're eligible. It's not new, been around for years in Washington.

The attendance thing might actually work in your favor. Unless you were like no-call no-showing or something really bad, most attendance issues don't rise to the level of 'misconduct' that would disqualify you. Washington ESD looks at whether your actions were willful and substantial.

•I had a few late arrivals due to transportation issues and called out sick twice without a doctor's note. Nothing too crazy I think.

•That sounds pretty normal to me. I'd be surprised if they denied you for that, but every case is different.

•That's what I'm worried about. I keep hearing horror stories about trying to reach someone.

•Same here, the phone system is broken. You call and either get busy signal or get disconnected after waiting on hold.

One important thing - make sure you start doing your job search activities right away even while your claim is being processed. You'll need to log at least 3 job search activities per week once you start receiving benefits. Keep detailed records of everything.

•What counts as job search activities? Just applying for jobs or other things too?

•Applications, networking events, job fairs, online career workshops, even updating your resume can count. Check the WorkSourceWA website for the full list.

•I thought it was 5 activities per week now? Or did they change it back?

Luca Ferrari
•It's 3 per week for most people. Some special programs require more but standard UI is 3.

File online but also be prepared for your employer to contest the claim. Most companies do this automatically now to try to keep their unemployment tax rates down. If they contest it, your claim will go to adjudication and you'll need to provide your side of the story.

•What happens during adjudication? Do I need to provide documents or anything?

•They'll ask both you and your employer for statements about what happened. Any documentation you have (emails, warnings, attendance records) can help support your case.

I was in almost the exact same situation - fired for attendance after 18 months at my job. Filed anyway and got approved after about a month. The key is being honest and showing that you weren't being deliberately defiant or anything.

•That's reassuring to hear! Did your employer contest your claim?

•Yeah they did, but Washington ESD still approved me. I think because I had legitimate reasons for most of my absences and I wasn't a problem employee otherwise.

Whatever you do, don't lie on the application. Washington ESD will find out the truth anyway when they investigate. Better to be upfront about what happened and let them make the determination.

•Definitely planning on being completely honest. Not worth the risk of getting in trouble later.

Make copies of everything before you submit your application. If something goes wrong with their system or you need to appeal later, you'll want records of exactly what you submitted and when.

•Good thinking. I'll screenshot everything as I go through the application process.

The whole system is designed to discourage people from applying. Don't let that stop you. You paid into this system with every paycheck, so don't feel bad about using it when you need it.

•You're right, I never thought about it that way. I did pay into it for 2 years.

Just remember if you do run into issues reaching Washington ESD by phone, that Claimyr service I mentioned earlier really does work. I used it again last month when I had questions about my work search requirements and got through to someone within an hour instead of calling for days.

•I bookmarked their site just in case. Hopefully I won't need it but good to have as backup.

Also be aware that if you do get approved, your weekly benefit amount will be based on your wages from the past year. They use a specific formula but generally it's around 60% of your average weekly wage up to the maximum benefit amount.

NebulaNomad
•Do you know what the maximum is right now?

Giovanni Greco
•I think it's around $844 per week but that changes every year. You can find the current amounts on the Washington ESD website.

One more tip - if your claim gets approved, you'll need to file weekly claims every week to keep getting benefits. Don't forget or skip weeks because you can't go back and claim those later.

•When do I file the weekly claims? Is it the same day each week?
0 coins
Fatima Al-Farsi
•You can file anytime Sunday through Saturday for the previous week. Most people just pick a day and stick to it.

Good luck with your application! The worst part is the waiting and not knowing what's going to happen. But based on what you described, I think you have a decent chance of getting approved.

Just saw this thread and wanted to add - don't be discouraged if your first attempt to call Washington ESD doesn't work. I tried for literally weeks before I discovered Claimyr and finally got through to resolve my adjudication issue. Sometimes you just need that extra help navigating their phone system.

•Seems like that service gets mentioned a lot. Must really work well for people.

•It does. I was skeptical at first but when you're desperate to talk to someone and can't get through any other way, it's worth trying.
