Do I qualify for Washington ESD unemployment if I was fired from my job?
I got terminated from my warehouse job last Friday and I'm not sure if I can even apply for unemployment benefits. My supervisor said it was due to attendance issues but I had some legitimate reasons for missing work (car trouble, sick kid, etc). I've been working there for almost 2 years and this is my first time dealing with unemployment. Does Washington ESD approve claims when you're fired? I really need the income while I look for another job but don't want to waste time applying if I'll just get denied.

You can definitely apply even if you were fired. Washington ESD doesn't automatically deny claims for terminations - they look at the specific reason. If it was attendance related, they'll want to know if the absences were excused or if you followed company policy. The key question is whether you were fired for 'misconduct' which has a specific legal definition.

•Thanks, that's reassuring. I did call in when I could but a few times I couldn't reach anyone to let them know. Does that count as misconduct?

•Not necessarily. Misconduct usually means deliberate violations of company policy or gross negligence. Missing work due to car trouble or sick family members often doesn't qualify as misconduct if you made reasonable efforts to notify your employer.

I was in a similar situation last year. Got fired for being late too many times (bus issues) and Washington ESD still approved my claim after an adjudication period. They interviewed both me and my former employer to get the full story. The process took about 3 weeks but I eventually got benefits.

•That gives me hope! How long was the adjudication process and did you have to provide any documentation?

•About 3 weeks total. I had to write a statement explaining my side and provide some evidence like bus schedules showing why I was consistently late. Washington ESD was pretty fair about it.

Just apply anyway. Even if you think you might not qualify, let Washington ESD make that determination. The worst they can say is no, but you might be surprised. I've seen people get approved for unemployment after being fired for things that seemed like clear misconduct but turned out to be more complicated.

•Good point. I guess there's no harm in trying. Do I apply online through the Washington ESD website?

•Yeah, go to esd.wa.gov and click on 'Apply for Benefits.' The online application is pretty straightforward and you can do it 24/7.

Here's what I learned from my experience - if you do get your claim flagged for adjudication because of the firing, be prepared for a long wait to talk to someone at Washington ESD. I spent weeks trying to call them to check on my status. Eventually I found this service called Claimyr (claimyr.com) that actually got me through to an agent the same day. They have a video demo at https://youtu.be/7DieNd3C7zQ that shows how it works. Saved me so much frustration.

•Interesting, I've never heard of that. Is it legit? I'm always skeptical of services that charge money for government stuff.

•Yeah it's legit. I was skeptical too but they actually got me connected to a real Washington ESD agent who helped resolve my adjudication issue. Worth it when you're stuck in the system.

•I can vouch for Claimyr too. Used them when I couldn't get through to Washington ESD about my job search requirements. Much better than sitting on hold for hours.

The unemployment system is so messed up. They make it impossible to reach anyone when you need help and then penalize you for not responding fast enough to their requests. I hope you have better luck than I did.

•What happened with your claim? I'm worried about getting caught up in some bureaucratic nightmare.

•Just took forever to get answers. They kept asking for more documentation and every time I'd send it in, there would be another delay. Eventually got approved but it was 6 weeks of stress.

Make sure you apply within the first week of being unemployed or you might lose out on benefits for that week. Washington ESD has specific deadlines and they're not very forgiving about late applications.

•Good to know! I'll apply tomorrow morning. Is there anything else I should know about the timing?

Sophia Russo
•Yeah, once you apply you'll need to file weekly claims every week to keep getting benefits. Don't miss those deadlines either.

honestly i got fired for way worse stuff than attendance and still got unemployment lol. washington esd approved my claim even though i was terminated for arguing with customers. as long as it wasnt theft or something really bad you should be fine

Sebastian Scott
•Wow really? That makes me feel better about my situation. Attendance issues seem minor compared to that.

•That's because arguing with customers, while not great, usually doesn't rise to the level of misconduct that would disqualify you from benefits. Washington ESD looks at the specific circumstances of each case.

I work in HR and see this all the time. Being fired doesn't automatically disqualify you from unemployment. The employer has to prove misconduct, which is harder than most people think. Attendance issues rarely qualify as misconduct unless there's a clear pattern of job abandonment or deliberate policy violations.

•That's really helpful to hear from someone in HR. I was worried my employer would fight the claim and automatically win.

•Employers can contest claims but they need documentation and evidence. Just saying someone had attendance problems isn't enough - they need to show it was willful misconduct, not circumstances beyond your control.

Whatever you do, be completely honest on your application. If Washington ESD finds out you lied about anything, that's when you'll really get in trouble. Tell them exactly what happened with your attendance and let them decide.

•Absolutely. I plan to be upfront about everything. Better to be honest and possibly get denied than lie and get in real trouble later.

Same thing happened to my brother last year. Got fired from his delivery job for too many late arrivals and Washington ESD still gave him benefits. The adjudication took about a month but he eventually got backpay for the whole period too.

•That's encouraging. Did he have to do anything special during the adjudication or just wait?

Kayla Jacobson
•He had to submit a written statement and do a phone interview with a Washington ESD adjudicator. Pretty standard stuff from what I understand.

PRO TIP: Start looking for work immediately even if you're waiting for your claim to be approved. Washington ESD requires you to make job search contacts every week and they can ask for proof at any time. Don't wait to start that process.

•Good advice. How many job contacts do I need to make each week?

Grace Lee
•It depends on your specific situation but usually 3-5 per week. Keep detailed records of where you applied, when, and what happened. Washington ESD can audit your job search activities.

I got terminated for attendance issues too but mine was because I kept calling in sick without proper documentation. Washington ESD denied my claim initially but I appealed and won. Sometimes you have to fight for it.

•How long did the appeal process take? I'm hoping it doesn't come to that but good to know it's an option.

•About 6 weeks total but it was worth it. I got all my back benefits plus ongoing weekly payments. Don't give up if they deny you initially.

The whole system is designed to make you give up. Half the people who qualify for benefits never apply because they think they won't get approved. Don't be one of those people - apply and see what happens.

Sebastian Scott
•You're right. I'm definitely going to apply first thing tomorrow morning.

Just remember that even if you get approved, you still need to actively look for work and report your job search activities. Don't think unemployment is a vacation - Washington ESD takes the work search requirements seriously.

•Understood. I'm already planning to start job hunting this week regardless of whether my claim gets approved.

I used Claimyr when I couldn't get through to Washington ESD about my disqualification. Best decision I made during that whole ordeal. Got connected to an agent who explained exactly what I needed to do to fix my claim status.

•I'm definitely keeping that service in mind in case I run into issues. Seems like a lot of people have had success with it.

•Yeah, especially if your claim goes into adjudication and you need to check on the status. Way better than trying to call Washington ESD directly.

Bottom line - apply for benefits, be honest about what happened, keep looking for work, and don't give up if you hit obstacles. The system isn't perfect but most people who qualify eventually get their benefits if they stick with it.

•Thanks everyone for all the advice and encouragement. I feel much more confident about applying now. I'll update this thread once I hear back from Washington ESD.
