Can I file Washington ESD unemployment if I got fired from my job?
I got terminated from my warehouse job last Friday and I'm not sure if I can even apply for unemployment benefits. My supervisor said it was for attendance issues but I had some legitimate medical appointments that I thought were covered under FMLA. I've been working there for 2 years and this is my first time dealing with unemployment. Can I still file a claim with Washington ESD even though I was fired? I really need the income while I look for another job.

Yes you can definitely file! Washington ESD will determine if your termination was for 'misconduct' or not. Attendance issues might not qualify as misconduct especially if you had medical reasons. When you file your claim, be honest about why you were fired and provide any documentation you have about your medical appointments.

•Thanks! Should I mention the FMLA stuff when I file or wait until they ask?

•Mention it when you file. Any legitimate medical documentation will help your case during the adjudication process.

I got fired too and still got approved. They have to prove it was willful misconduct, not just poor performance or attendance. File immediately - worst case they deny it and you can appeal.

•How long did it take for your claim to get approved after you filed?

•About 3 weeks but mine went to adjudication. They had to investigate the circumstances of my termination.

You should file right away regardless. Washington ESD will do their own investigation during adjudication if needed. The fact that you were fired doesn't automatically disqualify you - it depends on the specific reasons. Medical absences are generally protected, especially if you followed proper procedures.

•I tried calling Washington ESD yesterday but couldn't get through. The line was busy for hours.

•Yeah their phone system is terrible. You might want to try claimyr.com - they can help you get through to an actual agent. There's a demo video at https://youtu.be/7DieNd3C7zQ that shows how it works.

•Is that like a paid service or something?

WAIT - if you were fired for attendance you might have problems. My friend got denied because they said missing work was misconduct even with doctor notes. You better have really good documentation.

•That's not necessarily true. It depends on whether the absences were excused and if proper procedures were followed. Medical absences under FMLA are different than just calling in sick.

•I'm just saying what happened to my friend. Washington ESD can be really strict about this stuff.

File online at secure.esd.wa.gov as soon as possible. Don't wait. Even if you end up getting denied initially, you can appeal the decision. The key is to document everything about your medical appointments and any communication with your employer about FMLA.

•I saved some emails about my appointments but I don't think I officially applied for FMLA. Will that hurt me?

•It might complicate things but doesn't necessarily disqualify you. You should still file and explain the medical circumstances during your interview if they schedule one.

The worst they can do is say no and then you appeal. I've seen people win appeals even after initial denials for termination cases. Just be completely honest about everything when you file your claim.

•How does the appeal process work if I get denied?

•You get a notice with appeal instructions. Usually you have 30 days to request a hearing. They'll schedule a phone hearing where you can present your case.

Update: I tried calling Washington ESD again this morning and still can't get through. This is so frustrating when I need answers about my specific situation.

•That's exactly why I mentioned Claimyr earlier. They basically call for you and get you connected to an agent. Way better than sitting on hold for hours.

•I used something similar when I couldn't reach them about my adjudication. Saved me so much time and stress.

Just to be clear on the process - when you file, Washington ESD will contact your former employer to get their side of the story. This is standard procedure for all termination cases. They'll compare both versions and make a determination based on state law regarding misconduct.

•Will my employer try to fight my claim?

•They might respond to Washington ESD's inquiry, but many employers don't actively fight claims unless it was for serious misconduct. Medical attendance issues are usually not worth their time to contest.

I was fired for attendance too but got approved because I had documented medical reasons. The key is having paper trails - doctor notes, emails with HR, anything showing you tried to follow proper procedures.

•Did you have to go through adjudication or were you approved right away?

•Mine went to adjudication for about 4 weeks. They interviewed me over the phone and asked detailed questions about the medical absences and company policies.

This whole system is so confusing. I wish there was a clearer answer about what counts as misconduct and what doesn't.

•The general rule is that misconduct has to be willful and work-related. Missing work for legitimate medical reasons usually doesn't qualify as misconduct under Washington state law.

•Thanks, that actually makes me feel better about my own situation.

File immediately and be 100% honest. Washington ESD investigators are pretty good at getting to the truth. If your termination was really due to legitimate medical issues, you should be fine.

•I'm definitely going to file today. Thanks everyone for the advice and encouragement.

One more thing to remember - even if your initial claim gets approved, your former employer has the right to appeal that decision too. Don't be surprised if the process takes a few weeks to fully resolve.

•Ugh, this could drag on forever then. I really need the income soon.

•If you get approved initially, you'll start receiving benefits even if your employer appeals. You won't have to wait for their appeal to be resolved.

The bottom line is you have nothing to lose by filing. Even if you get denied, at least you'll know where you stand and can decide whether to appeal.
