Can you get unemployment if you fired - Washington ESD eligibility rules?
Got terminated from my warehouse job last week for attendance issues (had some car trouble and missed 3 days in a month). My supervisor said I was fired for cause but I'm not sure if that means I can't get unemployment benefits. Does Washington ESD approve claims when you're fired or do they automatically deny them? I've worked for 2 years straight before this happened and really need the income while I look for another job.

You can still apply for unemployment even if you were fired. Washington ESD will review your case during adjudication to determine if the termination was for misconduct or not. Attendance issues might not always count as misconduct depending on the circumstances.

•That's reassuring to hear. Should I mention the car trouble when I file my claim?

•Yes, definitely include all relevant details when you file. The more context you provide about why you missed work, the better your chances during the adjudication process.

•How long did the adjudication process take for you?

I had a similar situation last year and couldn't get through to Washington ESD for weeks to check on my claim status. Finally used Claimyr (claimyr.com) to get connected to an agent who explained the whole process. There's even a video demo at https://youtu.be/7DieNd3C7zQ showing how it works. Made the whole experience way less stressful.

•Never heard of that service before. Did it actually help you reach someone at Washington ESD?

•Yeah, got through to an agent in like 20 minutes instead of calling for days. They were able to check my adjudication status and explain what documents I needed to submit.

The key thing Washington ESD looks for is whether your termination was due to willful misconduct. Missing work due to car trouble generally doesn't qualify as misconduct if you notified your employer and it wasn't a pattern of irresponsible behavior. Make sure to document everything when you file your claim.

•I did call in each time I couldn't make it to work. Would that help my case?

Amelia Martinez
•Absolutely. The fact that you called in shows you weren't just no-showing. Keep records of when you called and any documentation about your car problems.

•This is really important advice. I got denied initially because I didn't provide enough documentation but won on appeal.

WAIT don't get your hopes up too high. I was fired for attendance and Washington ESD denied my claim saying it was misconduct. Had to appeal and it took MONTHS to get resolved. The system is brutal.

•Oh no, that's exactly what I'm worried about. Did you eventually win your appeal?

Mila Walker
•Yeah but it took forever and I had to get all kinds of documentation from my doctor about my medical issues that caused the absences.

•Appeals can take time but they're worth it if you have a legitimate case. Don't give up if you get initially denied.

file your claim ASAP even if you think you might get denied because there's a waiting period anyway

•Good point, I'll file tomorrow morning. Better to get the process started.

When you file, be completely honest about the termination reason. Washington ESD will contact your employer anyway, so any inconsistencies will hurt your case. Focus on the legitimate reasons for your absences.

•Should I mention that my supervisor seemed understanding when I called in sick?

Mason Davis
•Yes, any evidence that your employer was aware and initially understanding of your situation can help show it wasn't willful misconduct.

I work in HR and see these cases all the time. Three absences in a month for legitimate reasons like car trouble usually won't qualify as misconduct unless your company has a very strict policy that was clearly communicated.

Sophia Miller
•We had an attendance policy but it seemed like they were pretty flexible with it until recently.

Chloe Green
•That could actually work in your favor. If they were inconsistent in applying the policy, it suggests your termination might not meet the misconduct standard.

The adjudication process can be nerve-wracking but try not to stress too much. Most people who get fired for attendance issues eventually get approved if they have legitimate reasons.

•Thanks, that helps calm my nerves a bit. I was panicking about how I'd pay rent.

Make sure you're doing your job search activities too while waiting for the adjudication decision. Washington ESD requires you to be actively looking for work even during the review process.

•Do I need to log job searches before my claim is approved?
0 coins
Harper Hill
•Yes, you should start job searching immediately and keep records. You'll need to report these activities on your weekly claims.

Sophia Miller
•That gives me hope. Did you have to provide any documentation?

•just had to explain it in the interview with the adjudicator they were pretty understanding

If you need to talk to someone at Washington ESD about your adjudication, definitely try Claimyr. I was so frustrated trying to get through on my own but they made it super easy to reach an actual person who could help.

•Is it expensive to use that service?

•Worth every penny when you're dealing with unemployment stress and can't get through to Washington ESD any other way.

Don't let them bully you into thinking you can't get benefits. I was fired for performance issues and still got approved because they couldn't prove it was willful misconduct.
0 coins
Sophia Miller
•That's encouraging. I'm definitely going to file and see what happens.
0 coins
Zoe Gonzalez
•Exactly! The worst they can do is say no, but you might be surprised and get approved.

Make sure your employer doesn't try to contest your claim unfairly. Some companies automatically fight every unemployment claim to keep their rates low.

Sophia Miller
•How would I know if they're contesting it unfairly?

•Washington ESD will notify you if your employer contests the claim. You'll have a chance to respond with your side of the story.

The waiting period for adjudication is the worst part honestly. Try to find some temporary work if you can while waiting for the decision.

Washington ESD has gotten better about processing these cases since COVID but it still takes time. Be patient and make sure you keep filing your weekly claims even while waiting.

got fired from my last job too and was terrified about getting benefits but it worked out fine in the end Washington ESD was actually pretty fair about it

One more thing - if you do get approved, make sure you understand the job search requirements. You'll need to make at least 3 job contacts per week and keep detailed records in WorkSourceWA.

Sophia Miller
•I'll make sure to read up on all the requirements. Thanks for all the helpful advice everyone!
