Sudden ESD disqualification and overpayment notice after submitting able/available form - need urgent help!

I'm completely panicking right now. Just received a disqualification letter from ESD on Saturday saying I'm not eligible for benefits I've been collecting since March and now I owe an overpayment! The letter states the reason is 'able and available for work' issues, but I DEFINITELY submitted that form on May 1st (I have screenshots showing it was uploaded). My ESD account even shows it as 'complete' as of May 3rd. I've attended both my required WorkSource RESA appointments and haven't missed any requirements. I was counting on this payment to buy groceries for my kids this week, and now there's NOTHING. I'm literally shaking while typing this. Has anyone dealt with this before? What's my next move? Do I file an appeal? Call them? I'm desperate for any advice - we're talking about over $5,800 in benefits they now want back plus this week's payment I was counting on.

Thanks for responding. Did you win your appeal? I'm terrified about the 30-day deadline. The letter is dated May 28th so I guess I have until June 27th? I've never done an appeal before.

THEY DO THIS ALL THE TIME!!!! The system is BROKEN beyond belief. I had the EXACT same thing happen in February - I submitted all paperwork correctly and on time but their stupid computer system somehow missed it or ignored it. Then they hit me with $4000+ in overpayments without warning! You need to APPEAL IMMEDIATELY and also try to speak to a real person. The appeal buys you time while you get this sorted out.

Did you have to pay back anything while waiting for the appeal? I literally don't have money for an overpayment right now - we're barely making rent as it is.

I'm sorry you're dealing with this stressful situation. Based on your description, you should take these steps immediately: 1. File an appeal within 30 days of the letter date - this is critical and preserves your rights 2. Gather evidence: screenshots showing you submitted the form, confirmation emails, WorkSource attendance records 3. Continue filing your weekly claims during the appeal process (this is important!) 4. Request a payment plan if the overpayment stands (but focus on appeal first) It sounds like there may have been a processing error with your able and available form. This happens sometimes even when the system shows "complete" - the document might be there but not properly reviewed or linked to your claim.

Thank you for the clear steps. I'll start the appeal today. Should I fill out the appeal form on my ESD account or use the paper form they included with the letter? Also, when I file my weekly claim, will it let me even though I'm disqualified now?

This is why I tell everyone to CALL ESD whenever you upload ANY document. Their upload system is unreliable. You can submit something and it shows as received but then no one ever looks at it or it gets attached to the wrong part of your file. I've seen this dozens of times.

TRUE! And good luck getting through to them by phone! I spent HOURS last month trying to reach a human being. Their phone system is deliberately designed to frustrate people into giving up.

Have you checked if the form you submitted was the correct version? There was a change to the able and available form in early 2025, and people who used the old version had their submissions marked as complete but later rejected. Check the form number in the bottom corner - should be F203-842-000 (04/2025). Regarding your immediate situation, you should: 1. File your appeal using the form that came with the disqualification letter 2. Continue filing weekly claims (the system will allow this during appeal) 3. Contact your nearest WorkSource office - they sometimes can help expedite communication with ESD 4. Request a payment hold during the appeal process (this isn't automatic

I just checked and I did use the correct form - it has that exact form number you mentioned. I'll file the appeal with the paper form today and keep doing my weekly claims. Do you know how long appeals typically take to resolve? We're really struggling financially.

I've been trying to reach an ESD agent for weeks about a similar issue with no luck. Then I found this service called Claimyr (claimyr.com) that got me through to an actual human at ESD in about 20 minutes! They have a video showing how it works: https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3 I explained my situation about a form that was marked complete but then ignored, and the agent was able to see that it was in their system but not properly processed. They fixed it while I was on the phone. Might be worth trying in your situation since this seems like a clear processing error.

You need to be careful here. While appealing, make sure you understand what they mean by "able and available for work" issues. Sometimes this happens when you reported something on your weekly claims that triggered the system (like saying you were sick one day or turned down work). Or maybe you missed answering a specific question. Check your weekly claim history to see if there's a pattern that could have caused this.

I went back through all my weekly claims and I always answered that I was able and available for work. The only thing I can think of is that I had a doctor's appointment one week in April and marked that I was unavailable for 2 hours that day, but I still indicated I was available for full-time work overall.

Based on your last comment about marking unavailable for a doctor's appointment, that might be the issue. While it seems minor, ESD's system can flag this. Your appeal should specifically address this, explaining that a brief medical appointment doesn't make you unavailable for work in general (courts have upheld this interpretation). For the appeal, I recommend: 1. Be very specific about dates and times 2. Explain your overall availability for work 3. Reference any job search activities you performed that week 4. Include any communications with potential employers An Administrative Law Judge will review your case, and having detailed documentation will help tremendously.

Thank you! I'll definitely include all of this in my appeal. I've been keeping good records of my job search activities, so I can show I was actively looking for work that week. Would it also help to get a note from my doctor confirming it was just a routine appointment?

That's good to hear. 6 weeks is a long time though... I'm going to see if I can get through to them by phone using that Claimyr thing someone mentioned while also filing the appeal as backup. Can't afford to wait 6 weeks with no income.
