Quit job due to PTSD after ADA accommodation denied - ESD claim stuck in adjudication since August

I've been stuck in this horrible limbo since mid-August and don't know what to do anymore. My previous job was severely triggering my PTSD and anxiety disorder (diagnosed and documented). My doctor actually wrote an ADA accommodation request for me to work from home, but specifically stated that if they couldn't accommodate that, I should find a less stressful position. Well, my employer flat-out denied the accommodation with no alternatives offered. Based on my doctor's recommendation, I felt I had no choice but to resign. I filed for unemployment right away, but my claim has been in adjudication for over 3 months now! I finally managed to speak with an ESD agent today, and he said they're still waiting to hear back from my former employer before they can approve or deny my claim. Is this normal? Has anyone successfully received benefits after quitting for health reasons when accommodations were denied? I'm seriously drowning in bills at this point and don't know how much longer I can wait.

When you have medical documentation showing you needed accommodation that your employer refused to provide, it's considered 'good cause' for voluntary quit. Thanks for responding! The agent was pretty vague about the timeline - just said they're 'waiting on employer response' which is frustrating because it's been months. And yes, I uploaded everything - doctor's notes, the accommodation request, their denial email, everything. I even sent follow-up documents when requested. It just feels like I'm in this never-ending holding pattern.

my freind quit cuz of anxiety too and got denied. ESD said he shouldve tried harder to keep job or somthing. but he didnt have a doctor note like you do so maybe thats different? good luck.

What you're describing is a qualifying separation under RCW 50.20.050(2)(b)(ii) - "The separation was necessary due to the illness or disability of the claimant..." The fact that you have medical documentation and followed the ADA process properly puts you in a strong position. However, your employer might be arguing that they could have found another accommodation besides work-from-home that would have addressed your condition. One thing I learned from my experience is that ESD takes voluntary quits very seriously, and adjudication for these cases can take 12-16 weeks in the current backlog. August to November isn't unusual unfortunately.

Thank you for citing the actual law! That makes me feel a bit better. My employer never offered ANY alternative accommodations - they just said no to working from home and that was it. I'll mention that specific RCW if I need to appeal.

GET A LAWYER RIGHT NOW!!!! ESD is NOTORIOUS for denying legitimate claims and hoping people don't appeal. I went through something similar with my chronic migraines and they denied me at first even with ALL my medical documentation. The system is BROKEN!!!

It took about 10 weeks in adjudication but was eventually approved. Be prepared to explain in great detail how your condition affected your ability to do your specific job duties and why working from home would have helped. One important thing to note - if your claim is approved, you should get back pay for all the weeks you've been claiming while in adjudication. Make sure you've been filing your weekly claims consistently this whole time, even without receiving benefits. I've seen too many people miss out on weeks of benefits because they stopped filing during adjudication.

Since your adjudication has been going on since August, I'd recommend contacting your state representative's office. They can sometimes help expedite claims that have been stuck in the system too long. Just go to the Washington State Legislature website, enter your address, and it'll show you who your representatives are. Their offices often have staff dedicated to helping constituents with unemployment issues.
