Denied ESD benefits after quitting job - worth appealing after 2 month wait?
I'm completely frustrated with ESD right now. I quit my toxic retail job back in early November (manager was literally screaming at employees & creating unsafe conditions). Filed my unemployment claim around Nov 12th and just TODAY - almost 2 months later - they finally bothered to tell me I'm denied benefits! The determination letter says I left work "voluntarily without good cause" even though I explained the hostile work environment in detail. Has anyone successfully appealed after quitting? Is it even worth trying at this point or am I just wasting more time? The appeal deadline is 10 days from now and I'm so discouraged after waiting 2 months just to get denied. Any advice would be really appreciated.

Yes, 100% appeal it! The fact that you had a hostile work environment IS potentially good cause, but you need to document it properly. In your appeal, include any evidence like: - Emails or texts showing the hostile conditions - Names of witnesses who can verify your claims - Dates/times of specific incidents - Any HR complaints you filed - Medical documentation if the stress affected your health The burden of proof will be on you to show that any reasonable person would have quit under those circumstances. •Thank you!! This is so helpful. I do have texts from coworkers talking about how bad it was, and one of them even quit a week after me for the same reasons. I didn't think to go to HR (honestly the HR person was friends with my manager). I'm definitely going to appeal now.

I went through something similar last year. When you appeal, make sure you emphasize that you had "good cause" to quit - that's the exact phrase ESD looks for. Also important to show you tried to resolve the issues before quitting (like talking to supervisors). The OAH hearing will likely be by phone, and they'll ask very specific questions about why the work environment was intolerable. Preparation is key.

I DONT TRUST ESD AT ALL!!! They make EVERYTHING difficult and take FOREVER just to deny people. My sister went through 3 APPEALS before finally winning. The system is designed to wear you down so you'll give up!!! They denied me twice before approving my claim. The entire appeals process is a JOKE but you gotta do it if you need the money.

•No lawyer but she documented EVERYTHING and recorded her hearing (you have to tell them you're recording). The 3rd appeal judge was the only one who actually LISTENED to her case. It's all about which judge you get!!

When I went through my appeal after quitting, I actually printed out the specific ESD regulations about what constitutes "good cause" and highlighted the parts that applied to my situation. The key part is proving that: 1. The conditions were so bad that any reasonable person would quit 2. You attempted to resolve the issues before quitting 3. You had no reasonable alternatives The judge seemed impressed that I knew the specific regulations. I think that made a big difference in winning my appeal. Don't get discouraged!

•Check WAC 192-150-100 for the general good cause provisions. Also look at WAC 192-150-125 for change in working conditions. You can find them all on the Washington State Legislature website or just Google "Washington good cause to quit unemployment" - it should come up. Good luck!

i quit my job cuz of harassment and got denied to. ended up getting another job before my appeal hearing so i just let it go. ESD is so backed up it takes forever for everything. some ppl i know r still waiting from december claims

If you decide to appeal (which you should), trying to talk to an actual ESD agent about your case can be nearly impossible right now. I wasted days trying. Finally used a service called Claimyr (claimyr.com) that got me through to an actual human at ESD within 25 minutes. •Yes! The agent told me they specifically look for: 1) documentation of the issues, 2) evidence you reported problems to management before quitting, and 3) that the conditions were so bad any reasonable person would quit. She also said it helps to have testimony from coworkers who experienced the same issues.

One more important thing - when you file the appeal, you can request a copy of your claim file. Do this! It will show you exactly what your employer said about why you left. My employer completely misrepresented what happened, and seeing their statement helped me prepare specifically to counter their claims during the hearing.

Don't forget that even if you appeal, you need to keep filing your weekly claims! Many people miss this. Even if your initial claim is denied, if you win on appeal, they'll pay you for all those weeks - but ONLY if you filed claims for them. It's easy to get discouraged and stop filing, but that's a big mistake.

•Unfortunately, they won't pay for weeks you didn't file. But definitely start filing again now so you don't lose any more potential weeks. You can also explain in your appeal why you stopped filing - sometimes they'll make exceptions if you have a good reason.
