If you get fired can you still get unemployment in Washington - ESD eligibility question
So I got terminated from my job last week and I'm wondering if I can still file for unemployment benefits through Washington ESD. I've heard mixed things about whether you can get UI if you were fired vs if you quit. My manager said it was due to performance issues but I think it was really because I had some conflicts with my supervisor. I've been working there for 2 years and never had any write-ups until the last month. Can I still apply for unemployment or am I automatically disqualified since I was fired? I really need to know before I waste time filing a claim.

Yes you can definitely still get unemployment if you were fired! The key thing Washington ESD looks at is whether you were fired for 'misconduct' or not. Performance issues usually don't count as misconduct unless you were deliberately not doing your job. You should absolutely file a claim.

•Misconduct usually means things like theft, violence, repeatedly showing up late after warnings, or willfully violating company policies. Disagreements with your supervisor definitely wouldn't qualify as misconduct.

The Washington ESD will investigate your termination during the adjudication process. They'll contact both you and your former employer to get both sides of the story. If your employer can't prove misconduct, you'll be approved for benefits. Make sure you have documentation of your side of things ready.

Just to clarify something important - even if your employer contests your claim, that doesn't automatically disqualify you. Washington ESD makes the final decision based on the facts, not just what your employer says.

been through this exact situation before. got fired for supposedly not meeting sales targets but really it was because my manager didn't like me. filed for UI and got approved after about 4 weeks of adjudication. just make sure you're honest on your application about why you were terminated

Don't let them intimidate you! I know someone who got fired for 'insubordination' just because they questioned a safety violation and they still got unemployment. The bar for misconduct is actually pretty high.
