Washington ESD unemployment - if I got fired can I apply for unemployment benefits?

So I just got terminated from my job yesterday and I'm wondering if I can even apply for unemployment benefits through Washington ESD? I've heard mixed things about whether you can get UI if you were fired vs if you quit. The firing wasn't really my fault - there were some performance issues but I was trying to improve. Does anyone know if Washington ESD will approve my claim or will they automatically deny it because I was fired? I really need the income while I look for another job.

Yes, you can definitely apply for unemployment benefits in Washington even if you were fired! The key is WHY you were fired. If it was for misconduct (like stealing, fighting, or willfully violating company policy), then you probably won't qualify. But if it was for performance issues, inability to do the job, or other non-misconduct reasons, you should be eligible. Washington ESD will investigate during the adjudication process to determine if your termination was for misconduct or not.

That's reassuring, thank you! It was definitely performance-related, not misconduct. How long does the adjudication process usually take?

0 coins

Adjudication can take anywhere from 2-6 weeks depending on how complex your case is and Washington ESD's current workload. They'll contact both you and your former employer to get details about the termination.

I got fired for attendance issues last year and still got approved for UI benefits. The key is being honest on your application about why you were terminated. Washington ESD will do their investigation anyway, so don't try to hide anything.

Good to know! Did they contact your employer during the process?

Yeah they did. My employer had to provide documentation about my termination and I had to give my side of the story too.

I had so much trouble getting through to anyone at Washington ESD when I had questions about my claim after being fired. The phone lines are constantly busy and their online system doesn't always have clear answers. If you run into issues getting information about your claim status, I recently discovered this service called Claimyr (claimyr.com) that actually gets you through to ESD agents. They have a video demo showing how it works: https://youtu.be/7DieNd3C7zQ. It was a lifesaver when I needed to check on my adjudication status.

Never heard of that service before. Does it actually work? I've been trying to call Washington ESD for weeks about my pending claim.

It definitely worked for me. Way better than spending hours on hold or getting disconnected. Worth checking out the demo video to see if it would help your situation.

JUST APPLY ALREADY! Stop overthinking it. Even if you're not sure about eligibility, let Washington ESD make that determination. The worst they can do is deny your claim, but at least you'll know for sure. You can always appeal if you disagree with their decision.

0 coins

You're right, I should just go ahead and file. Better to try than wonder what if.

0 coins

Exactly! And if you file right away you won't lose any potential benefit weeks while you're deciding.

I'm going through this exact same situation right now! Got fired three weeks ago for not meeting sales targets and filed for unemployment immediately. My claim is still under adjudication but I'm hoping it gets approved since it wasn't misconduct, just performance issues. The waiting is killing me though.

0 coins

Ugh the waiting is the worst part! Have you heard anything from Washington ESD during the adjudication?

They sent me a questionnaire to fill out about the circumstances of my termination. Had to be really detailed about what happened. Haven't heard anything since then.

0 coins

Three weeks isn't that long for adjudication honestly. Mine took almost 6 weeks but eventually got approved.

Washington ESD has pretty clear guidelines about this. Generally, you're eligible for UI if you lose your job through no fault of your own. Being fired for poor performance usually qualifies, but being fired for misconduct doesn't. The burden is on your employer to prove misconduct occurred.

0 coins

That's helpful context. My employer would have a hard time proving misconduct since I was genuinely trying to improve.

Exactly. Performance issues are different from willful misconduct. You should be fine as long as you weren't deliberately doing anything wrong.

One thing to keep in mind is that even if you get approved, there might be some delay in payments while they sort everything out. Make sure you keep filing your weekly claims even during adjudication, otherwise you could miss out on benefits for those weeks.

0 coins

Good point! I'll make sure to keep filing weekly even if the claim is still pending.

Yes, this is super important! I forgot to file one week during my adjudication and lost that week's benefits permanently.

The whole system is such a mess. I've been trying to get answers about my own claim for weeks and can never get through to anyone at Washington ESD. Their website isn't helpful either when you have specific questions.

Have you tried that Claimyr service someone mentioned earlier? I'm getting desperate enough to try anything at this point.

0 coins

I actually just tried it yesterday after seeing it mentioned here. Got through to an ESD agent in like 20 minutes instead of the usual hours of busy signals. Pretty impressed honestly.

Whatever you do, be completely honest on your application. Don't try to sugarcoat why you were fired or make it sound better than it was. Washington ESD will find out the truth anyway when they contact your employer.

0 coins

Definitely planning to be honest. No point in lying when they'll investigate anyway.

0 coins

Smart approach. Lying on your UI application can get you in serious trouble and disqualify you permanently.

I got fired from my last job for attendance (medical issues) and was worried I wouldn't qualify but Washington ESD approved my claim after adjudication. They determined that my attendance issues were due to legitimate medical reasons, not misconduct. Every case is different but don't assume you won't qualify just because you were terminated.

That gives me hope! Glad it worked out for you.

Medical issues are definitely different from performance issues but both can be non-misconduct terminations.

File immediately! Don't wait. Even if there's adjudication, you want to get your claim started as soon as possible. The sooner you file, the sooner you can potentially start receiving benefits.

0 coins

You're absolutely right. I'm going to file today. Thanks everyone for the advice and encouragement!

Good luck! Hope your adjudication goes smoothly and you get approved quickly.

Just remember you'll also need to start doing your job search activities once you file. Washington ESD requires you to apply for jobs and log your job search efforts every week to keep getting benefits.

0 coins

Good reminder! I better start keeping track of all my job applications.

0 coins

Yeah the job search requirements are pretty strict. Make sure you understand what counts as a valid job search activity.

The Washington ESD website has a good FAQ section about eligibility after termination. Might be worth reading through that before you file so you know what to expect during the process.

0 coins

I'll check that out. Thanks for the tip!

Been through this process twice unfortunately. First time I was denied because they said my termination was for misconduct, but I appealed and won. Second time I was approved right away. Don't give up if you get denied initially - you can always appeal the decision.

0 coins

Good to know appeals are an option if needed. Hopefully it won't come to that though.

Appeals can take a while but they're definitely worth pursuing if you think the initial decision was wrong.
