Can you qualify for unemployment if you get fired in Washington state?

I got terminated from my job last week and I'm not sure if I can even apply for unemployment benefits. My supervisor said it was due to performance issues but I feel like they were looking for reasons to let me go. Does Washington ESD actually approve claims when you get fired instead of laid off? I've heard mixed things and don't want to waste time filing if I'm automatically disqualified.

Yes, you can potentially qualify even if you were fired, but it depends on the reason. Washington ESD looks at whether you were terminated for 'misconduct' or not. Performance issues alone usually don't count as misconduct unless you were deliberately not doing your job.

That's actually reassuring. They said performance but I was really trying, just struggling with the new system they implemented.

0 coins

Same situation happened to me - got fired for not meeting quotas but still got approved for UI benefits.

0 coins

You should definitely file your claim. The worst they can say is no, but getting fired doesn't automatically disqualify you. Washington ESD will investigate and make a determination based on the specific circumstances of your termination.

0 coins

How long does that investigation usually take? I need to start getting benefits ASAP.

0 coins

It can take 2-4 weeks if it goes to adjudication. Sometimes longer if they need more information from you or your employer.

0 coins

I've been trying to get through to Washington ESD for weeks about my own claim issues. Their phone system is impossible! If you need to talk to someone about your eligibility, I found this service called Claimyr that actually got me through. Check out claimyr.com - they have a demo video at https://youtu.be/7DieNd3C7zQ that shows how it works.

0 coins

How much does that cost though? I'm already strapped for cash.

0 coins

It's worth it when you consider how much time you'll save not sitting on hold for hours. Way cheaper than missing out on benefits you're entitled to.

0 coins

MISCONDUCT is the key word here. Things like theft, violence, harassment, or deliberately violating company policy count as misconduct. Poor performance, personality conflicts, or being bad at your job generally don't.

0 coins

They never accused me of any of those serious things, just said I wasn't meeting expectations.

0 coins

Even if your employer claims misconduct, you can appeal if Washington ESD denies your claim initially.

0 coins

File immediately! Don't wait. Even if there's a question about your eligibility, you want to get the process started. You can always appeal if they deny you initially.

0 coins

Good point. I'll start the application tonight. Do I need any special documents?

0 coins

Have your Social Security card, driver's license, and employment history ready. You'll need dates and addresses for all jobs in the last 18 months.

0 coins

this is why companies try to make people quit instead of firing them outright... they know fired employees can still get unemployment

0 coins

Exactly. 'Constructive dismissal' is also a thing - if they make your work environment so bad you have to quit, that can still qualify you for benefits.

0 coins

Wish I had known that. They definitely made things pretty miserable before they finally terminated me.

0 coins

The burden of proof is on your employer to show misconduct occurred. If they can't prove it, you should get approved. Make sure you tell your side of the story clearly when Washington ESD contacts you.

0 coins

That makes me feel more confident. I have documentation showing I was asking for help with the performance issues.

0 coins

Keep all that documentation! Email chains, performance reviews, any written communication about your job performance.

0 coins

I got fired from my last job for being late too many times (my car kept breaking down) and still got unemployment. Washington ESD was pretty fair about it.

0 coins

How long did it take to get your first payment?

0 coins

About 3 weeks total, but that included the one-week waiting period that used to exist.

0 coins

Whatever you do, be completely honest on your application. Don't try to make it sound like you quit or were laid off if you were actually fired. They'll find out anyway when they contact your employer.

0 coins

Yeah I definitely won't lie about it. Just worried they'll automatically deny me.

0 coins

They won't automatically deny you. Each case gets reviewed individually.

0 coins

Also remember you have to keep filing your weekly claims even while the initial determination is being made. Don't miss any weeks or you'll lose out on those benefits permanently.

0 coins

Good to know! I'll make sure to stay on top of the weekly filings.

0 coins

Set a reminder on your phone. I almost forgot one week and it would have been a nightmare to fix.

0 coins

Update on that Claimyr service I mentioned - I used them again today to check on my claim status and got through to an actual Washington ESD rep in under 10 minutes. Seriously worth it if you need to talk to someone quickly.

0 coins

Did they help you resolve your issue or just connect you?

0 coins

They just get you connected to the ESD agent, but that's the hard part. Once you're talking to someone at Washington ESD, they can actually help you.

0 coins

The unemployment system in this state is so confusing. I wish they made the eligibility rules clearer on their website.

0 coins

The Washington ESD handbook actually explains it pretty well, but it's like 50 pages long and written in legal language.

0 coins

That's the problem - who has time to read through all that when you just lost your job?

0 coins

I was fired for 'attitude problems' which basically meant I didn't smile enough at customers. Still got my unemployment approved. Don't let them intimidate you with vague performance reasons.

0 coins

That's ridiculous that they fired you for that, but good to know it didn't hurt your claim.

0 coins

Companies sometimes make up reasons hoping you won't apply for benefits. File anyway!

0 coins

Make sure you start looking for work right away too. Washington ESD requires you to make job search contacts each week to keep getting benefits.

0 coins

How many job contacts do I need to make per week?

0 coins

It's usually 3 per week, but check your specific requirements when you file. They'll tell you exactly what you need to do.

0 coins

The key thing is that Washington ESD looks at whether your termination was your fault or the employer's fault. Performance issues are usually considered the employer's fault unless you were deliberately sabotaging your work.

0 coins

That makes sense. I was definitely trying my best, just couldn't keep up with their new system.

0 coins

Sounds like a training issue on their part, not misconduct on yours.

0 coins

Even if your initial claim gets denied, you can appeal the decision. I've seen plenty of people win their appeals after being initially denied for misconduct.

0 coins

How long does the appeal process take?

0 coins

Usually 4-8 weeks for a hearing to be scheduled, but you can request expedited processing if you're facing financial hardship.

0 coins

Bottom line - file your claim ASAP. The sooner you file, the sooner you'll know for sure if you qualify. Don't assume you won't qualify just because you were fired.

0 coins

Thanks everyone for all the advice. I'm going to file tonight and see what happens.

0 coins

Good luck! Come back and let us know how it goes.

0 coins

One more thing - if Washington ESD does approve your claim, your employer might appeal the decision. Don't panic if that happens, it's pretty common and doesn't mean you did anything wrong.

0 coins

Would I have to pay back benefits if they successfully appeal?

0 coins

Only if the appeal decision goes against you, but you'd get to present your case at a hearing first.

0 coins

I used that Claimyr service someone mentioned earlier when I had questions about my claim. Really saved me hours of trying to get through on the phone. The demo video they have explains exactly how it works.

0 coins

Is it legit though? Seems too good to be true.

0 coins

Totally legit. They don't ask for your personal info or login details. They just help you get connected to Washington ESD faster.

0 coins

Remember that being fired and being terminated for cause are two different things in Washington state. Performance issues usually fall under regular termination, not termination for cause.

0 coins

Is there a difference in how Washington ESD treats those two situations?

0 coins

Termination for cause (misconduct) can disqualify you from benefits. Regular termination for performance usually won't.
