If you get fired can you file unemployment in Washington - need advice

I got terminated from my job last Friday and I'm trying to figure out if I can even apply for unemployment benefits. My manager said it was for performance issues but I feel like they were just looking for reasons to let me go. I've been working there for almost 2 years and never had any formal write-ups. Can you still file for unemployment in Washington if you got fired? I'm really stressed about this and don't know where to start.

Yes, you can absolutely file for unemployment even if you were fired. The key is whether you were terminated for 'misconduct' or not. Performance issues usually don't count as misconduct unless they were willful or repeated after warnings. You should definitely file your claim with Washington ESD right away - don't wait.

Thank you! That's a relief. I was worried I wouldn't qualify at all. How do I start the process?

Go to esd.wa.gov and click on 'File a Claim for Benefits'. You'll need your Social Security number, driver's license, and employment history for the last 18 months. File as soon as possible because there's a waiting week.

I got fired last year and still got approved for benefits. Washington ESD will investigate your termination and decide if it was for misconduct. They'll contact both you and your employer to get the facts. Even if your employer contests it, you might still win if you can show it wasn't misconduct.

Did they ask for a lot of documentation? I'm worried my employer will make up stuff to try to disqualify me.

0 coins

They asked for my side of the story and any documents I had. If your employer tries to lie, you can appeal and provide evidence. Keep any emails or performance reviews you have.

Just want to mention that if you're having trouble getting through to Washington ESD to check on your claim status, I found this service called Claimyr that helps you get connected to an actual agent. They have this system that calls for you and gets you through the busy lines. Check out claimyr.com - they even have a demo video at https://youtu.be/7DieNd3C7zQ showing how it works. Really saved me a lot of frustration.

Is that legit? I've been trying to call Washington ESD for weeks about my adjudication.

0 coins

Yeah it's real. I was skeptical too but it actually worked. Way better than spending hours on hold or getting hung up on.

The system is so confusing tho! I filed after getting fired and they put my claim in adjudication for like a month. Never explained why just said they were investigating. Finally got approved but man was it stressful waiting.

0 coins

A whole month?? That's terrifying. How did you survive financially during that time?

0 coins

Had to borrow money from family. The back pay helped when it finally came through but yeah it was rough.

0 coins

Adjudication is normal when there's a separation issue like being fired. It just means they need to investigate before approving benefits.

0 coins

What exactly counts as misconduct anyway? My friend got fired for being late too many times but still got unemployment.

0 coins

Misconduct has to be willful and work-related. Chronic tardiness can be misconduct if there were warnings, but it depends on the circumstances. Poor performance due to inability rather than unwillingness usually isn't misconduct.

I think it also matters if you were actually trying to improve or just didn't care. Washington ESD looks at the whole situation.

File immediately!! Don't wait to see if you'll get another job quickly. Even if you do find work right away, you want that claim established. The waiting week starts from when you file, not when you get approved.

0 coins

Good point, I'll do it today. Better safe than sorry.

This is smart advice. I waited two weeks thinking I'd find something fast and ended up kicking myself when it took longer than expected.

Just be honest on your application about what happened. Don't try to hide that you were fired or make up stories. Washington ESD will find out anyway when they contact your employer, and lying can disqualify you entirely.

0 coins

Yeah I definitely won't lie. I just hope they see my side of things.

0 coins

They're pretty fair about it. Just stick to the facts and don't get emotional in your explanation.

0 coins

The whole system is rigged anyway. Employers can contest anything and drag it out forever. I got fired for supposedly violating company policy but it was really just because they wanted to hire their friend's kid. Took 6 weeks to get approved.

0 coins

That sucks but at least you eventually got approved. The system isn't perfect but it does work for most people.

0 coins

True, just wish it was faster. Bills don't wait for Washington ESD to make up their mind.

Make sure you keep filing your weekly claims even if your initial claim is under review. A lot of people don't realize you have to do that to get paid for those weeks later.

0 coins

I didn't know that! So I file weekly claims before I'm even approved?

0 coins

Yes! You have to file for each week you want to claim benefits, even during adjudication. If you don't file for a week, you can't get paid for it later.

0 coins

Also remember you'll need to do the job search requirements once you start getting benefits. I think it's 3 job contacts per week now but check the current rules.

0 coins

It's actually 2 job contacts per week for most people, but some might have different requirements based on their situation.

0 coins

Oh thanks for the correction! I was thinking of the old rules maybe.

0 coins

Been there done that. Got fired, filed for UI, employer contested, went to a hearing, and won. The whole process took about 10 weeks but I got back pay for everything. Don't give up if they initially deny you.

0 coins

10 weeks?! How did you handle the hearing? That sounds intimidating.

0 coins

It was actually pretty informal. Just a phone call with an administrative law judge. I explained my side, employer explained theirs, judge asked some questions, and ruled in my favor a few days later.

0 coins

Whatever you do, don't quit to avoid being fired. I made that mistake thinking it would look better but then I couldn't get unemployment at all because I voluntarily left.

0 coins

Too late for that advice but good to know for the future I guess.

0 coins

Yeah quitting is usually worse for unemployment unless you have good cause like unsafe working conditions or harassment.

0 coins

One more thing - if you're getting any severance pay, that might affect when your benefits start. Washington ESD has rules about how severance is treated so make sure you report it accurately.

0 coins

I didn't get any severance unfortunately. They just walked me out that day.

0 coins

That's actually better for unemployment timing then. Severance can delay when benefits start in some cases.

I used Claimyr when I couldn't get through to Washington ESD about my fired/quit situation. They got me connected to an actual person who walked me through the whole process. Definitely worth it if you're stuck trying to reach them.

I keep seeing people mention this service. Might be worth trying if I run into issues.

0 coins

Same here, used it when my claim got stuck in adjudication. Much better than the endless phone tree.
