I was fired from my job can I get unemployment - Washington ESD eligibility?

So I got terminated last Friday and I'm wondering if I can still file for unemployment benefits through Washington ESD. My manager said it was due to performance issues but honestly I think they just wanted to get rid of me because I'd been there 3 years and was making more money than the newer hires. I wasn't given any written warnings or put on a performance improvement plan or anything like that. Does anyone know if being fired automatically disqualifies you from getting UI benefits in Washington? I really need to know if it's worth applying or if I'm just wasting my time.

You can definitely still apply for unemployment even if you were fired! Washington ESD doesn't automatically disqualify people who were terminated - it depends on the reason. If it was for performance issues rather than misconduct, you might still be eligible. The key is whether it was willful misconduct or just not being able to do the job adequately.

That's good to hear. What exactly counts as misconduct vs performance? I never did anything dishonest or broke company rules, I just struggled with some of the newer software they implemented.

Misconduct usually means things like stealing, violating company policy, being insubordinate, or deliberately not following instructions. Struggling with new systems typically falls under performance, especially if you were trying to learn.

I went through this same situation 2 years ago. Got fired for allegedly poor performance but I knew it was really because they wanted to hire someone cheaper. Filed for unemployment anyway and got approved after they investigated. Washington ESD will contact your former employer to get their side of the story during the adjudication process.

How long did the investigation take? I'm worried about how I'll pay rent if this drags on for months.

0 coins

Mine took about 3 weeks total. They called my old boss and then called me to ask about the circumstances. As long as you're honest about what happened, you should be fine.

0 coins

3 weeks?? Mine has been in adjudication for 6 weeks now and still no decision. I can't even get through to anyone at Washington ESD to check on the status.

0 coins

Ugh the whole process is such a nightmare. I've been trying to call Washington ESD for weeks about my claim and can never get through. The phone system just hangs up on you after being on hold forever. Has anyone found a way to actually talk to a real person there?

0 coins

I had the same problem until someone told me about this service called Claimyr (claimyr.com) that helps you get through to Washington ESD agents. They have this whole system that calls for you and gets you connected. There's even a video demo showing how it works: https://youtu.be/7DieNd3C7zQ

File the claim ASAP regardless! Even if you think you might not qualify, it's better to apply and let Washington ESD make the determination. The worst they can do is deny it, but if you don't apply at all you definitely won't get anything. Plus there's a waiting period anyway so the sooner you file the better.

Good point. I guess I have nothing to lose by trying. Do I need to have my termination paperwork before I can file?

0 coins

Nope, you can file without it. They'll ask for details about your last day of work and reason for separation but you don't need physical documents to start the application.

0 coins

Been there done that. Performance issues are tricky because employers love to claim everything is misconduct to avoid paying into the unemployment system. Make sure you document everything you can remember about your termination conversation and any performance discussions you had.

0 coins

I wish I had recorded it but who thinks to do that when you're getting fired. Should I write down what I remember now while it's still fresh?

0 coins

Absolutely! Write down dates, who was present, exactly what was said about why you were being terminated. That info will be helpful if Washington ESD needs more details during adjudication.

0 coins

This is why I keep a work journal of every interaction with my supervisor. You never know when you might need it.

The Washington ESD website has a whole section about being fired and unemployment eligibility. Basically if you were fired for reasons within your control (like being late constantly) you might be disqualified, but if it was about your ability to do the job itself, you should be fine.

0 coins

Where on the site is that info? I looked around but couldn't find anything specific about terminations.

0 coins

It's under the eligibility requirements section. They have examples of what counts as misconduct vs what doesn't.

0 coins

whatever you do dont let them bully you into not filing!! employers try to scare people by saying they'll fight the claim but most of the time they dont even respond to Washington ESD when they investigate

0 coins

My old boss did seem pretty confident that I wouldn't be able to get benefits. Maybe he was just trying to intimidate me?

0 coins

probably! they say that to everyone. file anyway and let the chips fall where they may

0 coins

I'm going through something similar right now. Got let go 2 months ago for 'not meeting expectations' but I think it was really because I complained about safety issues. Filed for unemployment and still waiting to hear back. The uncertainty is killing me.

0 coins

2 months?? How are you surviving financially? This is exactly what I'm worried about.

0 coins

Burning through savings and borrowing money from family. It's awful. I should have applied for emergency assistance too but didn't know about it until recently.

0 coins

You can apply for food assistance and other emergency aid while your claim is pending. Don't wait if you need help now.

Here's what I learned from my experience: Washington ESD really does investigate thoroughly when someone was fired. They'll ask your employer for documentation of the performance issues and if they can't provide it, that works in your favor. Sounds like your situation might qualify since you didn't get proper warnings.

0 coins

That gives me hope. I never got anything in writing about my performance being an issue until the day they fired me.

0 coins

Exactly! Proper progressive discipline usually involves verbal warnings, written warnings, improvement plans, etc. If they skipped all that it suggests it wasn't really about performance.

0 coins

The adjudication process can be stressful but try not to panic. I've seen people get approved even after being fired for cause because Washington ESD looks at the whole situation. Just be completely honest when they contact you for your side of the story.

0 coins

How will I know when they're investigating? Do they send notice or just call out of the blue?

0 coins

They'll update your claim status online to show it's in adjudication, then someone will call you within a few weeks. Make sure to answer unknown numbers during business hours.

0 coins

Pro tip: file your claim online late at night or early morning when the system is less congested. I tried for days during normal business hours and kept getting error messages.

0 coins

Good to know! I was planning to try tomorrow during lunch but maybe I'll do it tonight instead.

0 coins

Yeah the system gets overloaded during peak times. 11 PM or 6 AM worked best for me.

0 coins

Don't forget you still have to do work search activities even while your claim is being adjudicated. Keep track of your job applications because you'll need to report them on your weekly claims.

0 coins

Wait, I have to start looking for work immediately? Even before I know if I'm approved?

0 coins

Yep, the work search requirement starts right away. You need to apply for jobs and keep a log of your activities.

0 coins

The WorkSourceWA website has job search tools and they count some of those activities toward your requirements too.

I was in almost the exact same situation last year - fired for performance after 3 years with no prior warnings. Got approved for benefits after about 4 weeks of adjudication. The key was being able to show I was trying to do the job but just wasn't given proper support or training on new systems.

0 coins

This is so encouraging to hear! Did you have to appeal or did they approve you on the first review?

0 coins

Approved on first review. I think what helped was being very specific about the lack of training and support when they interviewed me.

0 coins

Whatever you do, don't delay filing. Benefits are only backdated to when you first apply, not when you were actually terminated. Every day you wait is money you're potentially losing.

0 coins

I didn't know that! I was going to take a few days to get my paperwork together but sounds like I should file now.

0 coins

File now, gather paperwork later. You can always provide additional documentation during the adjudication process if they need it.

0 coins

Just wanted to add that if you do get denied initially, don't give up! You have the right to appeal and lots of people win on appeal even if they lose the first determination. I had to go through 2 levels of appeals but eventually got my benefits.

0 coins

How long does the whole appeal process take if it comes to that?

0 coins

It can take several months unfortunately. But you get backpay for the whole period if you win, so it's worth fighting for if you believe you're eligible.

0 coins

The appeal hearing is usually by phone and you can have a lawyer or advocate help you if needed. Don't try to navigate it alone if it gets to that point.

0 coins

One more thing - if you're having trouble getting through to Washington ESD for updates on your claim, I had success using that Claimyr service someone mentioned earlier. Really saved me time and frustration trying to reach an agent.

0 coins

I might have to try that if I can't get through the normal way. The thought of sitting on hold for hours is giving me anxiety.

0 coins

Same here, I used Claimyr when I needed to check on my adjudication status. Much easier than the regular phone system.
