How long do you have to claim unemployment benefits - Washington ESD deadline confusion
I'm getting really confused about the timing rules for claiming unemployment benefits through Washington ESD. I lost my job about 2 months ago but haven't filed yet because I thought I might find something quickly. Now I'm worried I waited too long. Is there a deadline for how long you have to claim unemployment benefits after losing your job? I keep seeing different information online and I'm starting to panic that I missed my chance completely. Can someone clarify what the actual time limits are for filing an initial claim with Washington ESD?

You haven't missed your chance! In Washington, you can file for unemployment benefits as long as you're still unemployed and meet the other eligibility requirements. There's no strict deadline like 'you must file within 30 days' or anything. However, your benefits will only be paid from the week you actually file your claim - they don't backdate to when you first became unemployed. So the sooner you file, the better.

•Oh thank god! I was so worried I had completely screwed myself by waiting. So I should file this week then?

•definitely file asap! i waited 3 weeks and basically lost 3 weeks of benefits that i could have gotten

The key thing to understand is that Washington ESD has a 'waiting week' but no filing deadline. You can file your initial claim anytime you're unemployed, but benefits start from your claim date, not your job loss date. Also make sure you have your employment history for the last 18 months ready - you'll need employer names, addresses, dates of employment, and reason for separation.

•What exactly is a waiting week? Does that mean I have to wait an extra week before getting any money?

•The waiting week was actually eliminated in Washington. You can receive benefits starting with your first eligible week now. Just make sure to file your weekly claims on time every week after you submit your initial application.

I had a similar situation last year. Filed about 6 weeks after losing my job because I kept thinking I'd find work. The biggest thing I learned is that even if you're job searching or doing interviews, you should still file for unemployment. You can always stop claiming if you find a job, but you can't get back those weeks of benefits you didn't claim.

•That's exactly what I was thinking - that I shouldn't file if I was actively looking. Good to know I was wrong about that.

•This is so true! I made the same mistake thinking unemployment was only for people who had given up looking for work.

Pro tip: if you're having trouble getting through to Washington ESD to ask questions about your claim timeline or anything else, I recently discovered Claimyr (claimyr.com). They help you actually reach a live agent without sitting on hold forever. There's a video demo at https://youtu.be/7DieNd3C7zQ that shows exactly how it works. Super helpful when you need answers about filing deadlines or claim status.

•Is this legit? I've been dreading having to call Washington ESD because I heard the wait times are horrible.

•Yeah it's real. Used it twice now when I had questions about my job search requirements. Way better than trying to call on your own and getting hung up on after 2 hours.

•how much does this cost though? i'm unemployed so money is tight

just want to add that even though theres no deadline to file, there IS a deadline for how long you can collect benefits once you start. regular UI in washington is up to 26 weeks i think? but if you wait months to file you're just losing those weeks

Connor O'Neill
•Correct - it's up to 26 weeks of regular unemployment insurance, and your benefit year lasts 52 weeks from when you file. So timing does matter in terms of maximizing your benefits.

•OK so I really need to file this week then. Thanks everyone for the push I needed!

Wait, I'm confused about something related to this. If there's no deadline to file, what about people who get fired and then find a new job right away, but then lose that job too? Can they still file for the first job?

•That's a good question. Washington ESD looks at your entire work history during your 'base period' (usually the first 4 of the last 5 completed quarters). So if you worked multiple jobs, they'll consider wages from all qualifying employers when calculating your benefit amount.

FireflyDreams
•So it doesn't matter which specific job loss triggers you to file? They look at everything?

Yara Khalil
•Right, they calculate your benefits based on all qualifying wages in your base period, not just your most recent job. The most recent job separation just needs to be qualifying (like layoff, not misconduct).

I keep seeing posts about people waiting months to file and I just don't understand it. Like, unemployment insurance is something you've paid into through your payroll taxes. It's not welfare or charity - you've literally earned this benefit. File as soon as you're eligible!

•There's definitely still stigma around it. I felt weird about filing too even though I knew it was my right.

•Yeah I think that was part of my hesitation too. Plus I really thought I'd find something quickly.

WASHINGTON ESD SYSTEM IS TRASH!!!! I filed 2 months ago and my claim is still in adjudication with no explanation. They don't answer phones, don't respond to messages through SecureAccess Washington. The whole system is designed to deny people benefits they've earned!

•This is exactly why I mentioned Claimyr earlier. When my claim got stuck in adjudication, that's how I finally got through to someone who could explain what documents they needed from me.

•How long did your adjudication take once you got through to them?

Amina Toure
•About another week after I submitted the additional docs they requested. The agent was actually really helpful once I could talk to a real person.

Question for the group - I filed my initial claim but I'm not sure I did it right. How do you know if Washington ESD actually received and accepted your application? I submitted everything online but haven't heard anything back yet.

Connor O'Neill
•You should receive a monetary determination letter within a week or two that shows your benefit amount and base period wages. You can also check your claim status by logging into your SecureAccess Washington account.

•OK I'll check my SAW account. I was expecting like an immediate confirmation email or something.

everybody talking about filing deadlines but what about the weekly claim deadlines? those are way more important once you start claiming
0 coins
Yara Khalil
•True! Once you file your initial claim, you must file your weekly claims by midnight on Sunday for the previous week. Missing that deadline can delay or complicate your benefits.

Zainab Ibrahim
•Good point. So even though there's flexibility on when to start, once I start I need to be really consistent with the weekly filings.

•exactly! and make sure you do your job search activities every week or they'll audit you

I hate how confusing all this is. Like why can't Washington ESD just have a simple FAQ that clearly explains all the deadlines and requirements? Instead you have to piece together information from random forum posts and hope it's accurate.

Paolo Esposito
•They do have an FAQ but it's written in government speak that nobody understands. This forum is honestly more helpful than their official site half the time.

•Agreed! I learned more from this thread than from an hour of reading their website.

wait so if i lost my job in december but didnt file until march, i basically lost 3 months of benefits? thats like $4000+ i just threw away?
0 coins
Connor O'Neill
•Unfortunately yes, you can't get benefits for weeks before you file your initial claim. That's why it's so important to file as soon as you become unemployed, even if you think you might find work quickly.

Oliver Weber
•damn. wish someone had told me that in december. just assumed i could backdate it

•Don't beat yourself up too much. A lot of people make this mistake. At least now you know for the future.

Related question - is there any situation where Washington ESD WILL backdate benefits? Like if you were in the hospital or something and couldn't file right away?
0 coins
Yara Khalil
•There are very limited circumstances where they might allow backdating, usually involving serious illness or other situations beyond your control. But these are exceptions and require documentation. Generally, they don't backdate claims.

Isabella Ferreira
•Good to know. Hopefully I never need to test that exception!

Just wanted to share my timeline for anyone else wondering: Lost job on Friday, filed claim the following Tuesday (first business day I could sit down and do it properly), received monetary determination the next Monday, first payment hit my account 2 weeks after filing. Pretty smooth process overall.

Zainab Ibrahim
•That gives me hope! Sounds like if you file promptly and don't have any complications, it moves pretty quickly.

•lucky you didnt get stuck in adjudication! that seems to be happening to more people lately

OK here's what I don't understand - if there's no deadline to file initially, why do they make such a big deal about filing your weekly claims on time? Seems inconsistent.
0 coins
Connor O'Neill
•The initial claim establishes your eligibility and benefit year. The weekly claims are you certifying that you remain eligible each specific week. They serve different purposes in the system.

•Ah OK that actually makes sense when you explain it like that. Thanks!

One more thing to add - even if you start a part-time job or gig work, you might still be eligible for partial unemployment benefits. Don't assume that any work income automatically disqualifies you. Washington ESD has formulas for partial benefits.

Zainab Ibrahim
•Really? I didn't know that. I've been doing some freelance work here and there.

Omar Mahmoud
•Yeah, you just need to report all your earnings when you file your weekly claims. They'll calculate if you're still eligible for partial benefits based on what you earned that week.
0 coins
Yara Khalil
•Correct - in Washington you can earn up to a certain amount before it affects your benefits, and even above that amount you might still get partial payments.

Final thought - screenshot or save this thread because Washington ESD's website goes down randomly and you might need to reference this info later when you're filing your weekly claims or have questions.
