How long after unemployment can you file - Washington ESD timing requirements?
I've been putting off filing for unemployment because I thought I might find work quickly, but it's been about 6 weeks since I lost my job. I keep hearing different things about deadlines for filing with Washington ESD. Some people say you have to file immediately, others say you can backdate claims. What's the actual rule? Can I still file now or did I miss my chance? Really stressed about this because I could have used those benefits over the past month and a half.

You can still file! Washington ESD allows you to backdate your claim up to one year from when you became unemployed. However, there's a one-week waiting period that applies to the first week of your claim. The sooner you file, the better - they don't automatically backdate everything so you'll need to request backdating during your application.

•Thank you! Do I need to provide documentation for why I waited so long to file?

•They might ask during the application process, but 6 weeks isn't that unusual. Many people wait thinking they'll find work quickly.

Same thing happened to me last year - waited 2 months before filing because I was embarrassed about being unemployed. Washington ESD backdated my claim but I had to specifically request it and explain the delay. Don't wait any longer though, every week you delay is potentially money lost.

•Did they give you benefits for all the weeks you were unemployed or just from when you filed?

•They backdated it to my actual separation date minus the one week waiting period. Had to do phone verification though which took forever to get through.

•Getting through to Washington ESD by phone is impossible lately. I tried calling for weeks about my backdating request. Finally used this service called Claimyr (claimyr.com) that calls for you and gets you connected to an actual agent. There's a demo video at https://youtu.be/7DieNd3C7zQ showing how it works. Saved me so much frustration.

wait I thought there was like a 30 day deadline or something?? I've been unemployed for 3 months and haven't filed because I thought I missed the window. Are you saying I can still file now?

•There's no 30-day deadline for initial filing. You're thinking of the deadline for appealing a decision, which is 30 days. You can definitely still file after 3 months, but you'll need to request backdating and explain the delay.

•Don't beat yourself up - tons of people don't know the rules. File today and request backdating. The worst they can say is no, but you'll likely get approved for at least some of those weeks.

Quick update - I filed online last night and there was actually a section asking if I wanted to backdate my claim. I selected yes and put in my actual separation date. Now it's showing as 'under review' in my SecureAccess Washington account. Fingers crossed!

•Good job getting it filed! The review process usually takes 1-2 weeks for backdating requests. Make sure you continue filing your weekly claims even while it's under review.

•Yes definitely keep filing weekly claims! I made the mistake of not filing while waiting for my backdating decision and it created more complications.

For anyone reading this - here's what I learned about Washington ESD backdating rules: You can backdate up to 1 year, but you need a good reason for the delay. Valid reasons include not knowing you were eligible, medical issues, or thinking you'd find work quickly. They're pretty reasonable about it in my experience.

•What counts as a 'good reason' though? I waited because I was getting severance pay and thought I couldn't file until it ran out.

•That's actually a common misconception and would probably be accepted as a valid reason. You can often receive unemployment while getting severance, depending on how it's structured.

The Washington ESD website is confusing about this. I read through all the FAQ sections and it wasn't clear about backdating rules. Had to call three times before I got a straight answer from an agent.

•The phone system is brutal. I wasted hours trying to get through before discovering Claimyr. Now I just use that service whenever I need to talk to someone at Washington ESD. Worth every penny to avoid the phone tree nightmare.

•Never heard of that service but honestly might be worth it. I've been trying to reach them for two weeks about my claim status.

Important note: even if they approve your backdating request, you still won't get paid for the first week due to the waiting period. So if you were unemployed for 6 weeks, you'd get benefits for 5 weeks maximum. Just want to set expectations.

•That's still better than nothing! I was expecting to get zero benefits at this point.

•The waiting period is such BS. Other states don't have that anymore but Washington still does. Every week counts when you're unemployed.

Does anyone know if there are different rules for different types of job separation? I was laid off vs fired vs quit - does that affect the backdating timeline?

Oliver Fischer
•The backdating timeline is the same regardless of separation type - up to one year. However, the reason for separation affects your eligibility for benefits overall. Laid off is usually straightforward, fired depends on the reason, and quit requires good cause.

•Got it, thanks. I was laid off so should be fine on that front.

PSA: if you're reading this and unemployed, just file now even if you think you might find work soon. You can always stop claiming benefits if you find a job, but you can't go back in time. Don't make the same mistake I did waiting 8 weeks.

•This is such good advice. I always tell people to file immediately because there's no downside to filing early but lots of downsides to filing late.

•Yep, learned this the hard way too. Pride kept me from filing for months thinking I'd find something quickly. Should have swallowed my pride and filed day one.

Update for the original poster: make sure you have all your employment documentation ready. When they review backdating requests, they sometimes ask for proof of your separation date, last day worked, final paycheck, etc. Better to have it all ready.

•Thanks for the heads up! I have my termination letter and final pay stub saved. Anything else I should gather?

•That should cover it. Sometimes they want your work search log if you were looking for work during the gap, but that's not always required for backdating.

•If you need to talk to someone about what documentation they need, that Claimyr service mentioned earlier is really helpful. They can get you connected to an agent who can tell you exactly what Washington ESD needs for your specific situation.

Just wanted to share my experience for anyone else in this situation - I filed for backdating after 10 weeks of unemployment and Washington ESD approved it without any issues. The key is being honest about why you delayed. I explained that I was actively job searching and thought I'd find work quickly, plus I wasn't fully aware of the backdating option. They processed my request in about 10 days and I received benefits for 9 out of the 10 weeks (minus the waiting period). Don't let fear or embarrassment stop you from filing - the system is designed to help people who need it.
