How long can you wait to collect unemployment in Washington after job loss?
Lost my job two months ago and I've been hesitant to file for unemployment because I thought I might find something quickly. Now I'm wondering if I waited too long? Is there a deadline for when you have to apply after losing your job in Washington? I keep hearing different things from people and I'm worried I missed my chance. My last day of work was in early November and it's January now. Can Washington ESD still process my claim or did I mess up by waiting this long?

You can file a claim up to one year after your last day of work, but you can only get benefits for weeks AFTER you file the claim. So if you file today, you won't get retroactive payments for those two months you waited. The sooner you file, the better.

•Wait so I lost out on two months of payments completely? That's like $2400 I can't get back?

•Unfortunately yes, you can't get retroactive benefits for weeks before you filed. That's why they always say to file immediately after job loss.

File your claim ASAP! I made the same mistake and waited 6 weeks thinking I'd find work fast. Lost out on over $3000 in benefits. The waiting week is bad enough without adding more weeks on top of it.

•Ugh this is so frustrating. I was trying to be responsible and not take benefits if I didn't need them.

•That's admirable but unemployment is insurance you paid into through your paychecks. It's your money.

The one year rule is correct but there are some nuances. If you had 'good cause' for the delay, Washington ESD might consider backdating in very specific circumstances. Usually this applies to things like medical emergencies or being misinformed by an employer. Regular hesitation to file typically doesn't qualify as good cause.

•What counts as good cause? My employer told me I might be called back but that fell through after a month.

•That's a gray area. If your employer gave you specific dates or promises in writing about recall, that might be considered. You'd need documentation though.

•I tried this route when my employer strung me along for 3 weeks saying they might bring me back. Washington ESD didn't buy it without written proof.

Just went through this process last month after waiting 7 weeks to file. Getting through to Washington ESD to ask about backdating was impossible with their phone system. Spent hours calling and either got disconnected or sat on hold forever. Finally used Claimyr (claimyr.com) to get connected to an actual agent who explained the rules clearly. Saved me so much frustration and they have a video demo at https://youtu.be/7DieNd3C7zQ that shows exactly how it works.

•How much did that cost? I'm already behind on bills and can't afford to pay extra fees right now.

•It was worth it to actually talk to someone who could give me definitive answers instead of guessing from online forums. Much cheaper than losing more weeks of benefits.

This is why the unemployment system is so messed up! They don't tell people clearly that you lose benefits forever if you don't file immediately. How are people supposed to know this stuff?

•The information is on their website but honestly who reads all that when you're dealing with job loss stress?
0 coins
Alejandro Castro
•Exactly! And their website is confusing as hell anyway. Half the links don't work and the other half lead to PDF files from 2019.

File your claim online at secure.esd.wa.gov today. Don't wait another day. Yes you lost those 8 weeks of benefits but you can still get benefits going forward. The process takes a few days to get approved so start now.

•Should I mention in my application that my employer said they might call me back? Or will that hurt my claim?

Bruno Simmons
•Be honest about everything. If they said they might recall you but never gave specific dates or guarantees, that shouldn't affect your eligibility.

same thing happened to my brother in law, waited like 3 months because he was embarrassed about filing. lost thousands of dollars he could have gotten

•Yeah there's definitely a stigma around it. I felt like I was taking handouts even though I worked for 8 years straight.

•You paid unemployment insurance taxes on every paycheck. This isn't welfare, it's insurance you already paid for.

Also remember that once you file, you need to complete your weekly claims every week even if you're still job searching. Missing weekly claims can cause issues with your payments. Set a reminder for the same day each week.

•How strict are they about the job search requirements? I've been applying but haven't been keeping detailed records.

Teresa Boyd
•You need 3 job search activities per week and they can audit your job search log at any time. Keep detailed records of every application, contact, and interview.

•I got selected for a job search audit after 4 weeks. Had to provide proof of every single application. Good thing I kept screenshots and confirmation emails.

One more thing - if you're thinking about taking any part-time work while collecting, make sure you report it properly on your weekly claims. Even one day of work affects your benefit amount for that week.

Landon Morgan
•I might pick up some gig work to make ends meet. Do I need to report that too?

Lourdes Fox
•Yes, all income including gig work, freelance, anything. They'll reduce your weekly benefit amount dollar for dollar after the first $5.

Washington's waiting week is rough enough without adding voluntary delays. At least you don't have to serve another waiting week since you're filing within the same benefit year.

Landon Morgan
•What's a waiting week? Is that different from the processing time?
0 coins
Asher Levin
•The first week you file is a 'waiting week' where you meet all requirements but don't get paid. So your first payment comes after your second weekly claim.

Don't beat yourself up too much about waiting. Lots of people don't know the rules. Focus on getting your claim filed now and following all the requirements going forward. You can still collect for the remainder of your benefit year.

•Thanks, I really needed to hear that. I'll file today and just accept that I learned an expensive lesson.

•Smart move. And tell your friends about the immediate filing rule so they don't make the same mistake.

Been there with the phone system nightmare. Spent literally 4 hours one day trying to get through to ask about my claim status. Finally someone recommended Claimyr and I got connected to an agent in like 15 minutes. Game changer for dealing with Washington ESD when you actually need to talk to someone.

•Is that service legit? Seems too good to be true that they can actually get you through to ESD agents.

Zane Gray
•Totally legit. They have some kind of system that gets past the busy signals and holds your place in line. Worth every penny when you're dealing with claim issues.

Just to clarify the timeline rules: You have one year from your last day of work to file an initial claim, but benefits only start from the week you file. There's no backdating for regular voluntary delays. File within 7 days of job loss to avoid losing any potential benefits.

•Wish someone had told me that 2 months ago! I'll definitely spread this info to friends who might face layoffs.

•This should be posted everywhere. Companies should be required to tell employees this when they lay people off.

Monique Byrd
also make sure you have all your employer info ready when you file - company name, address, dates of employment, reason for separation. makes the process go smoother

•Good tip. I still have my W-2 from last year and my final pay stub with all that info.

•perfect, that's exactly what you need. should be able to complete the whole application in one sitting

The psychological barrier to filing is real. I waited 3 weeks because I kept thinking 'tomorrow I'll hear back from that interview' or 'maybe the recall will happen'. Those maybes cost me $1800 in benefits I'll never see.

Landon Morgan
•That's exactly my thought process! Always thinking something would come through in the next few days.

•I tell everyone now - file immediately and if you get a job offer before your first payment, great! You can always stop claiming. But you can't go backwards and claim weeks you didn't file for.

One year deadline is correct but I've heard of people getting exceptions for military deployment or serious medical issues. Regular 'I thought I'd find work soon' doesn't qualify though. Washington ESD is pretty strict about this rule.

Landon Morgan
•Makes sense. My situation is just regular job loss with no special circumstances.

Haley Stokes
•Then unfortunately those 8 weeks are gone, but file today so you don't lose any more time.

Quick question - after you file, how long before the first payment usually comes? I know there's processing time plus the waiting week.
0 coins
Teresa Boyd
•Typically 2-3 weeks if there are no issues with your claim. Week 1 is the waiting week, then week 2 you file your first payable claim, payment comes during week 3.
0 coins
Landon Morgan
•So I'm looking at about 3 weeks from filing to getting money? That's going to be tight with bills.

Sara Unger
•Yeah that's normal timing if everything goes smoothly. Longer if your claim needs adjudication for any reason.

Another Claimyr success story here - used them when my claim got stuck in adjudication for 6 weeks. Couldn't get anyone at Washington ESD to explain what was happening or when it might resolve. Claimyr got me connected to an adjudicator who walked me through exactly what they needed to complete my case. Resolved within a week after that call.

Landon Morgan
•6 weeks in adjudication sounds like a nightmare. I hope my claim goes through without issues.

•Most claims are pretty straightforward. Mine had complications because I had some 1099 work mixed in with W-2 employment. Just keep your job separation simple and clear when you file.

Bottom line: file your claim today online at secure.esd.wa.gov. Accept that you lost 8 weeks of benefits and don't lose any more. Set up your SecureAccess Washington account if you don't have one already. The whole process takes maybe 30 minutes if you have your employer info ready.
