Can you apply for unemployment months later with Washington ESD?
I lost my job back in August but didn't apply for unemployment right away because I thought I'd find something quickly. It's now January and I'm still looking. Can I still file a claim with Washington ESD or is it too late? I heard there are time limits but I'm not sure what they are. Really kicking myself for not applying sooner but I didn't think I'd need it.

You can still apply but you won't get backpay to August. Washington ESD only pays from the week you file your claim forward, not retroactively. The sooner you file the better since you're still unemployed.

•So I basically lost out on 5 months of benefits? That's thousands of dollars...

•Unfortunately yes. The effective date of your claim is when you file, not when you became unemployed. But file now so you don't lose any more time.

•How long did it take for your claim to get approved after you finally applied?

•took about 2 weeks but that was because I had all my documentation ready

There's no time limit to apply for unemployment benefits in Washington, but like others said, you can't get retroactive payments. The waiting period starts from when you file. If you're having trouble getting through to Washington ESD to file your claim, I used Claimyr.com recently - they have a service that helps you get through to an actual agent. There's a video demo at https://youtu.be/7DieNd3C7zQ that shows how it works.

•Is that service legit? I've been trying to call Washington ESD for days and can't get through.

•Yeah it worked for me. I was getting the busy signal constantly and this got me connected to an agent in about 20 minutes.

•I'll check that out, thanks. The Washington ESD phone system is impossible.

File your claim online at secure.esd.wa.gov if you can. It's usually faster than calling. You'll need your Social Security number, employment history for the last 18 months, and reason for separation from your last job.

•I tried the website but it keeps timing out. Is there a better time to try?

•Early morning or late evening usually work better. Avoid peak hours between 9am-3pm.

Wait so if I got laid off in December but didn't apply until now in January, I lose December benefits??

•Correct. Your benefit year starts the week you file your initial claim, not when you became unemployed.

•This is so stupid. How are people supposed to know this?

•It's on the Washington ESD website but yeah, it's not super obvious. I learned the hard way too.

THE SYSTEM IS DESIGNED TO SCREW PEOPLE OVER! They don't advertise that you lose benefits if you don't apply immediately. It's all about saving the state money while people struggle.

•I mean, it makes sense though. How would they verify you were actually looking for work months ago?

•They could ask for job search records just like they do now. It's just another hoop to jump through.

I work at WorkSource and I tell everyone - file your claim THE WEEK you lose your job, even if you think you'll find something fast. You can always withdraw it if you find work quickly.

•Wish I had known this advice 5 months ago. Do you know if there are any exceptions to the no-retroactive-pay rule?
0 coins
Charity Cohan
•Very limited exceptions, usually only for things like being hospitalized or military deployment. Regular job search delays don't qualify.

•What about if someone was waiting for severance to run out?

•Severance might affect when benefits start anyway, so you'd still want to file and let Washington ESD determine eligibility.

Just go ahead and file now. I waited 6 weeks after losing my job and regretted every day of it. The application process takes time anyway so the sooner you start the better.

•How long did the whole process take for you?

•About 3 weeks from filing to getting my first payment. Had to do a phone interview about why I was laid off.

Check if your employer contested your unemployment too. Sometimes they fight claims even for layoffs, which can delay everything.

•How would I know if they contested it?

•Washington ESD will send you a notice if there's a dispute. You'd have to provide your side of the story.

The job market is rough right now so don't feel bad about needing unemployment. I've been looking since October and still nothing substantial.

•What field are you in? I'm in tech and it's been brutal.

•Marketing/communications. Everything wants 5+ years experience for 'entry level' positions.

•Same here in finance. The requirements are insane compared to what they're paying.

Make sure you have all your documentation ready when you apply. Pay stubs, termination letter, etc. It speeds up the process if they need to verify anything.

•I have most of that stuff. Do I need anything else specific?

•Your complete work history for the last 18 months with dates and gross wages. Washington ESD uses this to calculate your weekly benefit amount.

Don't forget you'll need to do job search activities once your claim is approved. Washington ESD requires 3 job search activities per week.

•What counts as a job search activity?

•Applying for jobs, networking events, career fairs, interviews, etc. Keep detailed records in case they audit you.

•They can audit your job search? How often does that happen?

Geoff Richards
•It's random but they do check. I got audited last year and had to provide 6 months of job search logs.

Another option if you can't get through online or by phone is to visit a WorkSource office in person. They can help you file your claim there.

•Good idea. I'll try that if the online system keeps crashing.

I used that Claimyr service mentioned earlier when I couldn't get through to Washington ESD about my adjudication issue. Definitely worth it if you're stuck in phone hell.

•How much does it cost?

•I'd rather not say the exact amount but it was worth it to actually talk to someone instead of listening to busy signals all day.

File your claim this week if you can. Don't wait any longer or you'll lose even more potential benefits. Every week you wait is money you can't get back.

•You're absolutely right. I'm going to try the website again first thing tomorrow morning.

Once you do get your claim filed, make sure to file your weekly claims every week even if it's still pending. Missing weekly claims can mess up your benefits later.

Katherine Shultz
•Thanks for the heads up. I'll make sure to do that.

Jacinda Yu
•Yeah, the weekly claims keep your claim active. Even if you're in adjudication, keep filing them.

Sorry you're going through this OP. The unemployment system is confusing and they don't make it clear that you lose benefits by waiting. Hope you get your claim processed quickly.
