How long do I have to file unemployment claim with Washington ESD?
I got laid off from my retail job two weeks ago and I'm wondering if I missed the window to file for unemployment benefits. I've been putting it off because I thought I might find something quickly but no luck so far. Does Washington ESD have a deadline for when you have to file after losing your job? I'm worried I waited too long and screwed myself over. Also nervous about the whole process since I've never done this before.

You haven't missed it! Washington ESD doesn't have a strict deadline but you should file ASAP. Your claim will be backdated to when you became unemployed, but there are some rules about how far back they'll go. Generally you can backdate up to one year but you'll need good cause for any significant delay.

•That's a relief! What counts as 'good cause' for the delay? I was just being lazy honestly.

•Being lazy probably won't cut it lol. Good cause is usually things like medical issues, lack of internet access, language barriers, stuff like that. But 2 weeks isn't a big deal at all.

File today if you can! The sooner you file, the sooner your weekly claim cycle starts. Even though they might backdate your claim, you still have to serve the waiting week and go through any adjudication if there are issues with your separation.

•What's adjudication? That sounds scary.

•It's just when Washington ESD needs to investigate something about your claim - like if your employer contests it or there's a question about why you were separated. Most claims don't go through it.

I was in the same boat last year - waited almost 3 weeks before filing because I was embarrassed. Washington ESD still approved everything and I got all my back pay. The key is just being honest about when you became unemployed when you file.

•Did you have any trouble reaching them when you had questions? I keep hearing the phones are impossible.

•Yeah the phone situation is brutal. I actually found this service called Claimyr that helps you get through to Washington ESD agents. Check out claimyr.com - they have a demo video at https://youtu.be/7DieNd3C7zQ that shows how it works. Saved me hours of calling.

Whatever you do, don't wait any longer! I waited 6 weeks thinking I'd find work and when I finally filed, Washington ESD only backdated me 4 weeks. Lost out on 2 weeks of benefits because I couldn't prove good cause for the delay.

•Oh no that's exactly what I was worried about! What did you tell them about the delay?

•I was honest and said I thought I'd find work quickly. They said that wasn't good cause and I should have filed immediately while looking for work.

•That's rough but 6 weeks is pretty different from 2 weeks. OP should be fine.

The real question is whether your employer is going to fight the claim. If they laid you off you should be good, but if there's any question about misconduct or voluntary quit, that's when things get complicated with adjudication.

•It was definitely a layoff due to slow business. They laid off 4 of us at the same time.

•Perfect, that should be straightforward then. Make sure you have your employer's info handy when you file - business name, address, your supervisor's name, dates of employment, etc.

•You're right, I'm overthinking this. Going to file tonight.

Pro tip: when you file, you'll need to start filing weekly claims right away even if your initial claim is still processing. Don't skip weeks thinking you'll file them later - it doesn't work that way.

•Good to know! How often do I have to file the weekly claims?

Grace Patel
•Every week on your designated day. Washington ESD will tell you what day when your claim is processed. Usually Sunday through Saturday but depends on your SSN.

•And you have to do job search activities every week too - minimum 3 job search contacts. Keep a log!

Since you mentioned being nervous about the process - the Washington ESD website has a pretty good tutorial for first-time filers. The application asks for basic info about your employment history, reason for separation, and some personal details. Takes maybe 30-45 minutes if you have all your info ready.

•That doesn't sound too bad. Do I need my pay stubs or anything like that?

Charlie Yang
•Not for the initial filing, but keep them handy. Sometimes Washington ESD will ask for wage verification later, especially if there are questions about your base period wages.

I'm dealing with something similar but I got fired instead of laid off. Been putting off filing for 3 weeks because I'm scared they'll deny me. Should I even bother?

Charlie Yang
•File anyway! Even if you were fired, you might still qualify depending on the circumstances. Worst case they deny you and you can appeal.

•Yeah don't assume you're disqualified. Washington ESD looks at whether it was misconduct vs just not being a good fit or performance issues.

•Thanks, that makes me feel better. I'll file this week.

Update for everyone asking about contacting Washington ESD - I tried that Claimyr thing someone mentioned earlier and it actually worked. Got through to an agent in about 20 minutes instead of calling all day. Worth checking out if you need to talk to someone.

•How much does it cost? I've been trying to reach them for weeks about my adjudication.

•I'd rather not post pricing publicly but it was reasonable for the time it saved me. Check their website for current rates.

EVERYONE SHOULD FILE IMMEDIATELY AFTER BECOMING UNEMPLOYED. This is like the #1 rule. You're not helping yourself by waiting and hoping for the best.

•Calm down lol but yeah you're right. I made the same mistake thinking I'd find something in a few days.

The system is so messed up anyway. I filed the day I got laid off and still waited 5 weeks for my first payment because of some random adjudication issue. At least if you file late you know what to expect lol

Olivia Martinez
•Ugh that's frustrating. What was the adjudication about?

•Something about my employer not responding to their separation notice. Took forever to resolve even though it was clearly their fault not mine.

For what it's worth, I've helped several friends file their claims and the 2-week delay is really not a big deal. Washington ESD is pretty reasonable about short delays, especially if you're upfront about when you became unemployed.

Olivia Martinez
•That's reassuring, thank you! I feel much better about this now.

Make sure you file for the correct week! When they ask when you became unemployed, use the first day you were actually unemployed, not when you found out you were getting laid off.

Olivia Martinez
•Good point. So if my last day of work was a Friday, I'd put Saturday as when I became unemployed?
0 coins
Sophie Hernandez
•Exactly! And if you got any final pay like vacation payout, make sure to report that too.

Final advice for OP: gather your employment info (employer details, dates, reason for separation), file tonight, start your weekly claims on schedule, and do your job searches. You'll be fine with the 2-week delay. Washington ESD deals with much worse timing issues every day.
