How long do you have to file for unemployment after being fired in Washington state?

I was terminated from my job last Thursday and I'm trying to figure out the deadline for filing my unemployment claim with Washington ESD. My former employer said something about needing to file within a certain timeframe but I can't remember exactly what they said. Does anyone know how much time I have before I lose my chance to get benefits? I'm worried I might have already waited too long since it's been almost a week.

You generally want to file as soon as possible after losing your job. There's no hard deadline like 'you must file within 7 days' but the sooner you file, the sooner your benefits can start. Washington ESD won't backdate your claim to before the week you actually filed, so every week you wait is potentially a week of benefits you're losing.

Oh no, so I've already lost a week of benefits? I should have filed right away.

0 coins

Not necessarily lost - your waiting week might cover that gap. But definitely file today if you can.

The actual rule is that you can file a claim up to one year after your separation date, but like the previous poster said, you won't get benefits for weeks before you file. So if you were fired last Thursday, you should file this week to make sure you don't miss any potential benefit weeks.

One year seems like a really long time - why would anyone wait that long?

0 coins

Most people don't wait, but sometimes people find other work quickly and then lose that job later, or they don't realize they might be eligible.

I had trouble getting through to Washington ESD when I needed to file my claim. Spent hours on hold and kept getting disconnected. Someone on here recommended Claimyr (claimyr.com) which helped me get through to an actual agent to sort out my claim issues. They have a video demo at https://youtu.be/7DieNd3C7zQ that shows how it works.

Is that a paid service? I'm already unemployed so I'm trying to avoid extra costs.

It's worth checking out their site for the details, but honestly getting through to ESD quickly was worth it for me when I was dealing with claim problems.

WAIT A WEEK?? I thought you had to file within 3 days or something! I've been putting it off because I thought I might find another job quickly but now I'm panicking that I've missed some deadline.

0 coins

No 3-day deadline, but don't put it off any longer. File today if possible.

Okay logging into the Washington ESD website right now, thanks for the reality check!

Just to add some context - even if you file late, you might still be eligible for benefits going forward. I know someone who didn't file for 3 weeks after being laid off and they still got approved, they just lost those 3 weeks of potential benefits.

0 coins

That makes me feel a bit better. I was worried I'd be completely disqualified.

The Washington ESD website actually has all this information clearly laid out, but I know it can be overwhelming when you're dealing with job loss. The key thing is that your benefit year starts the week you file, not the week you lost your job.

0 coins

I tried looking at the website but there's so much information I got confused.

0 coins

Yeah it's a lot to process when you're stressed. Focus on just getting the initial application submitted first.

One thing to keep in mind is that even after you file, there's usually a waiting week where you won't get paid. So if you were fired last Thursday, and you file this week, your first payable week would probably be next week assuming your claim gets approved without issues.

0 coins

So there's always a week delay even if you file right away?

0 coins

The waiting week is built into the system, yes. It's not really a delay, just how Washington unemployment works.

0 coins

I waited 2 weeks to file because I was embarrassed about being fired and hoped I'd find something else quick. Biggest mistake - lost 2 weeks of benefits that I really needed. Don't make the same mistake!

0 coins

I can relate to the embarrassment part. It's hard to admit you need help.

0 coins

Exactly, but unemployment insurance is something you've paid into through your paychecks. It's not charity.

Also worth mentioning that if you were fired 'for cause' you might face additional scrutiny during the adjudication process. But that doesn't change the filing timeline - you should still file as soon as possible and let Washington ESD determine your eligibility.

0 coins

What counts as 'for cause'? I was let go for performance issues.

0 coins

Performance issues don't automatically disqualify you. Usually has to be willful misconduct. File your claim and explain your side if they ask.

The one year thing is technically true but practically useless. I've never heard of anyone waiting months to file unless they had some really unusual circumstances. File within the first week or two max.

0 coins

Agreed, the one year rule is more for edge cases where people didn't know they were eligible.

Quick tip - when you do file, make sure you have all your employment information handy including your employer's address and your dates of employment. It'll make the process go faster.

0 coins

Good point, I should gather all that info before I start the application.

I used Claimyr when I couldn't get through to ESD about my claim status. Really helped when I was stuck in adjudication for weeks and couldn't get anyone on the phone to explain what was happening.

0 coins

How does that work exactly? Do they call for you?

0 coins

They help you get through to an actual ESD agent when the phone lines are jammed. Check out their demo video, it explains it better than I can.

Bottom line OP - stop worrying about deadlines and just file today. The system is designed to help people who lost their jobs, not to trip them up with impossible deadlines.

0 coins

You're right, I'm overthinking this. Going to file right now.

0 coins

washington esd is so slow anyway that filing a few days late probably won't make much difference in when you actually start receiving benefits lol

0 coins

That's not really true - filing late definitely costs you benefit weeks even if processing is slow.

0 coins

Make sure when you file that you're honest about the reason for separation. If your employer contests it, Washington ESD will investigate and they'll contact both of you for your sides of the story.

0 coins

What if my employer lies about why they fired me?

0 coins

That's why you need to document everything and be prepared to tell your side. ESD will make a determination based on all the evidence.

0 coins

OP any update? Did you get your claim filed? I'm rooting for you!

0 coins

Yes! Just submitted it about an hour ago. Thanks everyone for the push I needed.

0 coins

Awesome! Now the waiting game begins but at least you got it in.

0 coins

For anyone else reading this thread - the key takeaway is file ASAP after job loss. Don't wait, don't overthink it, just get that claim submitted.

0 coins

This should be pinned at the top of this forum honestly.

0 coins

Glad this worked out for OP. I've seen too many people wait weeks thinking they'll find another job quickly and then regret it when they don't.

0 coins

Same here. Pride costs money when you're unemployed.

0 coins

One more thing - after you file, don't forget you have to file weekly claims to actually receive benefits. The initial filing is just the first step.

0 coins

Good reminder! I'll make sure to stay on top of the weekly filings.

0 coins

Had to use Claimyr myself last month when I couldn't reach anyone at ESD about an issue with my job search requirements. Sometimes you just need to talk to a real person and the regular phone system doesn't cut it.

0 coins

The phone system is definitely the weak link in the whole process.
