Got terminated from my job - do I qualify for Washington ESD unemployment benefits?
I was let go from my warehouse job yesterday after 2 years. My supervisor said it was due to 'performance issues' but I think they were just looking to cut costs. I've never been fired before and I'm not sure if I can get unemployment benefits. Does getting fired automatically disqualify you from Washington ESD benefits? I really need the income while I look for another job.

It depends on WHY you were fired. If it was for misconduct (like stealing, fighting, or repeatedly violating company policy), then you'd be disqualified. But if it was performance-related or they said you weren't a good fit, you might still qualify. Washington ESD will investigate and make a determination.

•They said I wasn't meeting productivity targets but I was never written up or put on a performance improvement plan. Does that help my case?

•That could definitely help. Lack of formal warnings or documentation suggests it wasn't willful misconduct on your part.

You should definitely apply! I got fired from my retail job for being late too many times and still qualified because Washington ESD determined it wasn't 'misconduct' severe enough to disqualify me. The worst they can do is say no.

•That's encouraging. How long did it take for them to make a decision on your claim?

•About 3 weeks. They had to do an adjudication interview with me and my former employer.

•3 weeks?? That's crazy. I've been waiting for my adjudication for over a month now and can't get through to anyone at Washington ESD to check on it.

I had a similar situation last year and used Claimyr to actually reach a Washington ESD agent who could explain my options. The service connects you directly to an agent instead of dealing with busy signals all day. Check out claimyr.com - they have a video demo at https://youtu.be/7DieNd3C7zQ that shows exactly how it works.

•Is that legit? I've never heard of paying to call a government office.

•It's totally legitimate - they just automate the calling process so you don't have to sit on hold for hours. Worth it when you need answers quickly.

•I've been trying to reach Washington ESD for weeks about my claim. Might have to look into this if regular calling isn't working.

The key factors Washington ESD looks at are: 1) Was it willful misconduct? 2) Did you violate a known company policy? 3) Were you acting in the company's best interest? Performance issues usually don't rise to the level of disqualifying misconduct unless you were deliberately underperforming.

•This is really helpful. I was definitely trying my best, just couldn't keep up with their unrealistic quotas.

Lucas Parker
•Unrealistic quotas that suddenly changed without proper training? That sounds like they were setting you up to fail honestly.

ugh the whole system is so confusing! i got fired last month for attendance and still don't know if ill qualify. washington esd website doesn't make it clear at all

•Attendance issues can go either way depending on the circumstances. Were you missing work due to medical issues or transportation problems?

•mostly childcare fell through when my daycare closed unexpectedly. had to miss like 5 days in 2 weeks

•That might actually work in your favor since it was due to circumstances beyond your control. Definitely apply and explain the situation.

I've been dealing with Washington ESD for months now and the phone situation is absolutely ridiculous. You literally cannot get through during normal business hours. I finally used that Claimyr service someone mentioned and got connected to an actual person within 10 minutes. Game changer for getting real answers about your specific situation.

•That's exactly what I'm worried about - not being able to get through to ask questions about my specific case.

•Yeah don't waste your time with the regular number. The wait times are insane and they often just hang up on you anyway.

One thing to keep in mind - even if you do qualify, your former employer might appeal the decision. Mine did and it added another month to the process. But I eventually got all my back pay once it was resolved.

Ali Anderson
•Ugh I hope they don't appeal. I need the money now, not in 2 months.

Zadie Patel
•Most employers don't appeal unless it was a clear cut case of misconduct. If it was truly just performance, they probably won't bother.

•My old company appealed everything just to be jerks. Cost me 6 weeks of benefits while it got sorted out.

The Washington ESD will conduct what's called a 'separation interview' where they'll ask both you and your employer about the circumstances. Be honest but focus on the facts - you were trying your best, received no formal warnings, and the expectations may have been unreasonable.

•Should I get documentation from coworkers who can vouch that the quotas were impossible?

Lucas Parker
•That could be helpful if Washington ESD requests additional information, but don't worry about gathering it upfront. Focus on your own experience and performance first.

I'm in adjudication hell right now and seriously considering paying for one of those calling services. Has anyone tried alternatives to Claimyr or is that the main one people use?

•I've only used Claimyr but it worked great for me. Got through to someone who could actually look at my claim details.

•Same here - Claimyr was the only way I could get real answers instead of generic website info.

Whatever you do, apply ASAP! Even if you're not sure you qualify, you want to get your application in quickly. There's a waiting period anyway so the sooner you start the process the better. You can always appeal if they deny you initially.

•Good point. I'll file online tonight. Thanks everyone for the advice!

•Smart move. And don't stress too much - performance-based terminations usually qualify as long as you weren't being deliberately negligent.

been through this exact situation twice now and both times i qualified even though i was 'fired' for performance. washington esd really looks at whether you were acting in good faith and trying to do your job

Ali Anderson
•That's reassuring. I definitely was trying my hardest, just couldn't meet their unrealistic expectations.

Zadie Patel
•Exactly - good faith effort is a key factor in their determination process.

The whole misconduct standard in Washington is pretty high. You basically have to have done something deliberately harmful to the employer's interests. Poor performance, especially without warnings, usually doesn't meet that threshold.

•That makes me feel a lot better about my chances. I was never trying to hurt the company.

•Yeah they're looking for stuff like theft, harassment, showing up drunk, etc. Regular job performance issues are different.

Just want to add that even if Washington ESD approves your claim, make sure you're keeping up with your job search requirements and filing your weekly claims on time. Don't let administrative stuff trip you up after you get approved.

Ali Anderson
•Good reminder. What are the current job search requirements?
0 coins
Alfredo Lugo
•You need to make at least 3 job search contacts per week and keep a log. WorkSourceWA has good resources for tracking this.

i got fired for performance last year and it took forever to get approved because washington esd kept asking for more documentation. finally got someone on the phone through claimyr who explained exactly what they needed

Ali Anderson
•What kind of documentation did they want from you?

•stuff like my job description, any performance reviews i had, emails about expectations. basically anything showing i was trying to do the job right

The process can be frustrating but don't give up. I was denied initially because my employer claimed I was fired for misconduct, but I appealed and won. The hearing officer could see through their BS and I got all my benefits retroactively.

Ali Anderson
•How long did the appeal process take?

Kaitlyn Jenkins
•About 6 weeks from filing the appeal to getting the decision. But I got all the back pay I was owed.

just file and see what happens honestly. washington esd is so backed up right now that by the time they make a decision you'll probably have found another job anyway lol

•Hopefully! But I still need the income in the meantime.

•That's a terrible attitude. People need these benefits to survive while job hunting.

One last thing - make sure you file in the same week you were terminated. The waiting week starts from when you file, not when you lost your job. Don't delay if you think you might qualify.

Wishing you the best OP. Being fired sucks but at least Washington unemployment benefits exist to help people get back on their feet. The system isn't perfect but it's there when you need it.
