Got terminated from job - can I still collect Washington ESD unemployment benefits?

My manager let me go yesterday after 2 years at my warehouse job. They said it was due to 'performance issues' but honestly I think they just wanted to cut costs since they've been laying people off. I've never been fired before so I'm not sure if I can even apply for unemployment benefits through Washington ESD. Does getting terminated automatically disqualify you? I really need the income while I look for something new.

You can definitely apply for unemployment even if you were terminated. Washington ESD will look at whether you were fired for 'misconduct' or just regular performance/business reasons. If it was performance issues and not like stealing or breaking major rules, you'll probably qualify.

That's a relief to hear. They never wrote me up or anything formal, just said I wasn't meeting expectations.

0 coins

Yeah performance stuff usually isn't considered misconduct unless they can prove you were deliberately not doing your job.

0 coins

I got fired last year and still got my benefits. You just have to be honest on your application about what happened. Washington ESD will contact your employer to get their side too.

0 coins

How long did it take to hear back after you applied? I'm worried about the bills piling up.

0 coins

It took about 3 weeks but that was because they had to do an adjudication to review my termination. Most people hear back faster.

0 coins

Here's what you need to know - Washington ESD uses something called 'misconduct' to determine eligibility. Simple performance issues, attendance problems, or personality conflicts usually don't count as misconduct. Things like theft, violence, or willfully violating company policy do. Since you mentioned performance issues, you should be fine to collect UI benefits.

0 coins

Thanks for explaining that. I was definitely not stealing or anything like that, just struggled to keep up with their productivity requirements.

0 coins

The key is being honest on your application. Don't try to hide that you were fired - they'll find out anyway when they contact your employer.

I had such a hard time getting through to Washington ESD when I needed to discuss my termination case. Spent weeks calling every morning at 8am sharp and could never get through. Finally found this service called Claimyr (claimyr.com) that actually got me connected to an agent. They have a video demo showing how it works: https://youtu.be/7DieNd3C7zQ. Game changer for getting answers about eligibility questions.

0 coins

How does that work exactly? I'm dreading having to call if they need more info about my termination.

0 coins

It basically calls Washington ESD for you and gets you in the queue, then calls you back when an agent is available. Way better than sitting on hold for hours.

0 coins

That sounds too good to be true honestly. How much does something like that cost?

0 coins

Just apply ASAP. Even if you're not sure about eligibility, let Washington ESD make that determination. The worst they can do is say no, but you might be surprised and get approved.

0 coins

Good point. I was overthinking it when I should just go ahead and file the claim.

0 coins

Exactly. And if they do deny you initially, you can always appeal the decision if you think they got it wrong.

0 coins

Make sure you have all your employment info ready when you apply - dates of employment, reason for separation, your manager's contact info, etc. Washington ESD will want details about the termination.

0 coins

I should probably write down exactly what happened while it's still fresh in my memory.

0 coins

Smart thinking. They might ask specific questions about conversations with your supervisor or any warnings you received.

0 coins

And keep copies of any paperwork they gave you when they terminated you - separation letter, final paycheck stub, anything like that.

0 coins

THE SYSTEM IS RIGGED AGAINST WORKERS! They fire you for bogus reasons then make you jump through hoops to get benefits you paid into. Washington ESD should automatically approve anyone who gets laid off or fired for performance.

0 coins

I get the frustration but they do have to make sure people weren't fired for legitimate misconduct.

0 coins

Yeah well my cousin got fired for being 5 minutes late ONE TIME and they denied his benefits. System is broken.

0 coins

That doesn't sound right. One instance of being late isn't usually considered misconduct unless there were other issues too.

0 coins

I went through this same thing 6 months ago. Got fired from my retail job for not meeting sales goals. Washington ESD approved my claim after about 2 weeks. The key is being upfront about everything and not trying to make yourself look perfect.

0 coins

That gives me hope. Were you able to find another job pretty quickly?

0 coins

It took about 3 months but I did find something better. The unemployment benefits really helped me stay afloat during the search.

0 coins

Quick question - do you have to wait a certain amount of time after getting fired to apply for unemployment? Or can you file right away?

0 coins

You can file right away. In fact, you should file as soon as possible since there's usually a waiting period before benefits start.

0 coins

Good to know, thanks!

0 coins

Been there buddy. Getting fired sucks but unemployment benefits exist for exactly this situation. Don't let pride stop you from applying - you paid into the system through your paychecks.

0 coins

Yeah you're right. I did pay into it so I shouldn't feel bad about using it when I need it.

0 coins

Exactly. That's what it's there for. Good luck with your application!

0 coins

Wait I'm confused about something. If you get fired can you still do work search activities? Like what if employers ask why you left your last job?

0 coins

You still have to do job searches while on unemployment, yes. As for explaining to employers, just be honest but focus on what you learned and how you've improved.

0 coins

That makes sense. I was worried it would make finding a new job impossible.

0 coins

Lots of people get fired and find new jobs. Don't let it define you, just learn from the experience and move forward.

0 coins

I used that Claimyr thing someone mentioned earlier when I couldn't get through to Washington ESD about my claim. Worked great - finally got to talk to someone after weeks of trying on my own. Definitely worth it if you need to speak with an agent about your eligibility.

0 coins

I might need to try that if my application runs into any issues. Good to have options.

0 coins

Yeah it's nice not having to stress about getting through the phone lines. They handle all that for you.

0 coins

One thing to watch out for - if your employer contests your claim, it might take longer to get approved. They'll do an investigation and you might have to provide more documentation.

0 coins

How likely is it that they'll contest it? I left on decent terms even though I was terminated.

0 coins

Hard to say. Some employers always contest, others never do. Just be prepared for the possibility.

0 coins

Even if they contest it, you can still win if the termination wasn't for misconduct. Don't worry too much about it.

0 coins

Make sure you understand the difference between being fired and being laid off when you're filling out the application. The terminology matters to Washington ESD.

0 coins

What's the difference exactly? I thought they were basically the same thing.

0 coins

Laid off usually means it's due to business reasons - budget cuts, downsizing, etc. Fired typically means it's due to your performance or conduct. Both can qualify for unemployment but for different reasons.

0 coins

Got fired from my warehouse job too last year. Performance issues just like you. Washington ESD approved my claim no problem. The adjudication process was scary but turned out fine.

0 coins

What was the adjudication process like? I keep seeing that term mentioned.

0 coins

They basically investigate the circumstances of your termination. They'll call you and your employer to get both sides of the story. Just be honest and you'll be fine.

0 coins

File your claim TODAY. Seriously, don't wait. Benefits are backdated to when you first became unemployed but only if you file within a reasonable timeframe.

0 coins

I'm going to do it right after I finish reading all these comments. Thanks everyone for the encouragement!

0 coins

Good plan. And remember, you can always ask questions later if you run into issues during the process.

0 coins

I tried using that Claimyr service when I was having trouble reaching Washington ESD about my terminated claim status. Honestly was skeptical at first but it actually worked. Got connected to an agent within a couple hours instead of spending days trying to call.

0 coins

That's the third person mentioning it so it must actually work. I'll keep it in mind if I need help.

0 coins

Yeah, wish I had known about it sooner. Would have saved me so much stress trying to get through on my own.

0 coins

Just remember that even if you qualify for unemployment, you still need to actively look for work and report your job search activities. Washington ESD takes that requirement seriously.

0 coins

How many jobs do you have to apply for each week?

0 coins

I think it's 3 job search activities per week but check the current requirements when you file your claim.

0 coins

And keep good records of your job search activities. They can audit you at any time and ask for proof.

0 coins

Best of luck OP! Getting fired is never fun but at least unemployment benefits can help bridge the gap while you find something better. The system isn't perfect but it does work for situations like yours.

0 coins

Thanks for all the support everyone. Feeling much more confident about applying now. Will update once I hear back from Washington ESD!

Please do update us! Always good to hear success stories to help the next person in your situation.
