Do you qualify for Washington ESD unemployment if you get fired from your job?
Just got let go from my warehouse job yesterday after 2 years. My supervisor said it was due to 'performance issues' but honestly I think they just wanted to cut costs. I've never filed for unemployment before and have no idea if I even qualify since I was technically fired. Can you still get Washington ESD benefits if you were terminated? I'm freaking out because I have rent due in two weeks and no savings.

Yes, you can still qualify for unemployment benefits even if you were fired, but it depends on the reason. Washington ESD will look at whether you were terminated for 'misconduct' or not. Performance issues usually don't count as misconduct unless you were willfully negligent or violated clear company policies.

•That's a relief! They never wrote me up or anything, just said my productivity wasn't where they wanted it. Does that help my case?

•That definitely helps. If there was no progressive discipline or documented violations, it sounds more like a business decision than misconduct.

I got fired last year for being late too many times and still got approved for UI benefits. Washington ESD said it wasn't misconduct because I had a legitimate transportation issue.

•Good to know! How long did it take for your claim to get processed?

•About 3 weeks but that was before they got really backed up with claims.

File your claim immediately! Don't wait. Even if you're not sure you qualify, it's better to start the process now. You can always appeal if they deny you initially.

•Should I file online or call them? I heard the phone lines are impossible to get through.

•Definitely file online first at esd.wa.gov. Only call if you run into issues during the application process.

Ugh the Washington ESD phone system is absolutely horrible. I've been trying to get through for weeks about my adjudication issue. If you need to talk to someone, check out claimyr.com - they have this automated calling service that actually gets you through to an agent. There's a demo video at https://youtu.be/7DieNd3C7zQ that shows how it works.

•Thanks for the tip! I'll keep that in mind if I run into problems.

•I used Claimyr too when my claim got stuck. Way better than sitting on hold for hours.

The key thing is being honest on your application about why you were terminated. Don't try to hide it because they'll find out anyway when they contact your employer.

•Will my employer try to fight my claim?

•They might, especially if they think it will affect their unemployment tax rate. But if you were let go for performance and not misconduct, you should be fine.

wait so even if you get fired you can still get unemployment?? i thought that disqualified you automatically

•Nope, common misconception. You can get fired and still collect benefits as long as it wasn't for misconduct.

I'm going through something similar right now. Got terminated for 'attendance issues' but I was dealing with a family emergency. Filed my claim 2 weeks ago and it's still in adjudication.

•How long are they saying adjudication will take?

•No timeline given. Just says they're reviewing my case and will contact me if they need more info.

•That's exactly when Claimyr helped me - when I was stuck in adjudication limbo. Got through to an agent who could actually check my case status.

Just remember you'll need to start doing your weekly claims even while your initial claim is being reviewed. Don't skip those or you'll lose benefits for those weeks.

•What exactly do I need to do for weekly claims?

Rachel Tao
•Report any work you did that week, any income, and confirm you're able and available for work. It's pretty straightforward.

The whole system is so confusing. I got fired 3 months ago for supposedly violating company policy but I never signed any policy documents. Still fighting my denial.

•Did you file an appeal? You have the right to contest their decision.

Seraphina Delan
•Yeah, appeal hearing is next month. Hoping it goes better than the initial review.

Performance terminations are usually not considered misconduct in Washington. I work in HR and we rarely contest those types of unemployment claims.

•That's reassuring coming from someone who actually deals with this stuff professionally.

•Yeah, misconduct has a pretty high bar. Has to be willful or deliberate violation of company rules.

just file already and see what happens! worst case they say no and you appeal

•You're right, I'm overthinking this. Going to file tonight.

I got fired for 'poor attitude' last year and Washington ESD approved my claim. Employer tried to fight it but couldn't prove I actually did anything wrong.

•How long did the whole process take with the employer fighting it?

•About 6 weeks total but I got back pay for all the weeks I was eligible.

Make sure you have all your employment dates and wage info ready when you file. You'll need your last employer's name, address, and dates of employment.

•Good point, I should gather all that stuff before I start the application.

Another vote for Claimyr if you need to actually talk to someone at Washington ESD. Their regular phone system is a nightmare but that service got me through in like 20 minutes.

The system is so broken. I've been trying to get my claim processed for a month. They keep asking for more documentation but won't tell me exactly what they need.

•That's frustrating! Have you tried calling them?

•TRYING is the key word. Can never get through.

Don't listen to people saying you can't get benefits if you're fired. That's old information. File your claim and let Washington ESD make the determination.

I was terminated for 'restructuring' which was really just them getting rid of people to save money. Got approved immediately.

•Sounds similar to my situation. They said performance but I think it was really about cutting costs.

File online, be honest about everything, and don't stress too much. The majority of people who apply get approved, even those who were terminated.
