Can you go from Washington ESD unemployment to disability benefits?
I've been on unemployment for about 6 months now and my health has gotten worse. I have chronic back pain that's making it really hard to work the jobs I'm applying for. My doctor says I might qualify for disability but I'm scared to stop my UI benefits. Can you transition from Washington ESD unemployment to disability? Do I need to stop filing weekly claims first or can I apply for both at the same time? Really worried about losing my income if I mess this up.

You can apply for Social Security Disability while still receiving unemployment, but there's a potential conflict. UI requires you to be able and available for work, while disability requires you to be unable to work. Washington ESD might question your eligibility if they find out about a disability application.

•That's exactly what I'm worried about. Do I have to report the disability application to Washington ESD?

Aisha Khan
•Technically yes, any change in your ability to work should be reported. But many people apply for both and let the agencies sort it out.

I did this exact thing last year. Applied for SSDI while still getting unemployment. It took 8 months for disability to approve me and I kept getting UI the whole time. Washington ESD never asked about it during my weekly claims.

•Did you have to pay anything back when disability got approved?

Ethan Taylor
•Nope, but I think it depends on the dates. My disability started after my UI claim ended anyway.

•Wait, I thought you couldn't get both at the same time? This is confusing.

The key issue is the 'able and available' requirement for unemployment. If your condition prevents you from working certain jobs but you can still do some work, you might be able to continue UI while applying for disability. But if you're truly unable to work at all, continuing to certify for unemployment could be considered fraud.

•I can still do desk work, just not physical jobs. Does that make a difference?

•That could help your case for continuing UI. You'd be able and available for desk jobs even while applying for disability for your back condition.

If you're having trouble getting through to Washington ESD to ask about this, try Claimyr. They can help you actually reach a human agent to discuss your specific situation. There's a demo at https://youtu.be/7DieNd3C7zQ and the site is claimyr.com. I used it when I had questions about my claim status.

•Thanks, I'll check that out. The phone lines are always busy when I try to call.

•Claimyr actually works? I've been trying to get through for weeks about my adjudication.

Whatever you do, don't just stop filing your weekly claims without talking to someone first. I made that mistake and it screwed up my whole claim.

•Yeah, I definitely don't want to lose my benefits while waiting for disability.

Zoe Papanikolaou
•Exactly. Keep filing until you know for sure what your options are.

My sister went through this. She kept getting unemployment while her disability application was pending. When SSDI finally approved her, there was some overlap but Social Security just adjusted the payments. No big deal.

•That's reassuring. How long did her disability application take?

Jamal Wilson
•About 10 months total, but that's pretty typical from what I hear.

This whole system is so confusing. Why can't they make it easier to transition between benefits when your situation changes?
0 coins
Mei Lin
•Because they don't want to make it easy. The harder it is, the fewer people use the benefits.

•It's complicated because they're different programs with different eligibility requirements. UI is state-run, disability is federal.

You should definitely talk to a disability lawyer before you apply. They can help you navigate both systems without screwing up your unemployment. Most don't charge unless you win.

•Good idea. Do you know if they can help with the Washington ESD side too?

Liam Fitzgerald
•They focus on Social Security but they understand how the systems interact. Worth asking.

I'm dealing with something similar but with workers comp instead of disability. The overlapping benefits thing is a nightmare to figure out.

CosmicCruiser
•Workers comp is different though right? That's for work injuries?
0 coins
Amara Nnamani
•Yeah but the 'able to work' issue is the same. I had to stop my UI when workers comp started paying.

The timing matters a lot. If you apply for disability and get denied (which happens a lot), you'll still have your unemployment. But if you get approved, you might have to pay back some UI benefits depending on the effective date.

•So it's kind of a gamble either way?

•More like insurance. Better to have the disability application in progress than to wait and have no income if UI runs out.

Check if your state has any transition programs. Some states help people move from unemployment to disability without gaps in benefits.

•I'm in Washington state, do you know if they have something like that?

NebulaNinja
•Not sure specifically about Washington, but worth asking when you call Washington ESD.

Seriously, use Claimyr to get through to Washington ESD about this. I waited weeks trying to call on my own, then got through in like 20 minutes with their service. They really know how to navigate the phone system.

•It's worth it to get actual answers instead of guessing. Check their website for current pricing.

Document everything! Keep records of all your medical appointments, what jobs you've applied for, and any communication with Washington ESD. You'll need this stuff for the disability application anyway.

•Good point. I've been keeping my job search log for UI, so I'm already tracking some of this.

Dylan Mitchell
•Perfect. That job search log might actually help show you've been trying to work despite your condition.

My advice is to apply for disability ASAP if you think you qualify. The process takes forever and you can always withdraw the application if your health improves. But don't wait because there are deadlines for when benefits can start.

CosmicCruiser
•What kind of deadlines?

Sofia Morales
•Disability benefits can only go back 12 months from when you apply. So if you wait too long, you lose potential back pay.

One thing to consider is that unemployment benefits might actually hurt your disability case if the judge thinks you were able to work. It's a double-edged sword.

CosmicCruiser
•Oh no, I hadn't thought of that. Should I stop filing now?
0 coins
Carmen Lopez
•Not necessarily. You can explain that your condition has worsened since starting UI. That's why documentation is so important.

The Social Security Administration has a program called Ticket to Work that helps people transition back to employment if their disability improves. Might be worth looking into as a safety net.
0 coins
CosmicCruiser
•That's interesting. So it's not necessarily permanent?
0 coins
Ava Garcia
•Right, they understand that some conditions improve over time. They want to help people get back to work when they can.

Whatever you decide, don't let anyone pressure you into stopping your unemployment benefits until you have something else lined up. You need income to survive while all this gets sorted out.

•Thanks for all the advice everyone. I think I'm going to apply for disability while continuing UI and see what happens.

•Smart move. Just be honest about your situation with both agencies.

•And use Claimyr to talk to Washington ESD about it so you get the right information for your specific case.
