Can you receive unemployment and disability benefits at the same time in Washington?
I'm really confused about this and getting different answers everywhere. I've been receiving Washington ESD unemployment benefits for about 6 weeks now, but my back injury from my last job has gotten worse and my doctor says I might qualify for disability. Can I collect both unemployment and disability at the same time? I'm worried if I apply for disability they'll stop my UI payments, but I really need both right now since disability takes forever to get approved. Has anyone been through this situation?

This is actually more complicated than most people think. For Washington ESD unemployment, you have to certify that you're able and available for work each week. But for disability, you're essentially saying you can't work. These two requirements directly contradict each other in most cases.

•So I can't get both? That seems unfair since disability takes months to get approved and I need income now.

•There might be some exceptions for partial disability or if you're appealing a disability denial, but generally no, you can't collect both simultaneously.

i think you can get both but not sure... my cousin was getting unemployment and then applied for disability but had to stop the unemployment when disability got approved

•That's not quite right. You usually have to stop unemployment when you APPLY for disability, not when it gets approved, because of the able and available requirement.

•oh ok i wasn't sure about the timing

I went through this exact situation last year. Washington ESD will ask you during your weekly claim if anything has changed regarding your ability to work. If you're applying for disability, you need to report that because it affects your eligibility. I had to choose between continuing UI or applying for disability - couldn't do both.

•What did you end up choosing? I'm so stressed about making the wrong decision.

•I continued with unemployment since it was guaranteed income while disability was uncertain. But everyone's situation is different.

•Did you ever have trouble reaching Washington ESD to ask about this? I've been trying to call for days to get clarification on my specific situation but can never get through.

Actually, I found a service called Claimyr that helped me get through to Washington ESD when I had questions about this same issue. You can check it out at claimyr.com - they have a video demo at https://youtu.be/7DieNd3C7zQ that shows how it works. Basically they call Washington ESD for you and get you connected to an actual person instead of spending hours on hold.

•Is this legit? I'm desperate to talk to someone at Washington ESD about my specific situation.

•Yeah it's real. I was skeptical too but it actually worked. Much better than trying to call yourself and getting hung up on constantly.

•How much does something like that cost? I'm already strapped for cash.

Let me clarify the technical aspects here. Washington state follows federal guidelines where you generally cannot receive unemployment and disability simultaneously because: 1) UI requires you to be able and available for full-time work, 2) Disability benefits are for people unable to work due to medical conditions. However, there are rare exceptions like if you're only partially disabled or appealing a disability denial.

•What if my disability is temporary? Like if I might be able to work again in a few months?
0 coins
Sasha Reese
•Temporary disability might be different, but you'd still need to meet the able and available requirement for UI. You should definitely talk to Washington ESD directly about your specific medical situation.

THIS IS SO FRUSTRATING! I've been calling Washington ESD for THREE WEEKS about this exact question and either get disconnected or told to call back later. The system is completely broken. How are we supposed to make important decisions about our benefits when we can't even talk to anyone?

•That's exactly why I mentioned Claimyr earlier. The regular Washington ESD phone system is impossible to get through to, but services like that actually work.

•I'm getting desperate enough to try anything at this point. The uncertainty is killing me.

•I feel your pain. I spent literally 8 hours one day trying to get through to someone at Washington ESD.

My brother went through this and had to stop his unemployment when he applied for Social Security disability. But that was federal disability - I'm not sure if state disability is different?
0 coins
Sasha Reese
•Washington state doesn't have its own disability program like some states do. Most disability here is through Social Security, which definitely conflicts with UI eligibility.

Sadie Benitez
•That makes sense. Yeah he had to choose one or the other.

Update: I tried that Claimyr service someone mentioned and actually got through to a Washington ESD representative! They confirmed that I cannot collect both unemployment and disability simultaneously. The rep explained that even applying for disability could affect my UI eligibility because it contradicts the able and available requirement. Thanks for the recommendation!

•Glad it worked for you! It's such a relief to actually talk to a real person instead of guessing about these important decisions.

•How long did it take for them to connect you? I might try this too.

•Way faster than trying to call myself. I think it was like 20 minutes total instead of the hours I was spending before.

so what are you going to do now? stick with unemployment or apply for disability?
0 coins
Christian Burns
•I'm going to continue with unemployment for now since it's guaranteed income. My doctor says my back might improve with physical therapy, so hopefully I won't need disability long-term.

Sasha Reese
•That sounds like a reasonable approach. You can always apply for disability later if your condition doesn't improve.

I work at a disability advocacy office and this comes up ALL the time. The key thing people don't understand is that unemployment and disability have fundamentally opposite eligibility requirements. You literally cannot meet both sets of criteria simultaneously in Washington state.

Christian Burns
•That's what the Washington ESD rep told me too. It seems obvious now but I was really hoping there was some way to get both.

Abby Marshall
•What about people who are partially disabled? Like they can work some jobs but not others?
0 coins
Drew Hathaway
•Even with partial disability, you'd need to prove you're actively seeking and able to perform suitable work for UI eligibility. It's very difficult to meet both requirements.

Does anyone know if there are other programs that might help bridge the gap? Like if you have to give up unemployment to apply for disability, is there anything to help with income during the waiting period?

Drew Hathaway
•There might be state assistance programs or food benefits you could qualify for. I'd recommend contacting DSHS to see what's available during the disability application process.

Sasha Reese
•Some people also look into temporary assistance programs through the state while waiting for disability approval.

This whole system is set up to screw people over. You get hurt at work, can't work anymore, but then they make you choose between benefits that don't even cover basic living expenses. Meanwhile disability takes MONTHS to get approved and most people get denied the first time anyway.

Diez Ellis
•I understand the frustration but the rules exist for a reason. UI is for people temporarily out of work who are looking for jobs. Disability is for people who can't work due to medical conditions.
0 coins
Isabel Vega
•Yeah but what about the gap period? People still need to eat and pay rent while waiting for disability approval.
0 coins
Drew Hathaway
•That's why it's important to explore all available assistance programs, not just UI and disability.

I'm dealing with a similar situation but with worker's compensation instead of disability. Does anyone know if you can get unemployment while receiving workers comp?
0 coins
Sasha Reese
•Workers comp is different from disability but similar rules apply. If you're receiving workers comp, you're typically not considered available for work, which would disqualify you from UI.

Abby Marshall
•Ugh, another impossible situation. Thanks for the info though.

Just want to add that if anyone is in this situation, document EVERYTHING. Keep records of all your medical appointments, communications with Washington ESD, disability applications, etc. Whether you choose UI or disability, you'll need that paperwork.

•Good advice! I've been keeping copies of everything just in case.

•Absolutely. Documentation is crucial for any benefit application or appeal process.

Update: I finally got through to Washington ESD using that Claimyr thing too. The representative was actually really helpful and patient with all my questions. Turns out my situation might be different because I'm not permanently disabled, just temporarily unable to do my previous job. Still working through the details but at least I have accurate information now.

•That's great! Having accurate information makes such a difference when you're making these important decisions.

For anyone reading this thread later, here's the bottom line: In Washington state, you generally cannot receive unemployment and disability benefits simultaneously because UI requires you to be able and available for work while disability benefits are for people unable to work. There may be rare exceptions, but you need to talk to Washington ESD directly about your specific situation.

Sasha Reese
•Perfect summary. And don't try to collect both without reporting it - that could be considered fraud.

Christian Burns
•Yeah, definitely be honest about everything. It's not worth the risk.

I'm a former Washington ESD employee and can confirm everything that's been said here. The able and available requirement is strictly enforced. Even if you're only partially disabled, you'd need to prove you can still perform suitable work to maintain UI eligibility.

Vanessa Figueroa
•Thanks for the official confirmation! It's helpful to hear from someone who actually worked there.
0 coins
Isabel Vega
•Did you ever see cases where people successfully got both? Or is it really impossible?
0 coins
Louisa Ramirez
•In my 8 years there, I never saw a case where someone legitimately qualified for both simultaneously. The eligibility requirements are fundamentally incompatible.

This has been really helpful to read through. I'm not in this situation yet but my health has been declining and I wanted to understand my options before I potentially need to make this choice. Sounds like the key is to talk to Washington ESD directly about your specific circumstances.

•Definitely get professional advice for your specific situation. Every case is a little different.

•And if you can't get through to Washington ESD the normal way, that Claimyr service really does work for getting connected to someone who can give you accurate information.

One thing I haven't seen mentioned - if you do apply for disability and get denied (which happens a lot), does that affect your ability to go back to collecting unemployment? Like if you were getting UI, stopped to apply for disability, got denied, could you restart your UI claim?
0 coins
Sasha Reese
•That's a good question and would depend on how much time passed and whether you're still within your benefit year. You'd definitely need to talk to Washington ESD about restarting a claim after a disability denial.
0 coins
Louisa Ramirez
•In cases like that, we would typically look at whether the person was still able and available for work and how long they had been out of the job search process.

Thanks everyone for all this information. As someone who might be facing this choice soon, it's really helpful to understand that these are mutually exclusive benefits in Washington state. Better to know now than find out the hard way later.

•Smart to research ahead of time. Too many people find out about these rules when they're already in crisis mode.

I've been following this thread and wanted to add some perspective as someone who works in benefits counseling. The frustration here is totally understandable - the system really does put people in impossible positions. One thing that might help is looking into local disability advocacy organizations or legal aid clinics. Many offer free consultations to help people understand their options and navigate the application process. They can also help you understand if there are any other safety net programs you might qualify for during gaps in coverage. The Washington State Department of Social and Health Services (DSHS) also has caseworkers who can do benefits planning - they can walk you through all available programs and help you strategize the best approach for your specific situation.
