Can you file for disability while on unemployment in Washington?
I've been getting unemployment benefits for about 2 months now after being laid off from my warehouse job. Recently my back problems have gotten much worse and my doctor is saying I might need to apply for disability. Can I file for Social Security disability while still collecting unemployment from Washington ESD? I'm worried about losing my UI benefits or getting in trouble for applying for both. Has anyone been in this situation before?

This is actually a really common question. You CAN apply for disability while on unemployment, but there are some important things to know. The main issue is that unemployment requires you to be able and available for work, while disability claims you can't work. Washington ESD doesn't automatically disqualify you for applying for disability, but they may investigate if there's a conflict.

•So I won't automatically lose my unemployment benefits just for applying? That's a relief. I'm just worried about my financial situation getting worse.

•The key thing is being honest about your situation. If your condition is getting worse over time, that's different than claiming you were never able to work.

I went through this exact situation last year. Applied for SSDI while collecting UI benefits. The trick is documenting that your condition worsened after you filed for unemployment. Keep all your medical records and be prepared to explain the timeline to both agencies.

•Did Washington ESD give you any trouble about it? I'm scared they'll think I was lying about being able to work.

•They did ask questions but since I had documentation showing my condition got worse, it wasn't a problem. Just be honest and keep good records.

Word of warning - getting through to Washington ESD to discuss this situation can be really frustrating. I spent weeks trying to get someone on the phone to ask about my specific case. If you need to talk to someone urgently about how this affects your claim, I found this service called Claimyr that actually got me through to an agent. Check out claimyr.com - they have a video demo at https://youtu.be/7DieNd3C7zQ that shows how it works.

•How much does something like that cost? I'm already struggling financially.

•It's worth checking out their site for details. For me, the peace of mind was worth it because I needed answers about my specific situation.

wait this doesnt make sense... if you can work you get unemployment, if you cant work you get disability. how can you get both?? seems like fraud to me

•It's not fraud if your condition changes over time. Someone can be able to work when they file for unemployment, then develop or worsen a condition that makes them unable to work.

•Yeah exactly, medical conditions can deteriorate. It's not like you choose to become disabled.

The biggest thing is timing and documentation. If you're applying for disability because your condition got worse AFTER you started getting unemployment, that's legitimate. But if you were already disabled when you filed for UI, that could be a problem.

•My back issues existed before but weren't bad enough to prevent me from working. Now they're much worse. I have all my medical records showing the progression.

•That sounds like a solid case then. Progressive conditions are exactly the kind of situation where this makes sense.

This happened to my neighbor. She was getting unemployment after her retail job ended, then her diabetes got really bad and she couldn't work anymore. She applied for disability while still on UI and everything worked out fine. The key was being upfront with both agencies about her situation.

•That's encouraging to hear. Did she have to pay anything back to Washington ESD?

Payton Black
•Nope, no issues at all. She just had to stop certifying for unemployment once she was approved for disability.

I'm dealing with this right now too. Filed for SSDI three months ago while on unemployment. Haven't heard anything back from Social Security yet but Washington ESD hasn't said anything about it either. The waiting is the worst part.

•How long have you been on unemployment? I'm hoping my back gets better but it's been getting worse for weeks now.

•About 5 months now. My condition is degenerative so it's only going to get worse unfortunately.

Make sure you keep doing your job search activities while you're still on unemployment. Even if you're applying for disability, you still have to meet the work search requirements until your UI claim ends.

•Good point. I've been keeping up with my job search log but it's getting harder to find jobs I could actually do with my back problems.

•You might want to focus on desk jobs or remote work if possible. That way you're still legitimately looking for work you could do.

The Washington ESD people are going to want to know about any changes in your ability to work. If your doctor says you're disabled, you should probably report that to them when you file your weekly claim.

•My doctor hasn't officially said I'm disabled yet, just that I should consider applying. Would I report that or wait until it's official?

•I'd wait until you have something official. But definitely report it once you do.

Social Security disability takes FOREVER to get approved. I've been waiting 8 months and still nothing. At least unemployment gives you something while you wait.

•That's what I'm worried about. I can't afford to lose my UI benefits while waiting for disability to get approved.

•You usually don't lose UI benefits just for applying for disability. It's when you're actually approved that things change.

I tried calling Washington ESD about this same question and spent literally 3 hours on hold before giving up. Ended up using that Claimyr service someone mentioned earlier and got through to an agent in like 10 minutes. They explained my whole situation and what I needed to know about applying for both benefits.

•That's exactly what I need - to talk to someone who knows the rules. I'll check out that Claimyr thing.

•I used them too when I had questions about my standby claim. Really helpful and way better than trying to get through the regular phone lines.

Just make sure you're honest with both agencies. Don't try to hide anything because they do communicate with each other sometimes. Better to be upfront about your situation from the start.

•Definitely planning to be completely honest. I just want to make sure I don't accidentally violate any rules.

•Honesty is always the best policy with government benefits. They hate it when people try to hide things.

One more thing - if you do get approved for disability, you might have to pay back some of your unemployment benefits depending on the dates. Social Security back pay can overlap with UI benefits.

Drew Hathaway
•Oh great, another thing to worry about. Do you know how they calculate that?

Khalid Howes
•It depends on your disability onset date versus when you were getting unemployment. It's complicated but they'll figure it out if you get approved.

My advice is to apply for disability as soon as possible if your doctor thinks you should. The process takes so long that the sooner you start, the better. You can figure out the unemployment stuff as you go.

•You're right. I keep putting it off but my back isn't getting any better. Time to bite the bullet and apply.

•Good luck! It's a stressful process but you'll get through it. Just take it one step at a time.

Make sure you get copies of all your medical records before you apply. Social Security will want everything and it's easier if you have it organized ahead of time.

•Good tip. I'll start gathering everything this week. Thanks for all the advice everyone!
