Can I apply for SSDI while collecting Washington ESD unemployment benefits?
I'm currently receiving unemployment benefits through Washington ESD and my health condition has gotten worse. My doctor thinks I should apply for Social Security Disability Insurance (SSDI) but I'm worried about what happens to my unemployment payments. Can I apply for both at the same time? Will Washington ESD cut off my benefits if they find out I filed for disability? I really need the income right now while waiting for SSDI to process.

This is a tricky situation because there's a potential conflict between the two programs. For unemployment, you have to certify that you're able and available to work. For SSDI, you're claiming you can't work due to disability. However, you can technically apply for both - just be aware that if SSDI approves you, they'll want to know about any unemployment benefits you received during the same period.

•So I won't automatically lose my unemployment if I apply for SSDI? That's a relief. Do I need to tell Washington ESD that I'm applying?

•You don't have to proactively tell Washington ESD, but if they ask during your weekly claim certification, you should be honest. The key is that you can still be looking for work even if you're also exploring disability options.

I went through this exact situation last year. Applied for SSDI in March while collecting unemployment. Washington ESD never asked me about it directly, and I continued getting benefits for 6 months until I found a part-time job. SSDI is still pending - they take forever to process claims.

•Did you have any issues with your weekly claims? I'm worried about the able and available requirement.

•I was still looking for work that I could do despite my condition, so I could honestly answer yes to being able and available. The key is being realistic about what type of work you can handle.

You might want to talk to someone at Washington ESD about this. I've been trying to call them for weeks about a different issue but can never get through. The phone lines are always busy or I get disconnected after waiting for hours.

•I had the same problem until I found Claimyr - it's a service that calls Washington ESD for you and gets you connected to an actual person. Check out claimyr.com and they have a video demo at https://youtu.be/7DieNd3C7zQ. Saved me so much time and frustration.

•Never heard of that but I'm desperate at this point. Does it actually work?

•Yeah it worked for me. They handle all the calling and waiting, then connect you when they get an agent. Much better than spending hours on hold yourself.

BE CAREFUL! This is fraud waiting to happen. You can't be disabled and available for work at the same time. Pick one or the other.

•That's not necessarily true. Many people have partial disabilities or conditions that are getting worse over time. You can be looking for suitable work while also exploring disability options.

•I guess but it seems like playing with fire to me. Washington ESD doesn't mess around with overpayments.

The timing matters a lot here. If SSDI approves you retroactively to a date when you were collecting unemployment, they'll consider that an overpayment situation. You might have to pay back some of the unemployment benefits.

•How do I avoid that? Should I stop filing for unemployment now just in case?

•Don't stop filing unless you're truly unable to work. If you're still able to do some type of work and actively looking, you're entitled to unemployment benefits. The overpayment issue only happens if there's an overlap where you're found disabled for the same period you claimed unemployment.

I'm dealing with something similar but my condition is mental health related. Anyone know if that makes a difference for Washington ESD?

•Mental health conditions are treated the same way as physical disabilities for both programs. The key is still whether you can perform some type of work.

•Thanks, that helps. I'm able to work some days but not others, so I think I can still honestly say I'm available for work.

One thing to keep in mind - SSDI has a 5 month waiting period even if you're approved, so you'll need some income during that time anyway. Unemployment might be your only option.

•I didn't know about the waiting period. That definitely makes me feel better about continuing to file my weekly claims.

My sister went through this and had to pay back like $8000 in unemployment when SSDI was approved retroactively. Just be prepared for that possibility.

•That's terrifying. Was she able to work out a payment plan?

•Yeah Washington ESD worked with her on a payment plan, but it was still a huge stress. The whole system is confusing.

You should definitely consult with a disability attorney before applying for SSDI. Many offer free consultations and can help you navigate both programs.

•Good idea. Do you know if they charge upfront fees?

•Most disability attorneys work on contingency - they only get paid if you win your case. Usually 25% of back pay up to a maximum amount.

whatever you do dont lie on your weekly claims about being able to work if you really cant. washington esd will find out eventually and then you're in real trouble

•I'm still able to work certain types of jobs, just not the physical labor I used to do. So I think I can honestly answer the questions.

The documentation requirements for SSDI are intense. Start gathering all your medical records now because they'll want everything going back years.

•Thanks for the heads up. I've been seeing multiple doctors so that's going to be a lot of paperwork.

I tried to get information about this from Washington ESD directly but gave up after calling dozens of times. Their phone system is impossible.

•That's exactly why I started using Claimyr. They deal with all the phone hassles and get you connected to someone who can actually answer your questions. Worth checking out if you need to talk to Washington ESD about this kind of complex situation.

Keep detailed records of everything - your job search activities, medical appointments, conversations with doctors. If there's ever a question about your eligibility for either program, you'll need documentation.

•Good point. I've been keeping a job search log for unemployment anyway, so I'll add medical stuff to that.

The job search requirement might actually help your case here. If you're genuinely looking for work you can do with your limitations, that shows you're not completely disabled yet.

•That's a good way to think about it. I am looking for desk jobs instead of the warehouse work I used to do.

Social Security will ask about any other income including unemployment when you apply. Be upfront about it from the beginning.

•Will do. Better to be honest than have problems later.

My advice is to keep filing for unemployment as long as you're actively looking for work you can do. Don't give up income you're entitled to just because you're exploring other options.

•That makes sense. I still need to pay bills regardless of what happens with SSDI.

One more thing - if you do get approved for SSDI, you might be eligible for Medicare after 24 months. That could be important for ongoing medical care.

•I didn't know about the Medicare benefit. That would definitely help with all these doctor visits.

This whole situation shows how complicated our benefits system is. Someone shouldn't have to choose between eating and following bureaucratic rules.

•Exactly. I just want to make sure I don't lose my only source of income while waiting for disability to process.

The bottom line is you can apply for both, but be prepared for potential complications down the road. Keep good records and consider getting professional advice.

•Thanks everyone for all the advice. I think I'll apply for SSDI while continuing my unemployment claims and job search. I'll also look into getting a consultation with a disability attorney.

•That sounds like a reasonable plan. Just remember to stay honest on all your forms and certifications. Good luck with everything!
