Can you apply for unemployment while waiting for disability approval in Washington ESD?
I'm in a really confusing situation and hoping someone can help. I applied for Social Security disability about 6 months ago and I'm still waiting for a decision. My condition makes it hard to work consistently but I'm not completely unable to work yet. My doctor says I should probably stop working but the disability process is taking forever. Can I file for unemployment benefits through Washington ESD while I'm waiting? I'm worried about having no income but also don't want to mess up either claim. Has anyone been in this situation before?

This is actually more common than you think. You can apply for unemployment while waiting for disability, but there are some important things to know. For Washington ESD unemployment, you have to be able and available for work, which might conflict with your disability claim. You'll need to be honest about your limitations but also show you can still perform some type of work.

•Thanks for responding. So I can apply for both at the same time? I'm just worried about contradicting myself somehow.

•Yes, legally you can apply for both. The key is being consistent about your work capacity. If you're saying you're totally disabled, that conflicts with being available for work. But if you're saying you can't do your previous job but could do other work, that's different.

I went through this exact situation last year. You need to be really careful about how you answer the weekly claim questions. Washington ESD asks if you're able and available for work every week. I was honest that I had limitations but could still work part-time or different types of jobs. My disability claim was for my specific job requirements, not all work.

•How did it work out for you? Did you get approved for both?

•I got unemployment for about 8 months while waiting. My disability claim was eventually approved but it took 14 months total. The unemployment helped me survive during that time.

•This gives me hope. I'm in a similar situation and was afraid to apply for unemployment because of my pending disability case.

You should definitely apply for unemployment if you qualify. The waiting period for disability can be years sometimes. Just make sure you can honestly answer yes to being able and available for some type of work. If you're completely unable to work at all, then unemployment isn't the right program.

•That makes sense. I think I could do desk work or something less physical than my previous job.

•Exactly. Being unable to do your previous job because of a disability doesn't mean you're unable to do ANY work. That's a key distinction.

I tried calling Washington ESD about this same question but couldn't get through to anyone. The wait times are insane and I kept getting disconnected. Has anyone found a good way to actually talk to someone there?

•I had the same problem for weeks. Then I found this service called Claimyr that helps you get through to Washington ESD agents. They basically handle the calling and waiting for you. Check out claimyr.com - they have a video demo at https://youtu.be/7DieNd3C7zQ that explains how it works.

•That sounds too good to be true. How much does it cost?

•I was skeptical too but it actually worked. I got through to someone at Washington ESD the same day I used their service. Way better than spending hours on hold.

be careful about this because if you get disability they might make you pay back the unemployment. i heard that happened to someone but not sure if its true

•That's not typically how it works. Disability benefits are usually retroactive, but unemployment is for a different time period. As long as you were honestly able and available for work when you collected unemployment, there shouldn't be an overpayment issue.

•ok good to know. i was worried about that

I'm dealing with this right now too. Filed for unemployment 3 weeks ago and still waiting for my claim to be approved. Washington ESD is taking forever with everything. At least I know I can keep my disability application going at the same time.

•How long did it take to hear back when you applied?

•Still waiting! My claim is in adjudication. I think they're reviewing my work history and medical information.

•Adjudication can take several weeks, especially if there are any complications. Keep filing your weekly claims even while it's pending.

The important thing is being truthful on both applications. Don't say you're completely unable to work on your disability application and then say you're ready to work full-time on your unemployment application. Be consistent about your actual capabilities.

•That's good advice. I think I need to be more specific about what types of work I can and can't do.

•Yes, specificity is key. You might be unable to do heavy lifting but able to do office work, for example.

My husband went through this. He collected unemployment for almost a year while waiting for his disability decision. The key was that he was genuinely looking for work he could do with his limitations. Washington ESD was fine with it as long as he met the job search requirements.

•What kind of job searching did he do? I'm worried about applying for jobs I might not be able to handle.

Liam O'Reilly
•He focused on remote work and desk jobs. The job search log just needs to show you're actively looking for suitable work.

Wait, I thought you couldn't get unemployment if you're not able to work full-time? I'm confused about this whole situation.

•You have to be able and available for work, but that doesn't necessarily mean full-time. Many people work part-time while on unemployment. The key is being available for the work you're seeking.

•Oh I see. So as long as you're available for some type of work, you can qualify.

I just want to add that you should document everything. Keep records of all your applications, medical appointments, job searches, etc. If there are ever any questions later, you'll have proof of what you were doing.

•Good point. I'll start keeping better records of everything.

•Documentation is super important, especially if you end up needing to appeal anything later.

I was in this exact situation 2 years ago. Got unemployment for 10 months while waiting for disability. Eventually got approved for both. The unemployment office understood that I was looking for work within my limitations. Just be honest about your situation.

•This is really encouraging. I was so worried about applying for unemployment because of my disability case.

•Don't let the disability case stop you from applying for unemployment if you qualify. You need income while you're waiting.

The Washington ESD system is so confusing. I tried to get information about this same question and couldn't get a straight answer from anyone. Finally used that Claimyr service someone mentioned earlier and actually got to talk to a real person who explained everything clearly.

•I might need to try that service too. These phone wait times are ridiculous.

•It's worth it just to get accurate information instead of guessing about something this important.

One more thing to consider - if you do get approved for disability and it's retroactive, you might need to report that change to Washington ESD. They need to know about any other benefits you receive.
0 coins
Emily Nguyen-Smith
•So I should report it even if the disability is for a different time period?
0 coins
Daniela Rossi
•Yes, it's better to report it and let them determine if it affects your unemployment benefits. Being transparent prevents problems later.

Thanks everyone for all this information. I feel much more confident about applying for unemployment now. It sounds like as long as I'm honest about my situation and capabilities, I should be okay applying for both.

•Exactly. Just be consistent and honest about what you can and can't do.

•Good luck with both applications. The waiting is the hardest part but you need income while you're going through the process.

Just to add one more perspective - I know someone who didn't apply for unemployment while waiting for disability and really struggled financially. If you qualify for unemployment, you should apply. Don't suffer unnecessarily while waiting for disability approval.

•That's a good point. I can't afford to wait potentially years without any income.

•Right. These programs exist to help people in exactly your situation. Use them if you qualify.
