Can you get Washington ESD unemployment while waiting for disability approval?

I applied for SSDI three months ago and still waiting to hear back. My doctor says I shouldn't work right now but the disability process is taking forever. Can I file for unemployment benefits through Washington ESD while I'm waiting? I'm not sure if being unable to work disqualifies me from UI benefits. Has anyone been in this situation before?

This is tricky territory. For Washington ESD unemployment, you have to certify that you're able and available for work each week. If your doctor says you can't work, that might disqualify you from UI benefits.

But what if I could do some types of work just not my previous job? Like desk work instead of physical labor?

0 coins

That might work if you can genuinely say you're available for suitable work within your restrictions. You'd need to be actively job searching too.

i was in similar spot last year. tried calling washington esd to ask about this but could never get through to anyone. the phone system is impossible

Same here! I've been trying to reach someone at Washington ESD for weeks about my situation. The automated system just hangs up on you after waiting forever.

Actually, I found this service called Claimyr that helps you get through to Washington ESD agents. Check out claimyr.com - they have a video demo at https://youtu.be/7DieNd3C7zQ that shows exactly how it works. Really helped me when I needed to discuss my specific circumstances.

interesting, never heard of that before. might be worth trying since the regular phone number is useless

The legal answer is you can apply for both but there are complications. If you receive both disability and unemployment, you might have to pay back the UI benefits later. Washington ESD considers this potential overpayment issue.

Wait, so I could get approved for both and then owe money back? That sounds like a nightmare.

It depends on the timing and circumstances. If disability gets approved retroactively to cover the same period you got UI, yes there could be overpayment issues.

honestly the whole system is set up to screw people over. you need money while waiting for disability but they make it impossible to get help anywhere

0 coins

I feel this so much. It's like they want people to just give up and disappear.

Ella Knight

•

Right? I just need some income while waiting for the disability decision. Shouldn't be this complicated.

Here's what I'd recommend: document everything with your doctor about what work you CAN do, even if limited. If you can perform some type of work and actively search for it, you might qualify for UI while waiting for disability.

That makes sense. So I should get a letter from my doctor specifying what kinds of work I can still do?

0 coins

Exactly. Having documentation of your work capacity helps if Washington ESD questions your ability/availability for work during weekly claims.

This is good advice. I did something similar when I had restrictions after an injury.

What about the job search requirements though? If you're limited in what work you can do, how do you prove you're actively looking for work?

0 coins

You still need to do the required job search activities each week, but they should be for positions within your restrictions. Document everything in your job search log.

Got it. So apply for jobs I can actually do with my limitations, not just any job.

my cousin tried this and washington esd denied her claim because they said if youre disabled you cant be available for work. she had to appeal

Ella Knight

Did she win the appeal? This is exactly what I'm worried about.

Zoey Bianchi

•

yeah but it took months and she had to get a lawyer involved. was a mess

This is where talking to an actual Washington ESD representative helps clarify your specific situation before filing. That Claimyr service I mentioned earlier really comes in handy for these complex questions.

Important point: if you do get UI benefits and later get disability approved with backpay, keep detailed records. You'll need to report the UI income when filing taxes and potentially resolve any overpayment with Washington ESD.

Ella Knight

•

This is getting complicated. Maybe I should just wait for the disability decision?

0 coins

Don't wait if you need income now. Disability can take years to get approved. Just be prepared for the paperwork if both come through.

Check if you qualify for any other assistance while waiting. Food assistance, utility help, etc. Sometimes there are programs specifically for people in your situation.

Ella Knight

•

Good point. I should look into SNAP and other programs too.

0 coins

Yes, and some are easier to qualify for than unemployment while dealing with disability issues.

DSHS has case workers who can help navigate multiple programs at once.

update: tried that claimyr thing someone mentioned and actually got through to talk to someone at washington esd. they explained my situation much better than the website does

Ella Knight

•

Really? What did they tell you about the disability/unemployment situation?

0 coins

basically said it depends on your specific medical restrictions and what work you can still do. they recommended getting documentation from doctor first before applying

I work in HR and see this situation a lot. The key is being honest about your work capacity. If you truly can't work at all, UI probably isn't the right benefit. But if you have limitations but can still do some work, you might qualify.

Ella Knight

•

That makes sense. I think I can do desk work even if I can't do my old construction job.

Then focus your job search on office/desk positions within your abilities. Document everything for Washington ESD.

Whatever you decide, don't lie on your weekly claims about being able to work. Washington ESD will find out eventually and you'll have bigger problems.

0 coins

Ella Knight

•

Definitely won't lie. Just trying to figure out if I legitimately qualify or not.

0 coins

Good approach. Better to get clarity upfront than deal with overpayment issues later.

•

talk to a disability attorney too. many offer free consultations and can advise on the interaction between disability and unemployment benefits

Ella Knight

•

I hadn't thought of that. Good idea to get legal advice on this.

Eli Wang

•

yeah they deal with this stuff all the time and know the rules better than most people

•

Final thought - if you do decide to apply for UI, having that conversation with Washington ESD first through something like Claimyr really helps avoid problems later. They can walk through your specific situation and give you guidance.

Ella Knight

•

Thanks everyone. I think I'll get documentation from my doctor first, then try to speak with Washington ESD before applying.

Smart plan. Better to get it right the first time than deal with appeals and overpayments.
