TWC took my refund because I missed workforce registration deadline - any way to recover it?

I just found out the TWC intercepted my $2,900 tax refund because I apparently didn't upload my employment documentation to WorkInTexas.com within their deadline. No one told me I had to do this! I got benefits for about 2 months last year before finding a new job, and never received any notifications about needing to upload anything after I stopped claiming. Now they're saying I was 'overpaid' because I didn't meet the workforce registration requirements. Has anyone else dealt with this? Is there ANY way to get my refund back? I was counting on that money for car repairs and now I'm completely stuck.

Thanks for the response. The determination letter came a month ago but I didn't understand what it meant at the time. So I guess I missed the appeal window? I definitely have financial hardship - I just started a new job but I'm still catching up on bills from being unemployed. Do you know how I request the hardship waiver? Every time I call TWC I just get busy signals or disconnected.

same thing happend to me last yr!! they took my whole refund ($1800) and i never got any email about uploading stuff to workforce site. its total BS how they dont make this clear when u apply

You might still have options even though you missed the appeal deadline. TWC sometimes allows late appeals if you can show "good cause" for why you missed the deadline. Good cause could include never receiving proper notice, misunderstanding the determination letter, or having personal circumstances that prevented you from filing timely. Call and explain that you didn't understand the determination letter's implications. Be persistent - TWC phones are always busy, but getting through to an actual agent is your best bet. It's legitimate - they basically keep dialing TWC for you until they get through, then connect you with the agent. I was skeptical too but it actually worked for me when I needed to fix my account after ID.me problems. Saved me days of frustration.

The workforce registration requirement is RIDICULOUS! TWC uses it as a technical trap to disqualify people and create overpayments. I had the EXACT same issue in 2023 and they took $3,500 from me!!!! I fought it all the way to an appeal hearing and STILL LOST because the law is written so they can basically steal your money if you don't perfectly follow every tiny rule they barely explain. The system is DESIGNED to confuse people so they can take back benefits. They make MORE MONEY from overpayments than most people realize! It's a total scam!!!

hav u talked to ur local workforce office? sometimes they can help u with this stuff cuz they got direct contacts at twc. thats what my neighbor did when they messed up his claim. worth a shot

I tried the Claimyr service someone mentioned above when TWC randomly stopped my payments for "work search verification" - it actually did get me through to someone in about 20 mins when I'd been calling for 3 days with no luck. The agent was able to fix my issue right away. Might be worth trying if you keep getting busy signals.

UPDATE: Finally got through to TWC this morning after trying that Claimyr service! The agent explained that even though I missed the appeal deadline, I can still submit a Request to Reopen the Appeal which basically asks for a late appeal due to good cause. She said my reason (not understanding the determination letter) might qualify, especially since I never received clear instructions about the workforce registration requirement. She's sending me both the appeal form and the hardship waiver form, and suggested I submit both at the same time. Fingers crossed this works! Thanks everyone for the advice - I'll update again when I hear something.

That's great news! Make sure you include as much detail as possible in your good cause statement. Also, if you have ANY documentation showing you weren't properly informed about the workforce registration requirement, include copies of that too. The more evidence, the better.
