TWC denied my claim because I reported 2 work searches instead of 3 - can I appeal this?
I'm freaking out right now. I just got a determination letter from TWC saying my benefits are DENIED because I only reported 2 work search activities instead of the required 3 for my county. It was an honest mistake - I thought I only needed 2 per week since that's what it was when I was on unemployment back in 2023. Apparently they changed it to 3 weekly activities sometime last year and I completely missed that update. Has anyone successfully appealed this kind of denial? It seems so harsh to lose benefits over one missing work search activity when I've been doing everything else right. I've got rent due next week and was counting on this payment. Should I file an appeal or just accept the denial and make sure I do 3 activities for future weeks? Any advice would be really appreciated!

Yes, you should definitely appeal this! I successfully appealed a similar situation last month. You need to file the appeal immediately since there's a 14-day deadline from the date on your determination letter. In your appeal explanation, be honest about the mistake and emphasize that you misunderstood the requirements based on your previous unemployment experience. If you have documentation of the 2 work searches you did complete, include copies with your appeal. The TWC can be understanding with honest mistakes, especially if this is your first issue.

•Thank you SO much for the quick reply! The determination letter just came today so I'm within the 14-day window. Did you appeal online or mail in the form? And how long did your appeal process take before you got a decision?

•This is EXACTLY why the unemployment system is broken!!! They change requirements without properly notifying people, then punish you for not following their new rules. It's designed to deny benefits any way possible. I had a similar issue last year and spent WEEKS fighting with them. The whole system is rigged against workers.

I recommend appealing immediately and continuing to request payments while your appeal is pending. Make sure you do 3 work search activities for each week going forward. In your appeal letter, explain that you made an honest mistake based on previous requirements and that you're now aware of the current 3-activity minimum. Include any documentation of the 2 activities you did complete to show good faith effort. The TWC does sometimes waive penalties for first-time mistakes, especially if you've been compliant otherwise. Be sure to check your determination letter carefully for the exact reason code - sometimes they list these as "failure to seek work" or "insufficient work search" which can affect your appeal strategy.

•Thank you for the detailed advice! The determination letter does say "insufficient work search activities" as the reason. I'll definitely keep requesting payments and doing all 3 activities every week while the appeal is pending. Should I also call them to explain the situation or just rely on the written appeal?

Honestly, you should try calling them before filing an appeal. Sometimes they can resolve these issues over the phone if you get through to the right person. But that's the challenge - getting through at all! After trying for days with busy signals and disconnects, I finally used Claimyr (claimyr.com) to get connected to a TWC agent within about 20 minutes. They have a video showing how it works: https://youtu.be/V-IMvH88P1U?si=kNxmh025COIlIzKh I explained my situation (different from yours, but also a small mistake), and the agent was able to help resolve it without going through the formal appeal process. Might be worth trying before you go through the whole appeal paperwork.

•It worked for me! I was skeptical too but was desperate after trying for 3 days straight. They connected me to an actual TWC rep who could access my claim info. Much better than the automated system that just hangs up on you when they're too busy.

i would just reapply for benefits instead of appealing. sometimes thats faster. i had a friend who got denied for missing work searches and he just started a new claim instead of appealing the old one

•This is actually incorrect advice that could cause more problems. Reapplying while you have an existing claim can trigger fraud alerts in the TWC system. Also, a new application doesn't erase the previous issue - the system will flag that you have a prior denial. The proper procedure is to appeal the determination and continue requesting payments while noting 3 work search activities for each week going forward.

Update: I called TWC this morning (had to try about 20 times before getting through) and spoke with an agent. She confirmed I need to file a formal appeal because they can't override the work search denial over the phone. She did say to emphasize in my appeal that it was an honest misunderstanding based on previous requirements and that I had completed 2 activities in good faith. I'm submitting my appeal today and will keep requesting payments with 3 work searches going forward. Fingers crossed!

•That's great you got through! Make sure to keep a copy of everything you submit. Take screenshots of your appeal confirmation page and maybe even send a follow-up through the TWC portal message system referencing your appeal submission. Documentation is key for these situations!

•Work search requirements vary by county in Texas. Rural counties typically require 3 activities per week, while some urban areas might require more. You can verify your specific county's requirement on the TWC website under "Work Search Requirements." Doing extra work searches beyond your requirement won't hurt you, but doing fewer than required can result in benefit denial as the original poster discovered.

When I had this exact problem last year, my appeal got DENIED even though it was my first mistake ever! Then I had to request a hearing which took ANOTHER 6 weeks to schedule! The entire time I wasn't getting paid even though I kept filing my requests. The system is designed to make you give up. Sorry to be negative but prepare yourself for a long fight.

•Oh no, that's scary to hear. Did you eventually get your benefits after the hearing? I really can't go 6+ weeks without this income. I'm going to submit the most detailed appeal I can and hope for the best.

•I did eventually win at the hearing, but it was so stressful. The hearing officer was actually pretty understanding once I explained everything. If you do end up needing a hearing, be super prepared with all your documentation. And definitely keep doing your payment requests with the full 3 work searches every week!

Quick tip that helped me during my appeal: If you have any emails or screenshots showing you were confused about the work search requirements or showing you looking up the old requirements, include those with your appeal. Anything that demonstrates you were making a good faith effort to comply but were genuinely confused about the current requirements can help your case.

•That's really smart! I actually have an old email from 2023 showing the 2-activity requirement. I'll include that in my appeal to show why I was confused. Thank you for this suggestion!

Final advice about your appeal: Make sure to keep requesting payments every two weeks even while your appeal is pending. Complete and document all 3 work search activities for each week. If your appeal is approved, TWC will release any payments that were held during the appeal process. But if you don't continue requesting payments during this time, you can't receive those benefits retroactively even if you win your appeal.

•Thank you! I've submitted my appeal online today and set reminders to keep doing my payment requests every two weeks with all 3 work searches carefully documented. I really appreciate everyone's help - I'll update once I hear something about my appeal!
