DEO claiming I didn't request 3 weeks of benefits - filed appeal but worried
Has anyone dealt with the DEO saying you didn't request benefits when you KNOW you did? I'm freaking out because they're denying 3 weeks of my benefits (about $950 total) claiming I never requested them. I am 100% certain I completed all my work search requirements and submitted everything through CONNECT just like I always do. The system even showed my request was complete when I finished! Now they send me this determination letter saying I failed to request these weeks in a timely manner. I immediately filed an appeal explaining that I did everything correctly and it must be a technical error on their end. I should have taken screenshots of the confirmation page, but who thinks of that? The worst part is I'm relying on this money for rent next month. Has anyone successfully appealed something like this? Do they ever rule in claimants' favor when it's basically your word against their system records?

OMG THIS LITERALLY HAPPENED TO ME LAST MONTH!!! DEO is such a MESS! They said I didn't request benefits for 2 weeks even tho I know I did. I even remember answering all those dumb work search questions. I filed an appeal too but havent heard anything back yet. Its been 3 weeks of waiting. So frustrating!!!! Let me know if u hear anything back about yours.

•It's so frustrating! How can we prove we did something when their system glitches? Have you called them at all? I've tried 8 times this week and can't get through to a real person.

I successfully appealed a similar issue last year. The key is documenting everything from now on. For the appeal itself, be very specific about the dates you claimed, the approximate time of day, and any confirmation messages you remember seeing. Also mention if you've successfully claimed other weeks before and after without issue, as this helps show a pattern of compliance. The appeals process typically takes 3-5 weeks right now. In my case, they ruled in my favor because they could see I had consistently claimed weeks before and after the disputed period, making it unlikely I'd randomly skip just those weeks. Make sure to keep claiming your current weeks while waiting for the appeal decision!

•Thank you so much for this info! I've been claiming every other week like clockwork for months, so hopefully they'll see that pattern. Did you have to attend a hearing for your appeal or did they just review your written explanation?

This is a common issue with the CONNECT system, unfortunately. Here's what you should include in your appeal to maximize your chances of success: 1. Any email confirmations you received (even general DEO emails showing activity during that period) 2. Bank statements showing a pattern of deposits to establish your regular claiming history 3. Screenshots of your work search records from those weeks (if you kept them elsewhere) 4. Any correspondence with potential employers during those weeks The appeals referee will look for any evidence that suggests you were actively engaged with your claim during the disputed period. Based on my experience helping claimants with appeals, they do sometimes rule in favor of the claimant when there's a consistent claiming history before and after the disputed weeks. While waiting for your appeal, I'd suggest contacting your state representative's office as well. They sometimes can help expedite the process.

•Thanks for the detailed advice! I keep all my job search records in a spreadsheet, so I do have that documentation. I wish I had saved confirmation emails though. Do you know if they look at your login history? Because I definitely logged into CONNECT during those weeks.

i had this exact problem! i kept getting disconnected when i tried calling to fix it. i found this service called claimyr that got me through to an actual deo agent in like 30 minutes! it costs money but was worth it to get my issue fixed fast. check out claimyr.com - they have a video showing how it works here: https://youtu.be/UzW_hbUy-ss?si=zORd51jeq1GX5Ldj the agent was able to see in their system that i had actually logged in during the time i was supposed to claim but something didn't process right on their end. they fixed it for me without having to wait for an appeal hearing.

•Is that service legit? Sounds like a scam to me. Why would you pay money to talk to DEO when you can just keep calling yourself?

•definitely legit! i spent two entire days trying to call myself and either got busy signals or was on hold for hours only to get disconnected. this got me through in 30 mins. just sharing what worked for me when i was desperate!

I went through this exact situation in January. The system is completely broken. I filed an appeal for missing weeks that I KNOW I claimed and guess what? Six weeks later they ruled AGAINST ME saying there was "no evidence in the system" that I had claimed those weeks. They completely ignored my consistent claiming history and my detailed explanation. Now I'm out almost $1000 and there's nothing I can do about it. The whole system is designed to deny benefits any way they can. My advice? Take screenshots of EVERYTHING from now on. Every confirmation screen, every work search entry, everything. The burden of proof is always on us, never on their glitchy system. Good luck with your appeal but don't get your hopes up.

•This is what I'm afraid of. I'm sorry that happened to you. Did you try contacting your state representative after they denied your appeal? I'm wondering if that's worth trying.

•I did try contacting my state rep but just got a generic response from a staff member saying they'd "look into it" and then nothing. Maybe you'll have better luck than me though. The whole system just seems designed to frustrate people until they give up.

One more tip I forgot to mention - if you log into CONNECT, go to your "Determination, Pending Issues and Decision Summary" page. Sometimes there will be additional information there about why they determined you didn't claim those weeks. It might show if they sent you any notices that you missed or if there was a specific issue with your claim during that period. Also, for your appeal hearing (if you have one), make sure to mention any technical issues you experienced with the CONNECT system during that time. The appeals referees are often more understanding about technical glitches than the initial determination process.

•I checked that page and it just says "Failed to request benefits within 14 days" for each week. Nothing more specific. I'll definitely mention that I had trouble with the site timing out during that period. Do you know how long until they schedule an appeal hearing usually?

To answer your follow-up question - yes, I did have a telephone hearing for my appeal. It was pretty straightforward. The referee asked me to explain my side, then asked a DEO representative to explain their records. The whole thing took about 15 minutes. One thing that really helped me was having my calendar with notes showing I had set reminders to claim those weeks. I also had my work search records ready to go. The referee seemed impressed that I was so organized and could specifically recall details about claiming those weeks. In your case, if you can remember any specific details about claiming those weeks (like any error messages you might have seen, or if the confirmation page looked different), definitely mention those. Specific details make your account more credible.

•That's not true at all. They have a whole department that reviews claims.

Quick update on my situation that might help you - after I got through to DEO using that service I mentioned, the agent told me something interesting. Apparently sometimes if you claim your weeks but close the browser before seeing the final confirmation page, the system doesn't record it properly even though it seems like you completed everything. They said always wait to see the final confirmation page that shows the exact weeks you claimed and the payment amount. Just sharing in case it helps anyone else!

•That's actually really helpful info! I sometimes have to use my phone when my laptop isn't working, and the mobile site is terrible. It's entirely possible something didn't process correctly even though I thought I finished everything. I'm going to mention this possibility in my appeal.
