5 weeks no PA UC determination letter despite employer not contesting - legal waiting time?

I'm at my wits end with PA unemployment! It's been FIVE WEEKS since I filed my initial claim after being let go (downsizing), and I still haven't received any determination letter. My former employer already confirmed to me that they responded to UC's request for information over 3 weeks ago and told them they are NOT contesting my claim. I've been faithfully filing my weekly claims but haven't seen a penny. My rent is due next week and I'm seriously starting to panic. Is this normal?? Can PA UC legally take this long to make a decision when the employer isn't even fighting it? What should I do next? I've tried calling but can't get through, and the chat feature just tells me to wait for a determination letter.

Unfortunately this is pretty normal for PA UC right now. My determination took 8 weeks even though my employer also didn't contest. They're seriously backed up with claims processing. Have you checked your dashboard to see if there are any open issues listed? Sometimes they need additional info but don't actually tell you.

8 WEEKS?! That's insane!! I did check my dashboard and it says I have an 'open issue' but doesn't explain what the issue actually is. How am I supposed to fix something if they don't tell me what needs fixing???

omg same boat here waiting 6 weeks already... its so frustrating when ur employer isnt even fighting it!! did u try messaging them thru the portal?

Yes! I've sent THREE messages through the portal over the past two weeks. No response at all. It feels like shouting into a void.

The open issue on your dashboard is likely what's causing the delay. PA UC has a legal timeframe of 21 days to make a determination after all information is received, but that clock doesn't start until the open issue is resolved. Here's what you need to do: 1. You need to speak directly with an examiner about your open issue, as these often require additional information they haven't requested yet. 2. Call the UC service center as soon as they open at 8:00 AM. Keep trying different options on the phone tree as sometimes option 1 is busy but option 4 will get you through. 3. If your employer truly isn't contesting, request that they contact UC directly again to confirm this, as sometimes employer responses get flagged incorrectly in the system. 4. Document all your attempts to contact them - this can help if you need to request backpay later. You are legally entitled to a determination, and if your employer isn't contesting, you should ultimately be approved. The delay is frustrating but doesn't mean a denial is coming.

Thank you so much for this detailed response! I've been trying to call at 8am but it's constantly busy no matter which option I choose. I'll definitely ask my former HR person to contact them again though - that's a great idea.

same thing last month for me lol. ended up being they needed wage verification or something but never told me until i finally got someone on the phone. try early morning calls thats the only way

Yea I've noticed they're especially taking long times if there was any overtime or bonus pay in your base year. They have to manually review those for some reason.

I had this EXACT same problem last month! Waiting and waiting while bills piled up. After trying for 2 weeks to get through on the phone with no luck, I found this service called Claimyr (claimyr.com) that got me connected to a UC rep in about 20 minutes. They have a video showing how it works: https://youtu.be/CEPETxZdo9E?si=WL1ZzVZWG3KiHrg2 Turns out my issue was just that they needed verification of my last day worked, which wasn't matching what my employer submitted. Once I talked to someone, they fixed it on the spot and my payments started the next week with backpay for everything I was owed. Definitely worth it to actually talk to someone instead of waiting forever.

I've never heard of this service before. Did it actually work? I'm desperate enough to try anything at this point if it means I can finally get someone on the phone.

Yes, it really worked for me! I was connected to a real UC rep who could see my claim details and fix the issue. Just be ready with your claim information when you call.

PA UC actually can legally take up to 8 weeks to process claims, though they're supposed to aim for 21 days. The Pennsylvania unemployment system has been understaffed since the pandemic, and they still haven't fully recovered. What's happening is that your claim is stuck in a verification queue, and since you mentioned seeing an 'open issue', that's definitely why there's a delay. In my experience, open issues fall into a few categories: 1. Identity verification issues (IDme related) 2. Separation reason verification (even if employer isn't contesting) 3. Wage verification discrepancies 4. Work search compliance questions You'll eventually get backpay for all weeks you've claimed once approved, but that doesn't help with immediate bills. I recommend reaching out to PA 211 for emergency assistance options while you wait for your UC determination. They can sometimes help with rent and utilities during gaps like this.

Thank you for the detailed explanation! I've already done the IDme verification, so it must be one of the other issues. I'll try 211 - I hadn't thought about looking for emergency assistance.

Any luck getting through to someone? I know it's frustrating, but keep trying. Also make sure you continue filing your weekly claims even without a determination - if you miss weeks, you can't claim them later.

I actually got through this morning! Used the Claimyr service that someone mentioned above and it worked - got connected in about 15 minutes. Turns out the issue was that I had a previous claim from 2023 that had some unresolved questions, and they needed to close that one properly before processing my new claim. The rep was able to fix it immediately and said I should get a determination letter within 3-5 days, with payments to follow if approved (which she said looked likely since my employer didn't contest). Huge relief! Thanks everyone for your help and suggestions.

Great news! This is actually a common issue that many people encounter - old claims creating problems with new ones. Glad you got it resolved. Make sure to print out or screenshot the determination letter when you get it for your records. PA UC sometimes has system glitches where documents disappear from your dashboard.
