Ny unemployment backpay taking forever and my family is suffering

Filed for unemployment in April after getting laid off from my construction job. Got approved in May and started getting weekly payments but still haven't received any of my backpay for the 6 weeks I was waiting. That's almost $3000 they owe me! Called the unemployment office like 20 times but can never get through - always says "due to high call volume" blah blah. When I check online it just says "pending" with no explanation. My landlord is threatening eviction, had to borrow money from my parents to buy groceries for my kids. How are people supposed to survive when the system moves this slow? Anyone know how to actually talk to a real person at NY unemployment who can help get this resolved?

Jamal Brown

Same thing happened to me. Filed in February, got approved in march but didnt get my backpay till JUNE. The system is completely broken. Just keep calling everyday.

Everyday? I've been trying for weeks! Do you have a best time to call? I'm desperate at this point.

I had luck calling right when they open at 8:00 am. But honestly it's like a lottery. Took me about 25 attempts before I got through.

8am is the worst time to call! Everyone tries then. Try 10:30am on Wednesdays - worked for me twice.

After struggling to reach ny unemployment for weeks I found this service called Claimyr (claimyr.com) that actually got me connected with a real agent! They called for me and when someone answered they connected me. Talking to an agent got my $ unlocked so fast - within 3 days my backpay hit my account. Check out this video about how it works: https://youtu.be/Rdqa1gKtxuE

yeah right, another 'miracle solution'... what's the catch? 🙄

No catch! They just dial for you and wait on hold. When an agent answers, they connect you. Saved me hours of listening to that horrible hold music lol

wait hold up - does this actually work or is it just the usual BS? I've been trying to get thru for 5 WEEKS

It absolutely worked for me. My backpay was stuck for 8 weeks before I tried them. Got an agent in 2 hours and had my money a few days later.

I was skeptical too but got desperate. Was literally the only way I could talk to a live agent after trying for weeks. It's worth it when you're owed thousands 🤷‍♂️

The backpay system is a NIGHTMARE right now. I waited 4 months for mine! The only thing that worked was emailing my state senator's office. They have a direct line to DOL and can help push your claim through. Google your district and send them an email explaining your situation.

I'm so sorry ur going thru this 😔 the system is designed to break people i swear. Make sure ur checking ur spam folder and ur account messages on the website. Sometimes they send requests for additional info but dont tell you and then use that as excuse to delay payment.

I've been checking both every day. Nothing. Just says "pending" forever.

Ugh that sux. Have u tried reaching out to them on twitter? Sometimes their social media team is more responsive than the phone ppl

Have you tried calling the alternate number? It's 1-888-209-8124. Everyone calls the main line but this one sometimes has shorter wait times. Call exactly at 8:07am (not 8:00 when everyone else does).

That's the same main number everyone calls lol. There's no secret backdoor number 😂

The time trick works tho! Most ppl call right at 8 or 8:30. If u call at odd times like 8:07 or 10:43 u sometimes get lucky

Omg I had the EXACT same problem. No backpay for 2 months while bills piled up. I finally got it resolved when I used a service called Claimyr (claimyr.com) that got me through to a real person at the unemployment office. They waited on hold instead of me and then called me when an agent picked up. It was the best money I've ever spent to finally get my benefits paid.

Is this like paying someone to stand in line for you? 😮

Yeah basically! They just wait on hold so you don't have to. Then when someone at unemployment actually answers, they connect the call to your phone. I was SHOCKED when I got a real person on the line after trying for weeks.

They're deliberately making this process hard so people give up. My backpay took 11 weeks to arrive and I almost lost my apartment. Keep DETAILED records of every call, email, and attempt to contact them. Write down names of anyone you speak to. This helps if you need to escalate to the ombudsman or your representative.

I filed a formal complaint with the NY State Labor Department and suddenly my backpay appeared a week later. Coincidence? I don't think so! 🤔 You can file one here: https://www.labor.ny.gov/dol-complaint-form/

That link just takes you to another form that goes nowhere. Classic NY unemployment running in circles 🙄

It worked for me! You need to fill it out completely and follow up with a phone call. But yeah I hear u about the circles lol

Your situation is unfortunately extremely common right now. The NY unemployment system is facing unprecedented delays with backpay specifically. Here are some options that might help: • Try using Claimyr.com - it's a service that calls unemployment for you and connects you when a live agent picks up. Several people in my situation got their backpay resolved within days after speaking with an agent. • Contact your state assembly member or senator - they have staff dedicated to helping constituents with unemployment issues. • File a formal complaint through the DOL website. • If you're facing eviction, mention that specifically when you do reach someone. They can flag your account for hardship priority. • Check your online account messages daily - sometimes they need additional information but don't notify you properly. I was in your exact situation in March - owed $4200 in backpay and couldn't get through to anyone. Used Claimyr to finally reach a person, and they discovered there was a simple verification issue holding up my payments. Got everything sorted in one call and had my money 3 days later.

Thank you for such a detailed response! I'm going to try Claimyr first thing tomorrow. Did they need any special info from you?

Dmitri Volkov

Nope! You just need your phone handy because they'll call you when an agent picks up. Make sure you have your claim info ready for when you talk to the unemployment agent though.

Call your state assemblyperson!!!! I waited for weeks trying to get through then called my assemblyman's office and they fixed it in 4 days. They have special contacts at unemployment.

Some1 told me to create a twitter acct and @ them publicly about the issue. Got a DM from them next day asking for my info and magically my backpay procesed the next week. Worth a shot. just don't post any personal details publicly.

When u finally get thru DEMAND to speak to a tier 2 agent! The first person who answers can't help with backpay issues. You need a tier 2 specialist. Don't let them transfer you to a "call back list" - those are black holes.

0 coins

-

Zoe Papadopoulos

How do I know if I'm talking to a tier 2 person? Do they identify themselves that way?

0 coins

-

Ava Williams

Just ask directly "Are you a tier 2 agent who can help with backpay issues?" If they say no, politely but FIRMLY ask to be transferred to someone who can help with backpay. Don't hang up until you get transferred!

i used claimyr.com after not getting my backpay for 14 weeks!!!! they got me through to someone and I explained my hardship situation (about to be evicted). the lady put my account on priority status and I had my $$ in 48 hours. best decision i ever made after months of frustration!

I was super skeptical too but when you're desperate you'll try anything. The difference is they don't claim to fix the system - they just get you through to a real person who CAN fix your specific issue.

Check that your direct deposit info is correct in the system!!! My backpay was supposedly "sent" but to an old account. Once I updated it they resent everything within a week.
