New York Unemployment denied because of previous employer even though I'm a laid off school worker
I work at a school and I'm laid off for winter break. I tried filing a new claim and certified last Sunday but didn't get paid. Called and they said I was denied because of previous employers from 6 months ago where I got fired. Those claims were already denied back then. The school told me I should collect unemployment during breaks like I did last winter and summer. The rep says one employer can affect my whole claim. Is this right?

School workers situation is complicated af. If you worked enough quarters at the school, those old jobs shouldnt matter. Sounds like the rep doesnt know what their talking about tbh 🤔

As a former NYS unemployment worker, let me break this down for you: School employees have special rules for breaks. If you have a reasonable assurance of returning to work after the break, you may not qualify for benefits during scheduled breaks. However, this is separate from previous employment issues. Your previous denials shouldn't affect a new claim if: 1. You've earned enough wages at the school 2. Your school employment is your base period employer 3. You have reasonable assurance of returning I recommend using claimyr.com to get through to a tier 2 rep who can properly review your claim. Regular reps often don't understand the nuances of school employee claims.
