Need help getting 4 weeks of back pay from NY unemployment after severance confusion
I lost my job about 5 months ago and didn't file for my first month of unemployment because my company said I might get a severance package within those first 30 days. Turns out they never sent the severance during that period, so now I'm trying to get those 4 weeks of back payments from NY unemployment. I've sent three different requests through the portal - first one about 9 weeks ago, second one around 5 weeks ago, and just sent another last week. Haven't heard anything back at all. Called the unemployment office at least four times but keep getting the automated message saying they're too busy and to try again later. Never even get put on hold. Starting to get really frustrated since that's almost $1800 I'm missing. Does anyone have advice on how to actually get these back payments processed? I've tried everything I can think of.

Same thing happened to me but it was 6 weeks of backpay. They are litterally impossible to get ahold of. I finally got through using claimyr.com after wasting weeks trying to call myself. The service kept calling and got me a rep who fixed it all in like 10 mins. talking to an agent got my money unlocked so fast - wish I'd found it sooner! Check out their explanation video: https://youtu.be/Rdqa1gKtxuE

•Is this some kind of scam? How does that even work?

•Nah not a scam. They just automate the calling and hold process. When an actual person picks up, they connect the call to your phone. Saved me hours of hold time and frustration.

•another 'miracle solution'... what's the catch? 🙄 these things never work

•No catch that I found. It just does the waiting for you. Better than spending your whole day hitting redial. Got my backpay issue fixed in one call after weeks of nothing.

•hmm I've been burned by so many of these 'services' before... what makes this different? most are just money grabs that don't deliver

•honestly was skeptical too but it actually worked. i'm not affiliated with them or anything, just sharing what helped me get unstuck with my claim. was about ready to set my phone on fire after days of trying myself

Call right at 8:00 AM when they open. That's the ONLY way I got through. And when you do, be super nice to the person you talk to. They deal with angry people all day. I had a similar issue with backpay from March and they fixed it for me when I finally got through.

The backpayment system is completly broken. I was in ur exact situation and it took 5 MONTHS to get my money. What a joke. The only way I got it resolved was by contacting my state representative who put pressure on unemployment for me. Try that route - google your local rep and call their office.

•Thanks for the suggestion! How long did it take after contacting your representative?

•About 3 weeks from when I contacted the rep til the money hit my account. Way faster than trying to deal with unemployment directly.

•I second this. My assemblywoman's office was SUPER helpful with my claim issues. They have dedicated channels to DOL.

This is going to sound werid but try the unemployment facebook page. Message them directly and include your claim number and issue. I had been waiting months for backpay and got a response in 2 days when I tried that method. They messaged back asking for some details and then fixed it.

•Isn't that risky sharing personal info over Facebook tho?

•They tell you to DM them, dont post publicly. They only ask for enough info to locate your claim. Worked for me 🤷♂️

This exact BS is why I had to use claimyr.com to get someone on the phone. I tried for weeks and could never get through. Used their service and had an agent on the phone in 2 hours. Totally worth it to get my backpay unstuck.

The real problem is that the NY unemployment system isn't designed to handle backpay requests efficently. They prioritize new claims and pushing through regular weekly certifications. Backpay gets put at the bottom of the pile. Your best bet is to either: 1) Keep being persistent with calls - use services like claimyr.com to get through the phone lines 2) Contact your state representative or assemblyperson's office 3) Try sending a detailed message through the portal, but include the specific dates and reason for backpay very clearly 4) As a last resort, file a complaint with the state labor department Don't give up! The system is frustrating but you ARE entitled to those benefits. The key is finding someone who can actually process your request. Getting a real person on the phone is crucial - that's why so many people use automated services to help with the calling. The squeaky wheel gets the grease with these government agencies. Good luck!

•Thank you! This is really thorough advice. I'll definitely try the state rep approach if I can't get through on the phone.

•THIS!!! The backpay system is completely broken by design. They know most people will give up.

Have u tried going to a career center in person? Some locations have UI staff that can help with claims. Worth a shot if ur calls aren't working.

•The career centers can't help with backdating issues - they'll just tell you to call the main number. I tried this route and wasted half a day 😡

I swear they deliberately make it impossible to reach them so people just give up on backpay. It's criminal. They owe you that money!!! 😤

Try reaching out on Twitter too. Sometimes the social media teams respond faster than any other method. Tag the DOL and your state reps.

ok so here's what worked for me when I had almost IDENTICAL situation. call the spanish language line even if you don't speak spanish. there's way less wait and they all speak english too. crazy hack but it worked!

CosmicCommander
•I tried this and it worked! Only waited 20 minutes compared to never getting through on the English line. The rep was super helpful too.

•This is kinda messed up tho... taking spots from Spanish speakers who need help in their language 😕

•I mean maybe? But the whole system is broken. Just trying to help people get their $$ that they're entitled to

When you submit requests through the portal are you using the backdating option specifically? There's a difference between general messages and formal backdate requests. Make sure you're using the right form.

Mei Lin
•Yes, I'm definitely using the backdating form where you select the specific weeks you're requesting backpay for. Still no response after multiple attempts.

Any1 else notice that the NY unemployment system is EXTRA dysfunctional lately? I feel like it's gotten even worse in the past few months. Used to at least get through sometimes but now it's impossible without using a service like claimyr.com

•wait hold up - does this actually work or is it just the usual BS? seems too easy

Emma Davis
•It literally just calls the number over and over and waits on hold so you don't have to. Not magic, just automation. But it works - I got my issue fixed same day after weeks of trying myself.

Pro tip: call your state senator and assembly person AT THE SAME TIME. I had to do this for my partner when they were in the exact situation. Our senator's office had a special form for unemployment issues and they got it resolved in 3 weeks.

They actually process the backdated claims in batches. My friend who works for DOL said they only do them like once every 6 weeks or something stupid. So frustrating! But keep following up because eventually they will get to it.

Here's what worked for me on a similar issue - I sent a secure message through the portal AND emailed unemploymentinfo@labor.ny.gov with all my claim details. Got a call back within 5 days.

So I used to work at DOL (not anymore thank god) and the backpay requests get flagged for manual review which creates huge delays. The ONLY way to speed it up is to get a live agent to manually push it through. That's why everyone is suggesting phone calls - it's literally the only solution. And yeah claimyr.com is how a lot of people are getting through these days.

•Whoa an insider! Any other tips for dealing with the system?

•Make sure all your info is 100% consistent across your application. Even small discrepancies can flag your claim. And always certify even if you're waiting on issues to be resolved.

my cousin had this exact problem and she filed a complaint with the labor department's inspector general office. got her backpay within 10 days after 3 months of nothing.

Check if your issue falls under any of the class action lawsuits against NY unemployment. might help pressure them to solve your case faster.
