NYS Department of Labor unemployment - when does it stop if I get a job?

I've been collecting unemployment for about 8 weeks now and I just got offered a full-time position starting Monday. I'm supposed to file my weekly claim this Sunday but I'm not sure what to do. Do I still file for this week since I haven't started working yet? When exactly does my NYS Department of Labor benefits stop? I don't want to mess anything up or get in trouble for overpayment.

You need to report the start date of your new job on your weekly claim. Your benefits will stop the week you start working, even if it's just one day. So if you start Monday, you can still claim for the days before you started but you have to report the job start date.

Thanks! So I should still file this Sunday but put Monday as my start date? Will they automatically calculate the partial payment?

yeah this happened to me too, just be honest about when you start working and they'll figure out the payment. Better to report it than get hit with an overpayment later

Congratulations on the new job! Here's what you need to know: File your weekly claim as usual this Sunday, but make sure to answer 'yes' when they ask if you started work and enter your start date. NYS Department of Labor will calculate any partial benefits you're entitled to for the days before you started. Your unemployment will officially end the week you begin working. Keep all your job start documentation just in case.

What if the job doesn't work out after a few weeks? Can you reopen your claim or do you have to start over completely?

If you lose the job through no fault of your own within a short period, you can usually reopen your existing claim. Contact NYS Department of Labor as soon as possible if that happens.

I had such a hard time getting through to NYS Department of Labor when I had questions about this exact situation. Spent hours on hold and kept getting disconnected. Finally found this service called Claimyr at claimyr.com that helped me reach an actual agent. They have a video demo at https://youtu.be/qyftW-mnTNI showing how it works. Made the whole process so much easier than trying to call myself.

That's interesting, I've been dreading having to call if I run into any issues. How does that service work exactly?

They basically handle the calling and waiting for you, then connect you when they get an agent on the line. Way better than sitting on hold for hours.

The whole system is so confusing! I wish they made it clearer what happens when you go back to work. I'm always worried I'm going to do something wrong and owe money back.

Totally agree. The NYS Department of Labor website has the info but it's buried in so much text. Just be honest about your work start date and you'll be fine.
