When do you stop unemployment benefits in NY - confused about ending my claim

I've been collecting unemployment for about 7 months now and I'm not sure when I'm supposed to stop filing my weekly claims. I got a job offer last week that starts Monday but I already certified for this week yesterday. Do I need to call NYS Department of Labor to tell them I'm stopping? Or do I just stop filing weekly claims? I don't want to mess anything up and get an overpayment notice later. Also not sure if I should report the new job on my last weekly claim or wait until after I start working. Really don't want any issues with this.

You need to report your return to work on your final weekly claim certification. When you file your last weekly claim, there's a section where you report if you worked or will start working. Make sure to include your start date and expected weekly earnings. You should continue filing until the week you actually start working, then stop after that. Don't just stop filing without reporting the job - that can cause issues later.

Thanks! So I report it on this week's claim even though I haven't started yet? Just want to make sure I do this right.

yeah you definitely want to report the job when you file. i made the mistake of just stopping my claims without telling them about my new job and they sent me a letter asking why i stopped filing. had to call and explain everything which was a pain

The key thing is to file your weekly claim for any week where you were unemployed for part of the week. So if you start work on Monday, you'd still file for that week but report that you started working. NYS Department of Labor needs that final claim to properly close out your benefit year. If you have trouble getting through to them by phone to confirm anything, you might want to check out claimyr.com - they help people reach NYS Department of Labor agents when the lines are busy. There's a demo video at https://youtu.be/qyftW-mnTNI that shows how it works.

Never heard of that service before but might be useful. I've been trying to get through to ask about my adjudication for weeks with no luck.

Wait, I'm confused about this too. If I work part time, do I keep filing claims? Or only if I'm completely unemployed?

You can file for partial unemployment if you're working part time and earning less than your full benefit rate plus $50. You'd report your part time earnings each week and they'll calculate if you're eligible for any benefits.

Congrats on the new job! Just to add - make sure you keep records of your last day of unemployment and first day of work. Sometimes NYS Department of Labor will audit claims later and you want to have documentation. Also, if the job doesn't work out for some reason, you might be able to reopen your claim rather than filing a completely new one, but only if you report everything correctly when you stop.

good point about keeping records. i always screenshot my weekly claim confirmations just in case

Just wanted to share my experience - I had a similar situation last year. You definitely want to file that final weekly claim and report your new job start date and expected earnings. I reported everything properly and had no issues. The system automatically closed my claim after I stopped filing. One tip: if you're starting on a Monday, that counts as working during that benefit week, so make sure to report it even though you'll only work a few days. Better to over-communicate with NYS DOL than leave them guessing why you stopped filing.

This is really helpful advice! I'm in a similar boat - got a job offer but won't start for another two weeks. So I should keep filing weekly claims until I actually start working, then file one final claim for the week I start and report the job details there? Just want to make sure I understand the timing correctly.
