Do you stop getting unemployment when you get a job - NYS Department of Labor rules?
I just started a new full-time position last Monday and I'm not sure what I'm supposed to do about my weekly unemployment claims. Do I need to immediately stop filing with NYS Department of Labor or is there some kind of transition period? I'm worried about messing something up and having to pay back benefits if I do this wrong. My last weekly claim was filed on Sunday before I started the job. Should I file this week or not?

You need to stop filing weekly claims immediately once you start full-time work. NYS Department of Labor requires you to report any employment on your weekly certification. If you worked any hours during the week you're claiming for, you need to report those hours and earnings. Continuing to file after starting full-time work could result in an overpayment that you'd have to pay back.

•Thanks! So I shouldn't file this week's claim at all since I worked the full week? I don't want to get in trouble for overpayment.

yeah you stop right away when you start working full time, thats how it works with unemployment

I'm in a similar situation but my job is only part-time. Do the same rules apply or can I still get partial unemployment benefits? I'm only working 20 hours a week and the pay is pretty low.

•Part-time work is different. You can still receive partial unemployment benefits as long as you report your hours and earnings on your weekly claim. NYS Department of Labor will calculate your partial benefit amount based on what you earn. You just need to make sure you're still able and available for full-time work and continue your job search activities.

I had such a hard time getting through to NYS Department of Labor when I had questions about this exact situation. Spent hours on hold just to get disconnected. Finally found claimyr.com which helped me get connected to an actual agent who explained everything. There's a video demo at https://youtu.be/qyftW-mnTNI that shows how it works. Made dealing with the unemployment office so much easier.

•That sounds helpful! I've been dreading having to call them if I mess something up with my claim.

Congratulations on the new job! Just make sure you keep all your employment documentation in case NYS Department of Labor needs to verify anything later. It's always better to be over-prepared when dealing with unemployment claims.

Just want to add that you should also make sure to update your contact information with NYS Department of Labor if your employment status changes, especially if you get employer-provided health insurance. They sometimes need to verify benefit eligibility and having current info helps avoid any delays or complications. Also, if this new job doesn't work out for any reason, you'll want to have everything properly documented to potentially reopen your claim later.

•That's really good advice about keeping documentation and updating contact info! I didn't even think about the health insurance aspect. Quick question - if I do need to reopen my claim later, is there a time limit on how long after closing it I can do that? Or do I have to start completely over with a new application?
