NY unemployment penalty appeal timeline - has anyone received a hearing date yet?

Finally submitted my appeal for these unemployment penalties they slapped me with last month. Been checking my mail obsessively but haven't heard anything back yet. Has anyone else appealed their NY unemployment penalties recently and actually gotten a hearing date? How long did you have to wait? Getting nervous since I've got that 30-day deadline coming up for some other paperwork they want.

I appealed a penalty in January and just got my hearing date last week - so almost 2 months of waiting! And the hearing isn't scheduled until mid-April, so another month away. The whole system is backed up rn

2 MONTHS?? Ugh that's way longer than I expected. Did they at least stop collection activities while your appeal was pending?

I successfully appealed a penalty last year. The timeline varies depending on your region and current backlog, but typically expect 6-8 weeks for a hearing date assignment. Important things to know:\n\n1. The appeal does temporarily pause collection activities in most cases\n2. Make sure you've submitted all supporting documentation with your appeal\n3. Prepare your case by organizing all your certification records, income reports, and communication with NYSDOL\n4. The hearing will likely be conducted by phone, so have all your documents ready\n\nIf you need to speak with someone at NYSDOL about your specific situation, I'd recommend using Claimyr (claimyr.com) - they helped me get through to an agent within 30 minutes when I was stuck in appeal limbo. They have a video showing how it works: https://youtu.be/Rdqa1gKtxuE

Thanks for the detailed info! I've got all my documentation together, but I'm worried about the phone hearing - I don't interview well and get nervous. I'll check out that Claimyr service if I don't hear anything in the next couple weeks.

Is anyone else getting conflicting info from different NYSDOL reps? I filed my appeal in February, and one rep told me it would take 4-6 weeks for a hearing date, another said 10-12 weeks, and a third said they couldn't give me any timeline at all! So frustrating when they can't even agree on basic information.

The system is COMPLETELY broken! I waited 11 weeks for my hearing date last year and then they rescheduled it TWICE without explanation. By the time I actually had my hearing, I had already been forced to make payments on the penalty amount because they started garnishing my tax refund!!! The whole appeal process is designed to make you give up.

Appeals for unemployment penalties in NY currently have an average processing time of 7-9 weeks before you receive a hearing date. This is based on the current backlog as of March 2025.\n\nThe wait time depends on several factors:\n- The complexity of your case\n- Your local office's current workload\n- Whether you've submitted complete documentation\n- The specific type of penalty being appealed\n\nMake sure you've received a confirmation that your appeal was received. If it's been more than 2 weeks since you submitted and you haven't received confirmation, you should follow up.

Thanks for the info! I did get a confirmation email when I submitted online, so I guess that's something. Just wish they gave some kind of estimate in the confirmation so people weren't left hanging.

Congrats on winning! Do you mind sharing what kind of penalty you were appealing and what evidence helped your case? My situation involves some missing certification weeks that I thought I had completed.

my brother in law never got a date they just sent him a letter saying appeal denied!!! no hearing at all!! be careful cause sometimes they just decide without even letting u talk to anyone

That's unusual and may indicate a procedural error. If someone receives a denial without a hearing opportunity, they should immediately file for reconsideration citing lack of due process. New York unemployment appeals are governed by specific regulations that require the opportunity for a hearing in most circumstances.

Just a heads up - make sure you're checking both your online message center AND your physical mail. I nearly missed my hearing because they sent the date through the online portal but not to my mailing address (which they had done for everything else). The system is incredibly inconsistent with how they communicate.

This!!! They sent my first notice by mail, then follow up online, then another mail... makes no sense which system they use when

DONT GET YOUR HOPES UP!!! I waited 7 weeks for a hearing date, had to prepare everything, took time off work to be available, and then the so-called 'judge' spent all of 15 MINUTES on my case before ruling against me anyway!!! The whole appeals system is just theater to make it look like they're giving you a fair chance. They're ALWAYS going to side with the department unless you have an attorney.

I understand your frustration, but this hasn't been everyone's experience. While the system certainly has flaws, many claimants do win their appeals, especially when they can clearly demonstrate errors in the original determination. The key is thorough documentation and clearly explaining which specific elements of the determination you believe are incorrect and why.
