NY unemployment appeal hearing delay - filed in October with no response yet

I filed for an appeal hearing with NY unemployment back in early October 2025 after my benefits were denied. It's now been almost 2 months and I haven't heard a single thing from NYSDOL about when my hearing will be scheduled. The automated system just says 'pending' whenever I call. The determination letter said I would be contacted within 4-6 weeks to schedule my hearing, but nothing so far. Has anyone else experienced this kind of delay? How long did you have to wait before they contacted you about your appeal hearing? I'm getting really worried because I'm running out of savings.

The appeals backlog at NYSDOL is ridiculous right now. I filed my appeal in September and didn't get my hearing scheduled until mid-December - more than 3 months of waiting! And that was after calling them repeatedly. The ALJ (Administrative Law Judge) told me during my hearing that they're severely understaffed and processing appeals from months ago. Your best bet is to keep trying to reach someone on the phone to check your status.

My appeal took 11 weeks before I got the hearing notice in the mail! I was freaking out too, but apparently this is "normal" for NY unemployment. Yes, you should receive an acknowledgment letter within 2-3 weeks after filing your appeal. If you filed online through your NY.gov account, you should also see a confirmation number immediately after submission. You can actually request a reschedule if the time they give you doesn't work with your schedule. You need to do it ASAP after getting the notice though. I had mine changed from a morning slot to afternoon when I finally got the notice.

Make sure you're preparing for your hearing while you wait! I wasn't ready when mine finally came and it didn't go well. Gather ALL your documentation, especially any proof that contradicts why they denied you. If you were denied for misconduct, get statements from coworkers. If it was about availability for work, have your job search records ready. Don't just wait - use this time to build your case!

That's really good advice, thank you. I was denied because they said I didn't have enough work history in my base period, but I actually did - they somehow missed one of my jobs. I have all my W2s and paystubs ready to go. Just wish I knew when I'll actually get to present them!

i waited almost 4 months for my hearing last year. the whole system is a mess. when i finally got my hearing the judge was actually pretty fair tho. won my appeal. hang in there

yeah got everything backdated to when i first applied. took another month after the hearing but eventually got the full amount

One important thing to note: Once you do get your hearing scheduled, make absolutely sure you attend it! If you miss the hearing, it's extremely difficult to get it rescheduled and your appeal will likely be dismissed. They usually give you very little notice too - sometimes just a week or so. Make sure your address is up to date in the system and check your mail daily.
